I know the logistics will not be easy but someone needs to stand up
for the players.

That is not remotely possible since they are owed money and getting paid is solely up the IPT. The players have NO power at all and the IPT plans on keeping it that way, they would be too afraid to not show up. All you have to do is read this quote from KT way back in the beginning.

The players are helpless and Kevin knows that, he doesn't really care, if they don't show up then there will be no tournament and he moves on, big deal. It was never his intention for the players to ever have a say in anything. Let's face it, the players are at his mercy no matter how you look at it.

He could care less if he uses pros or a bunch of amateur bar players, like he said, "no one outside the billiard world will notice".
If you study this thing from the beginning whether success or failure, it is clear what it was to be and it was not player oriented, no matter what they tried to project, the players were and are totally expendable. If they don't what to play he will find someone who will, he is dealing with desperate people, his usual M.O.

Sometimes standing up for principals when there is no real alternative is not a good idea. Unions are usually formed after the business is making money (or the executives are making a lot and not leaving the profit in the business).

Even if you think there is only a five percent chance that there will be any tournaments next year, is that better that demanding an escrow account and having KT just say "forget about it, it's not worth the trouble"? I don't know the right answer but that is what the players have to consider.
 
i wont name names, but i just spoke with the player who would be the obvious choice in leading the players into forming a protective association. His response was, "never in a million years". He went on to say, the players would never "draw a line in the sand", with them on one side, kt on the other, effectively causing an us versus the ipt.

The players are aware that the ipt holds the power, and more importantly right now, the money.

Interestingly enough, although the player is hopeful, he suspects that the players WONT get paid. If it's over, everyone involved has made some money. He feels most badly about the qualifiying players who participated in reno, who paid to play, and those that are still paying to qualify.

Interesting insight.

Keith, you are correct, and such a stand would be primarily
"principal" based.

From a financial standpoint, KT ha the upper hand, but sometimes it
comes down to self respect, after all, the players survived long before
the IPT ever came around.

Also, I don't entirely agree that the players are powerless, KT needs the world's top players to make the tour, and he knows it, anything he says to the contrary is just bravado imo.

In any case, I realize it is easy for me to make such statements without
being in their shoes however I can say that I have been in similair situations.

Wait-Everyone has made some money? Did he mean players?

Assuming no further payments, the guys who finished last in Vegas what 80 guys? got $2k!!(not 5 like Reno didnt pay!!). They had to shell out for Orlando remember (tour players), shell out for Vegas and shell out for Reno.
These guys got hurt pretty bad especially if they sacrificed work, family etc.

Why?

It's only been 26 days.

Chicago is still 51 days away.

Besides, who in the pool world would the players back and follow? How about John Di Toro? Oh wait, he has own tour. The Florida Pro Tour. In fact they are in West Palm Beach this weekend. I'll bet there will be a big turnout for that one. All the players will be looking for info as to what is happening with the IPT. At least John will have the cash there.

Somehow I suspect if the players from Reno are not paid before the Chicago tournament the players will not bother to show up for the Chicago Tournament.

Exactly, gives them time to get something together, at the very least shows
KT that they can't be pushed around.

Also, 26 days late payment is a fair amount of time already, but significantly worse when you have NO idea when the cheque is coming.

First of all, I believe everybody WILL get paid. I have said all along that this pay issue is a non-issue.

For what? They have no leverage at this point. Kevin offers big money. The players show up. Kevin delivers on the pay day (we hope). The players have more money and KT can do no wrong because you don't bite the hand that feeds you.

You need to realize that players organizations have been done in the past and they have failed miserably. Organizing something now would be the same as calling a fire inspector after your building has burned down, all they could do is assess the damage and offer condolences.

Last year I said that the IPT players needed to have something in place that protects them. I offered to assist on a voluntary basis - free of charge - to advise and organize that initially. I was told to STFU, I was called a negative naysayer, a douchebag, enthusiatically negative, or whatever else some of them could dream up. That speaks volumes of the maturity level of the people involved in the massive IPT rah-rah movement. Not dealing with the existing problems within the game will eventually come back to haunt them. Money won't solve anything. It will only complicate matters. That is not being negative, that is a fact of life and they need to deal with that internally or pay the consequences.

