Illegal Break in 9-Ball and 10-Ball

I have a rules question I need help clarifying. I currently play in Germany where they follow World Pool Association rules for the most part with minor tweeking. Here when a player fails to make a legal break in 9-Ball or 10- Ball(failure to pocket a ball or drive 4 balls to a rail) they play that the incoming player has ball in hand. So if a player miss cues on the break and misses the rack completely, most of the time the incoming player takes ball in hand and grazes the 1 ball postioning the cue ball behind the rack. I even saw this allowed at the recent Euro Tour event in Austria. Has anyone else seen this play out in a professional pool tournament?

No, its the other part of driving 4 to a rail.

Illegal breaks over here are also BIH, however I have not seen anyone tweek the rack and end up behind it--sounds like a one pocket strategy.

If you don't pocket a ball or drive 4 balls to a rail yes is a foul. Its normal for it to be an illegal break in this situation but only here in Germany have a seen players try and 3 foul someone from a miss cue on the break
 
I think it should be that the other person gets to break a new rack. Not ball in hand, until a legal break is made.

It's the standard shot here in the UK, and makes sense - you have to be very precise to hit the one from behind the pack, plus there's the chance of scratching if you do.

The standard response is to scatter the balls far and wide, in the hope you get an easier kick on the third attempt.

Regarding 10 ball breaks, what's the rule with potting the 10? I did it twice the other day and neither me nor my partner knew what the rule was - obviously it was respotted, but do you maintain your visit at the table?

Yes I have seen it in a pro tournament. Jose Parica did it to his opponent in the 10 Ball event in Vegas about 3 years ago. Can't remember if it was the US Open or the Predator 10 Ball tournament that preceded it. BTW, his opponent did manage to kick at the one when on 2 fouls so he got out from under that predicament. Can't remember who ended up winning the rack.

More recently I seem to recall Oscar Dominguez doing this on a streamed event within the last few months.

The correct action is to exactly that, position the cue ball close to the rack and play off the 1 ball so that the CB goes behind the rack.

It never ceases to amaze me that so many players have either never read the rules of play or have not understood them.
