I'm running behind leaving WA state headed to the factory and then on down south because....i had a motorcycle accident March 28th at 11pm coming out of Toppenish, WA heading back home. Bad thing beside being beat to hell and back, because I didn't end up in the hospital 3 different law firms didn't feel i have a lawsuit worth their while. Riding from a city street to a highway on ramp getting ready to enter highway traffic going 55mph, and already traveling at about 40mph, i found out where all the sand and gravel was on the on ramp that was not visible to be seen that late at night and lost control of my motorcycle and slid and rolled according to the state patrol abound 70ft. I didn't receive any kind of citation as it was noted in the police report that the cause of the accident was because of the excessive loose sand and gravel covering the on ramp....GREAT, WASN'T MY FAULT!.....big deal, main problem was i didn't have injuries enough to gain legal representation to sue the state for as i found out later on, so i guess I'll be filing my own lawsuit for damages, so to start with, that comes to about $4,000 to fix my motorcycle. The road rash will heal sooner or later, still have some on my left knee 3 months later, but my right knee is going to require surgery to fix the torn ligaments....and i get to pay for that out of my own pocket as there is no medical insurance on a motorcycle to cover personal injury, so at any rate i won't be headed south until about the end of October is my guess. On a good note, i did get moved up to the Medical Lake, WA area which is where I'll be calling home for the rest of my life I guess, which is about 15 minutes West of Spokane, WA. So tbis is my new area to work out of when I'm at home.

This is what the on ramp look like at 11pm that the state insists they're not liable for because they haven't had time to sweep it since the last time it snowed....which was mid February, 6 weeks back.

This is what it loomed like in the daylight the next day. In the last picture at the bottom right you can still see my rear tire track mark.

Same intersection June 22nd, i guess they still haven't had enough time to sweep the sand and gravel off the on ramp making it safe for motorcycles.

Wow. Sorry to hear about all that. Always sucks to go down. I lost a Brother recently. Glad you walked away.

I know people value your work so much. I hope they can simply be patient and understanding.

.

Everyone I knew that lost life or limb on a motorcycle were experienced riders with years and years on two wheels. You can't drive for the other knuckleheads on the road.

I told this to my son in law, and he says, "You can't drive around scared like an old woman, you gotta be aggressive on a motorcycle".
I told my granddaughters "not his kids" and my daughter, if they get on the back of it with him, they are as goofy as he is !

I've rode my motorcycle more than 20,000 miles in the last 12 months and have been driving for over 45 years, there's a reason why I've never had an auto accident, it's called driving with anticipation of what can happen in the next few seconds to come, in other words...expect the unexpected. The accident with my motorcycle didn't involved any other vehicles, and had nothing to do with negligence on my part but rather on the states part to perform their job of maintaining safe roadways.

Hope you get better soon

Hope you come to Louisiana, call me if you do, need your expertise making my diamond table play perfectly, thanks, Gerald Huber (504) 451-9603

Sorry..

So sorry that happened to you. In Alaska we have a "basic speed law" and often those in a single vehicle accident are cited for "driving to fast for the road conditions".

The states argument is that if the driver had been going slower the accident may not have happened. Up here it usually involves snow and ice.

The posted speed limit is not a consideration under the "basic speed" law.

That won't hold water seeing how the State Patrol cited the cause of the accident was loose sand and gravel covering about 1/3rd of the hwy on ramp, and didn't issue me a citation what-so-ever.

I'm sure he'll get down there eventually. He's not ready to retire yet! I hadn't known about your book but will get it.

I had a wreck similar to that in 1962. The county had left a bunch of gravel on the road at the ending of blind curve. I was thrown from the car, ended up with a back broken in 5 places, a ruptured spleen & wrapped up in barbed wire. Spent 43 days in the hospital & a year later I learned to walk again. Dallas county said I would need their permission to suit. And I would have to prove they done it.

I ended up 2-3 inches shorter, scars everywhere & a bill that took 15 years to pay off... been there done that.

Good Luck to you.
