Did you happen to know that the cue tip covers were invented by at least two other people before you?

Ralf Souquet's father has been making and selling them for I think about 15 years or so.

And a while back about ten years or so there was a guy from the NorthWest who did a lot of knick knack items for pool, among them a Foam Bridge head that was pretty good. I believe he had cue tip covers as well.

Not saying you didn't come up with these on your own independently of the others but just making you aware that other people have had the same idea on the market for a while now.

Even with your patent though I don't think you will be able to do much about someone making them in another country.

But good luck with the fight. Sucks to have a good idea and put a lot of effort into it and see it knocked off.

I still think you not draw attention to the other guy - because IF his product is a better "value" than yours then a percentage of people will gravitate that way. Telling people to stay away from something pushes them to go look at it and if they like what they see they might end up buying that and telling all their friends to buy there instead.

John you seem to know more about Pool than most people know about what they ate for Breakfast!
 
I have a Patent Lawyer. I spent close to $5,000 to Patent my invention and to get 2 Trademark Registrations.

And I spent $40,000 suing over an infringment of my trademark and in the end only got a settlement agreement which wasn't fully adhered to. Then I was advised by my attorney that it would be another 20k to make them stick to the agreement. I received no compensation for the product sold bearing my trademark, no damages for loss of sales, reputation, goodwill etc..... In fact the only reason we settled is because my attorney said that it would cost another 40k to go to trial.

I really hope it's all worth it to you. I have sympathy for where you are at mentally with this. It's a brutal world these days on the IP front.

That is why the Cue Tip Covers were never Patented. My Lawyer did a search for just that reason. No Patent is in force, but product was already out there. Although my version is different from the others...It's too close to be patented.

One thing though...Money is not an issue for me. I will do what is needed to put him permanently "OUT of BUSINESS". He stepped into a "Hornet's Nest"...He just doesn't know it yet.

Is saying "money is not an issue" in a dispute like this the same as when two people are woofing at each other and one says what do you want to bet and the other one says, bet what you want? (meaning the window is wide open).....

For me money is always an issue. But if you can afford to go after him with the intention of putting him "out of business" then by all means spend that money. I am sure that there are plenty of people in the middle who appreciate the business. They love the emotionally driven "money is not an issue" crowd.

I don't have legal woes. I was merely illustrating that owing a Trademark or a Patent does not include "protection" against infringement.

No one but the IP holder is going to care about or monitor infringement, nor do anything about it. Getting a patent or trademark only registers that the IP holder has established a claim to the IP. That doesn't mean it can't be copied or contested.

Patent examiners award patents all the time which are later struck down when contested in court.

I was merely illustrating to you that after you GET the patent or the trademark then you have to DEFEND it when something happens. In some cases that defense can be as cheap as a cease and desist letter from you, or a $500 C&D from an attorney, or as expensive as several thousand to file suit, pay for every deposition, motion, phone call etc... you start to think about these things when you are being billed $200 and hour and your lawyer asks how the weather is.

Most "regular people" have no idea of the complexity of intellectual property law. They think that getting the patent or trademark is the holy grail and now they are set. It's just the necessary first step in the long and unending fight to protect your IP.

That's the unfortunate part.

To me I think that the patent and trademark process should be more rigorous but with a CLEAR time frame of either acceptance or denial. Then I think that infringement should be criminalized just like any other theft. If infringers faced serious prison time then a lot of the small time guys would think twice about it.

And actually there is some forms of "protection" that the government offers. For a fee you can have your registered patents and trademarks tied to the US customs database and then they will try to catch unauthorized imports of goods which infringe on your IP. If you know of a store selling knockoffs of your registered goods then you can have it raided by the US Marshal's service and shut down.

I doubt very much though that they will put cue cases and FingerSlides high on the priority list of things to watch out for.

Sorry...All I meant by "Legal Woes" was the fact you spent so much money and didn't acheive the results you wanted.

I am aware of the US Customs Database. My Lawyer educated me on that option. Let's say that is all taken care of.

I agree that stiffer penalties should be handed out for IP theft. Jail Time would stop thieves and make them think twice!! Good Point!!

(This was posted in anger...And I appologize to the upstanding members here. If you knew the WHOLE story, you would understand. My Lawyer Strongly advised me to have nothing to do with Pocket Chalker. This was a result of him buying the domain, FingerSlides without my knowledge. I was informed about it "after" he bought it. For some reason Pocket Chalker thought we were in business together. I never agreed to anything and this so called business relationship he talks about only exists in his "mind". He knows the TRUTH, he just won't admit it. He jumped the gun and spent a lot of money without confirming or even asking if I wanted to do business with him. If I POST anything about him, it's to make other inventors aware of his practices. I just wish someone had done that for me.)

This is bazaar. Why are you going back and forth trying to get in the last word. Just pay attention to your business and forget about all this. In fact, all business people should stay away from these internet boards. They think some how it is free advertising, It isn't. And the worst case scenario you can end up defending yourself to a lot of faceless trouble makers who honestly don't really care other then to get a rise out of you. I am not a forum moderator so I usually don't like to post like this but come on. This isn't second grade. These insults are a bit over the top and should not be brought to a public forum.
 
I'm not one to throw insults...I'm just calling a spade a spade.

This woman led me to believe that we would work together and after I didn't get hundreds of hits on the domain name she assumed I was stealing her product. Before there was even one made she wrote to About.com, who was actually doing a write-up on my products. She wrote to him and slandered me and has been lying non-stop ever since.

Now there is a thread with my name in the title accusing me of some lame BS in a forum where I have built quite a few clients and many room owners come and read.

It kills me to stand by and watch this. It eats me up inside knowing just how hard I tried to help her and she is doing this. I was prepared to help take her business places she only wishes it would go and now this. It's pretty frickin' rotten.

And the insults she's throwing out there should tell you something more about her. She doesn't contradict what I'm saying, she just says stupid things...

Ok...so I'm no spelling bee contest winner but I always thought that the word 'since' meant from that point in time until today. So I thought that 'since 2009' meant from just a couple of months ago. My bad.

Anyways...I'll be putting my product back up on my website soon enough. And they are going to start appearing in stores and on other websites soon enough.