The fact remains that there are holes in the ship. It didn't have to hit an iceberg to sink the ship, it would sink by design. Calling for a a mutiny while everybody should be trying to keep the ship from sinking will accomplish nothing but speeding up the inevitable. Is the IPT in trouble? I don't know. I don't think it is in danger of sinking right now, but I do believe that Kevin is sweating the fact that he isn't making a profit, which is why he is trying to unload it and get out of town (just like I said he would 1 year ago in a thread I started).

Any type of a player's organization would have to be separate from the IPT, and set up to represent the players arbitrarily. It has always been my recommendation that NO PLAYERS be involved within the working of this entity. That would eliminate any and all conflicts of interest. This type of organization would work with the IPT and the players to ensure that both sides are treated fairly.

The problem is many within the IPT see this as an intrusive, offensive proposition. It is not. In fact it would strengthen the relationship between the players and the IPT, and it would also give the players a sense of security in issues regarding fines, payouts, judgment calls, and it would lead the way to establishing exemptions for HOF members, tour champions, and other issues.

Will this ever happen? I hope so. The main problem seems to be that Kevin is not receptive to having anybody tell him how to run his business. In his case, if you don't have a portfolio that rivals his own, he wants nothing to do with you and he won't listen. With an attitude like that this venture will fall by the wayside like his Mega-Memory System. That's sad, because many people have put a lot of faith in this and have dedicated their lives to seeing this thing materialize into a profitmaking venture. I contend that if a player organization was in place, the pay issue from Reno would have been addressed immediately - privately and publicly - FOR the players. It would have relieved a lot of undue stress and worry from their lives.

Nevada State law's guidelines for paying employees is:

Nevada Semi-monthly; FLSA-exempt employees paid by out-of-state employers can be paid monthly Wages earned from 1st-15th, pay by end of month; 16th-end of month, pay by 15th of next month

Even if they are considered contract labor (1099 form) and terminated, the IPT will have to pay by either 30 or 60 days (I don't remember which).

If the IPT fails to comply with State Payroll laws, it can be charged with a misdemeanor for each occurance, and fined $5,000 for each occurance.

The IPT has to comply with the FLSA (Fair Labor Standards Act) and Nevada State Payroll Laws (Employment Laws), or else it will be in REAL

Is there a definition for laborer where you are getting this information?

Does the guaranteed minimum make them employees or contract labor as opposed to (for lack of a better term) contest winners or prize winners?
 
The truth is the players needed a union long berfore the IPT ever
came around but most of them will never see the benefit to it.

Hi Scott. First the FLSA has NOTHING to do with independent contractors and ONLY has to do with "employees." Anyone who properly is issued a 1099 is specifically deemed NOT to be an employee so the FLSA cannot possibly apply.

As independent CONTRACTORS any disputes between parties to the CONTRACT must be submitted to CIVIL and not criminal litigation. The matter would be one of filing a breach of contract action in a civil court. No one gets arrested for breach of contract unless there was criminal activity associated with the act being complained about i.e. embezzlement would be a fundamental breach of contract under, among other things, the "implied convenant of good faith and fair dealings" to which all contracts are subject...but embezzlement is also a crime so actions could be brought in BOTH civil and criminal courts.

Furthermore, where Nevada law would applicable AT ALL would depend on a lot of things including where the contract was signed and what "governing law" provisions might be in the contract.

Besides, if...as I hope will NOT be the case...the IPT cannot pay what it owes to the players, it will file bankruptcy and all those claims will get blown away anyway.

I believe you 100%, all the IPT players in the top 100, please don't show up to the Chicago tournament. amc
 
Organize the Players

It's been tried a million times before and here we are with our hands out, begging for a few crumbs. We need more legitimate promoters like Barry Hearn, Matt Braun and Allen Hopkins, Mike Zuglan and Danny Janes who pay out REAL MONEY for REAL PLAYERS.

The player's voice will be heard in Chicago if no one is paid. They won't show up! That is the loudest statement of all.

I'll make you a wager, I say at least half the IPT members show up
for Chicago regardless of what kind of payment (if any) they recieve for Reno.

I say this because I believe the players will feel they have no other
choice.
