Hi Guys,

Just wondering if anyone know how I can recoup my money and cues sent to an individual who hasn't deliver on the good. The payment were made via paypal about 4 and 7 months ago totally about $900.00 via my chase bank. The payments were made to a person I've trusted who ended up lying and I think have already stole my goods. Been promising me for ages now that he will deliver my cues which I've sent for a refinish and rewrap along with blanks for conversion. I really liked my Weinstock cue but I now have little hope to ever see it again.

This individual was on AZ at one point and got kick off. Anyhow, I knew he have been in a jam for some time now and I figure he had to hustle me for the money to feed his family. At first, I thought that giving him the cue works could help him out and he did delivered on my refinished Miranda and the work wasn't bad but my weinstock and several other conversion has yet to arrive and it's been almost a year now.

He had a few ideas on doing some conversion using my full splice blanks and selling them for me but con me into giving him the inventory and money to make the cues that I've have not seen of for many months now. No pictures, no update...just promises that comes and go.

I spoke to my lawyer, he basically tell me it's a waste of my time to try and recoup the money and good especially if he's broke. He suggested that I try small claim court to claim the good as my loss is estimate to be around $3000.00 but I don't think he working. Althought, he say he made good money as a manager with a dealership, I don't think it's the case. I have his old address but he was careful enough not to give me his new address which I need to submit paperwork for the small claim court. I have his recent number but the number doesn't accept in coming call. I think I can still find his information as I have his number and name which can be search online.

Anyway, any advice, suggestions would be appreciate in regards to this matter.

Regards,
Duc.

I think small claims court is probably the best way to go. What does paypal say about getting the money back? It is probably past the deadline to file a claim with them. I use a credit card when sending money through paypal. If paypal does'nt do anything the credit card company will. But it usually has to be done in a short time like 30-60 days. Paypal does not like you to use a credit card because they have to pay a fee. Using the credit card gives you extra protection.

never, ever, ever, ever, EVER pay on paypal with bank direct debit or check. ALWAYS pay via credit card. When you pay via direct debit or check, paypal is fully within their rights to say to you, "Damn man sorry you got ripped off. We couldnt recover anything. Sorry again your shit out of luck". By paying via credit card you always have recourse of going to your credit card and disputing the charge.

Also even if Paypal recovers anything, they charge you $25 for the dispute process. F*k that man, you do a chargeback and get 100% of your money back if you have been ripped off.

He's running a biz right? Contact his state's Attorney General's office and file a report against him. If he is operating without a license, he will face fines. The AG's office is usually pretty good about helping to solve a situation...but it really depends on the state.

I'm pretty sure I know of whom you are speaking...and it's a shame he has chosen to bite one of the few hands left that would feed him.

Duc,
Sorry you've been ripped off.

I'm almost certain I know who you're referring to. There's not an honest bone in his body.

Start with PayPal, just to show you tried . Contact your Bank (Chase) next.

But definitely contact the State Attorney General's office and they will steer you in the right direction. I'm almost positive you will be calling the ILLINOIS AG's office. It's not the first time they've heard his name.

We don't have debtors prison and you can't squeeze blood from a turnip, so you may not see your money again. But you can make his life hell and have judgments issued. It is time consuming, but in the end it might prevent someone else from becoming his next victim.

Take care,

Don't bother with Paypal.. if he doesn't have money in his paypal account they have nothing to give back.. and you can bet he has no money in there.

I don't know how anyone else feels, but I think guys like this should be outed on here to protect other members of AZ. Am I wrong to feel this way?

No, you are right, they should be outed on here way someone elsedoesn't get burned. As long as whoever puts it on here has the facts right. By the way...did you get my check yey?:D Johnnyt

Thanks for the feedback guys... I've received several email from people with good advice and they also figured out who it is. I understand the guy ran into some financial issues and really don't want to bash him anymore than what he has already done to himself.

I regarded him as a friend through many of the conversation that I've had with him at the beginning of our transactions and he seem like a decent gent who just trying make money to support his family. I guess he just did what he has to do to survive. (Just bad luck for me I guess) I've already told him the situation he's in today is a result of his own actions.

Anyway, After looking at the cost of small claim which is about $300 for filing papers etc...not to mention time which i really don't have... I think I'm just going to play it by ear and hope one day my cues will show up.
