there is no such thing as so close to getting his money back when you fraudulently describe an item and expect the buyer to eat any portion of the sale. You are supposed to take the shafts back, sell them for whatever you can get them for and then see your FRIEND, for the balance. This is not supposed to have any involvement with me WHATSOEVER at this point.

Josh,

The bottom line is- Do you think that your case would hold up in a court of law? I believe the responsibility is yours/ whether or not your buddy screwed you/ does not give you the right to screw an innocent buyer. You have to deal with your friend separately and learn from this ordeal.

ps.- If you don't have the money to cover the transaction ( if something goes wrong) , you should not be doing the transaction.

Yes you did. YOU were asked specifically to check them, and you SAID

"Selling one 1989 Paul Mottey custom shaft. I believe it is a 12.7mm so that's what I'm saying now but I am going to have it checked tomorrow so I will update the information then if I am wrong. Shaft rolls good. 5/16-14 thread and is piloted. Black collar with maple stitched rings. I believe the ferrule is Ivory and it has a moori tip. Shaft is in excellent condition as you can hopefully see from the pictures. Paul charges from $200 to $350 for a new shaft. Feel free to ask questions if I have left something out.

I REPEAT. I WAS SO UNSATISFIED THAT THE CUE WAS TOTAL GARBAGE THAT I JUST GAVE IT TO MY GIRLFRIEND BECAUSE SHE DIDN'T KNOW THE DIFFERENCE BETWEEN A GOOD CUE. I Said I would not mess with the likes again. I also told you all this in the PM's when we spoke of all this there. I told you there was no feedback left and why I never contacted you back. You said the cue was good condition and it was TOTAL GARBAGE. Try and spin it off all you like but we both know about that cue and what happened!!!!

I said you almost had all your money back and you could let this go and would receive the difference when my friend could get the money! You want to make a scene! I am doing the best I can do at this time. Don't you get that?

AND THERE IS NO FRAUD HERE!!!!!!!!! I DID NOT KNOW THE SHAFTS WERE THINNER THEN WHAT WAS SAID AT THE TIME!!!!!!!! I DID NOT KNOW AND TRY TO SELL THEM TO YOU ANYWAY!!!!!! THAT'S WHAT YOU ARE TRYING TO SAY!!!!!! YOU WANT TO MAKE THIS OUT TO BE SOMETHING THAT IT'S NOT!!!!!

I am not screwing him over. I am making every attempt and how can you not see this???????? He has the shafts sold for $125, I am giving $100 out of my own pocket, I have said that when my buddy gets the difference of the $75 that it would be sent to him!!! Wow, What's wrong with that????? In the end it would be resolved and Joe loses nothing!!! Don't tell me I am screwing him because what I just said clearly says different!!!!

Yes because that's what my buddy told me!!!!!!!!!!!!!!!! 12.7mm......... I would not put these up for sale at that size if I knew they were not that size. I thought it would be ok for him to check them and tell me. Obviously it wasn't. Again, I am making an attempt to try and resolve this issue and it's clearly shown in the posts. You are the one Joe, Who wants to keep this going!!!!!!!

Harboring a grudge like this over what I'm sure was something Joe would have refunded you for. For god sakes man, tell us, how was Joe to have known you were unhappy with that Nomina (?) cue.....book a show on Montel and ask Sylvia Brown ????

And now, bringing this into the play to add to the rest of your litany of snivelling excuses to not make the deal right. So, now that Joe didn't know you weren't happy in some previous deal, he should end up getting screwed here now ????

I guess you making this right is out of the question.
 
Josh, no one is going to convince you that you have handled this incorrectly. I'm certain of that because debates we've had here in the past with guys like Aaron Painter. Some people just don't get it. But here's a recommendation that should help you:

Go back and re-read every post in this thread....take notes. Come up with a forum concensus - that's a concensus of the opinions of your peers here on AZ - folks you want to do business with in the future. Study those notes, learn from them, then act upon them. Maybe you will still believe you are right and everyone else is wrong, but at least you will know how we EXPECT you and others to behave - and you will have it in writing and can refer back to it the next time you have a problem on here.

I also stated this when I said something about it. The cue has nothing to do with the shafts!!!! It was simply if he's going to question my integrity then his should be questioned too. What's writing him and telling him how I feel about the cue matter? As he is saying here about me, Something was described to be one thing and turned out to be another! If I am a bad person for something that was not done on purpose then what does that make him if he knew the cue was garbage and said it was good condition??? Really, Ask yourself that!!!! And your so blind as to not see I am trying to make things right???? I'll say it again.. He has the shafts sold for $125, I will give $100 from my own pocket. That's $225 out of $300.. The extra $75 will be sent to him when my buddy comes up with the cash to make the whole deal even.. I'm psycho? Your crazy for saying I am not trying to make good here!!! It's not about some piecemeal resolution offer that might come together sometime in the future. It's about having some integrity and your whole approach in this matter. You have still taken no responsibility for this.....it's your buddy's fault, but you sold the goods !@!@!@! runscott and others have alluded to this and plain flat-out stated it. You just aren't seeing it.

What can I do Scott? I do not have the whole $300 to give him back considering I didn't get a penny from the shafts. I don't have the $300. I can give $100 at this time. He can sell them for $125 today. That's $225 out of $300. The extra $75 will be sent to him when my buddy comes up with the cash. What more can I do? I am trying to make it right! I can't give him $300 if I don't have it to give right? How am I acting out of line? I am trying to make it right! Joe is the one who is keeping this going.

Ok, Like I said. He can have $225 out of the $300 back within 4 days. The extra $75 will be sent to him when it can be afforded. I have explained this very clear. I am trying to make it right. This is the last reply you get from me cueaddicts. Your the one who can't see what is trying to be done.

Did I send you payments?? Give me the same courtesy.. I don't care if you have to borrow the money from your mother, grandmother, clergyman etc..
I didn't pay you in payments and I won't take "payments" in return. Its bad enough I am obviously going to be out shipping. This transactions shouldn't cost me a dime. One other thing.. I am not a bank or a pawn shop, and I don't know your buddy.

Amazing thread. This has been an interesting read, right up there with E L Doctorow latest!

Here's the bottom line: IF the shafts were misrepresented, knowingly or unknowingly, unwittingly or inadvertently, and understanding that the buyer purchased them based on the info the seller gave him, and the info is not accurate, the seller has to make take full responsibiity and satisfy the buyer.

Stuff like this happens in all types of businesses numerous times every day. Any money out of the sellers pocket that he spends to make thngs right comes back 10 times over because he did the right thing.
