I bought a cue from overseas
paypaled the money now dude is saying it was lost in shippment
anyone have any experieance w this kinda situation?
will i get my money back?

Um, you have been scammed 100%. Unless you did it through ebay where you have some kinda recourse, your f@#ked. I do not think paypal has a way to disbute this unless through ebay.

The prior explaination is incorrect. In fact you have several months to file a dispute.

The 2 main disputes are
1)Item not received and 2) item not as described.

Go online and file the dispute right away, then call customer service.

The seller has to provide tracking info. If he shipped an item unisured then it's his loss NOT YOURS.

As long as your Paypal payment or invoice clearly states that you paid for merchandise. He has to demostrate that it was delivered, by delivery confirmation/ signature required.

Hopefully you paid the Paypal bill with a credit card. If so call the credit card company as well and ask to initiate a "chargeback". This is where the credit card company witholds payment from Paypal, thereby putting pressure on them to rule in your favor.

If Paypal is owed you can bet they will rule against the seller, and go after his credit score and undertake collections.

If you need any guidance here, please PM me. Also please out the guy who sold you the cue, especially if he was from AZ. We don't need sellers like that here.

Sellers should always insure the items against loss or damage, because if they are lost or damaged it is their responsibility, not the buyers. Also sellers need to hold onto the delivery confirmation slips for 6 months in case a claim is filed late by a bogus buyer. if you can;t prove shipment, you will lose any dispute...period.

As i said, i didnt think paypal offered its own recourse outside of Ebay, according to you, I am wrong. I would not argue that at all as I know very little about paypal over all, but please reflect the first part of my post as being correct. 100% he got scammed (ok 99% just in case).
 
Master9 is correct. I returned several jump cues due to Not as Described.

The seller picked up the cues and told Pay Pal that he had not received them. Once I provided PP with the Tracking Number, he was screwed.

Same thing, if he can't provide PP with your item Tracking Number, he is at fault.

File as quick as you can and good luck.

PP is a third party credit card processor, for which it means the merchant doesn't get to know your credit card information but rather use PP to accept credit card payments. So when you file a chargeback with your credit card company, Paypal is responsible, not the merchant. Therefore, you will get their attention when a chargeback is filed.

I'd advice to first go through the dispute channel on PP and demand a tracking number. If all things fail, file a charge back with your credit card.
 
Also, if the item is delivered and damaged and the seller attempts to file an insurance claim with the shipping carrier, you're normally asked to ship back the item to the carrier. If PP is used, NEVER EVER ship the item back to the carrier (UPS, Fedex, or what not). Always ship it back to the seller and have the person deal with the carrier himself. This is a typical scam when a person intentionally ships a damaged product, and have you return the product back to the shipping carrier. When Paypal asks for your return tracking number, the zipcode/city has to match the merchant.

Did you buy it through Ebay? You may have a chance if you did if not, paypal will not help you. This also go's for items sold and sent overseas, if the Credit used turns out bad they will hold you responsible even though they allowed the card to be used on their site.

Goin out on a limb here...But Instead of providing the already great advice here. if you feel so inclined, can you reveal the sellers name, sourse of sale, etc. so that we may ensure we are protected against this person in the future.

It would be appreciated.

I buy online all the time. Just file a claim with Pay Pal right away. I agree with other post. If you used a credit card through Pay Pal call your credit card company and report as item not received. Having your Credit Card Company on your side can't hurt!!!

I have only had to file twice for non receipt of purchased item(s). In each instance my money was refunded within 5 days. Good Luck!!!
 
I think it's great people here are able to help. I'd like to think they know all this information because they are well read not because it has happened to them; however, i think that is not the case =/

There are ways to cover yourself 100% as a buyer and a seller. Sometimes using escrow is the best thing. I have had it work in my favor several times. Where the cue has a flaw and my escrow agreed. The repair costs are taken out of my purchase price or they get their cue back. That usually makes them see the light.

If anybody needs an escrow there are several available here, and I could help as well.

I use a local cue maker. It gives me the benefit of his expert opinion, with a repair quote, plus I can look at the cue myself. It works very well for me.

Master is right! I got F'ed twiced. File a claim and you should get a refund. Get ready to wait, it took my claims 4-6 weeks.

I bought you the P3, didn´t get it yet nor the tracking number , and i'm not worried yet too, because as some friends from this forum told you, you can allways open a dispute against this seller.:wink:In case both of you don't get an agreement i think Paypal will refunds you. That's all what i know.

Chinese scammer

I let her squirm for about 2 weeks so she could feel the burn a bit. Fair is fair right? She got her money back in time and got booted from here beccause "her" attempts at scamming. How many Chineses school girls do you know that are looking for $3000 player cues!!!
