What would you do? cue deal gone wrong

Looking for a bit of advise here. Here's the story

I agreed to buy a cue from a guy on here who lives in U.S. We agree a deal and i send him money through paypal.
He says he will send cue the next day.
Next day comes and he says there's a problem he needs to wait 3 days for the money to clear into his mum's account.

I respond saying once paypal says you have funds the money is yours why the delay? He responds saying he has no money to pay for shipping and will have to wait for the money to clear.

So although i'm little pi**ed off about this i wait the 3 days and pm him asking for an update, has the money cleared? has the cue been shipped? and i receive no response. I pm him every day for the next 4 days asking for an update and receive nothing back, he has been on AZ every day but decided to just ignore all my messages.

So i start to think i've been scammed and give him 1 last chance saying i will submit a claim though paypal tonight unless i receive a response.

So eventually i get a response saying he is sorry for not getting back to me but there is a second problem the money went to his mum's account but he lost it because it cleared her overdraft! he should have the money this week and i am his main priority. He then asks me to be patient with him as he is really broke at the moment and has no job.

I pm'd him back saying i want some answers or a paypal claim is going to happen i want his address and phone number, when exactly will he have the funds? why he ignored my messages? and why did the money clear his mums overdraft surely you would know it was going to do this?
I tell him i want an immediate answer and again i get ignored.

So what would you do? The guy i agreed the deal with has 1 itrader 100% and 300 posts i don't want to unveil him yet untill i decide what to do, and I know its always a risk buying something from a random person and escrow is best but the cue is only worth $235 so not huge loss but thats not the point.

Shall i give him till the end of the week to get the money and send cue?
Should i go straight to paypal and bust him?

what would you do?

If I were you, living overseas, I'm calling him out, right here, right now.

If it's gone exactly like you say, you've been patient enough.

His mom isn't selling the cue, he is.

I've seen the power of AZ work, might as well use it. If he frequents as often as you say, he obviously enjoys AZ town. Light a fire, and watch it work.

If I were you, I would expect him/her to uphold their end of the deal and ship the cue ASAP. I understand that things happen, but, a deal is a deal. If things did not go as planned for whatever reason, he either needs to refund your money or ship the cue. The least he can do is make arangements with you and set a concrete time for shipment. It is sad that just a few make it tuff on the honest people.
 
Call him out right here right now the only thing you can do, wether it's a scam or not it just sounds so bad.

What is he 12yrs old, using his Mom's account and clearing his Mom's overdraft thats so Lame!
 
He sounds like a young person in dire need of a lesson in integrity. I would submit a claim and have paypal pull the funds from her account. In the meantime, I would communicate respectfully and save every correspondence.

I would NOT believe that your item is in shipment, even if the seller says it is, unless he can produce a viable tracking number.

Once, I won a paypal claim and my funds were refunded...then the item arrived. No harm, I simply sent payment a second time. Good luck
 
It sounds like you have been more than patient. If he has had your money for a week or more and hasn't shipped then there is no excuse. I would start the PayPal claim process now, because that is going to take a few weeks anyway.

Like Kobachi said, I would recommend calling him out here as well. If he values AZB he will do the right thing, and also he has a chance to tell his side of the story as well.

I'm giving this guy till tonight to get back to me and when is going to send the cue.

If i don't get a response or a definate shipping date then i'll call him out on here and submit a paypal claim. He has had enough time to send the cue and i've ran out of patience with this. I've got every single pm from him with his lame excuses.
 
I would def. throw him under the bus, you have been more then patient with the guy. I believe AZers need to know that the guy now has a history of poor customer service and it could prevent headaches for someone else.

I agree with another poster above that this sounds like a younger person you're dealing with. It's not your fault he doesn't have his own account, or that the account he chose to use is in bad standing. You shouldn't be penalized and made to wait because of his lack of responsibility.

I think he threw himself under the bus. This guy seriously can't expect you to believe that he can't come up with the money to ship your cue.

The last cue I shipped was wrapped in velvet and bubble wrap, put in a pvc tube with two caps (which I bought), put in a USPS Priority Mail box with insurance to $2000 and signature delivery which came all together around $40. I doubt he would/will ship this cue with all that extra packing/deliver insurance so it shouldn't cost that much.

Get in touch with paypal and let them know they will freeze up his money .
 
Through a simple search, I see the member in question.
I had a run-in with this gentleman last week.
He was wanting to purchase a cue from me.
So if he wants to purchase a cue from me, how can he be broke?
I say file a claim with paypal, they will hold the money until the situation is resolved.
It will definitely get his attention.

I would approach on two fronts:

1- call him out on AZ
2- start you claim with PayPal

he has committed fraud, you are the victim... no reason to extend him any more courtesy

may not be his 1st or last scam
 
Money you pay to him through paypal does not go directly to a checking
account. He has to actively transfer it to the checking account from his paypal account. That usually takes about 3 days to clear. What he has done was to clean out his Paypal account before you could grab the money back. There is no recourse to him now. It's sorta like you've gone to the county fair. As we used to say you been screwed , blewed. and tattood

I had a run-in with this gentleman last week. He was wanting to purchase a cue from me. So if he wants to purchase a cue from me, how can he be broke?

I call this "the sap factor". Criminals prey on the goodness of others. He played the "I'm broke and don't have a job" card in hopes that you would be a "sap" and feel sorry for him (as most decent people would). Meanwhile he's trying to buy a cue from someone else at the same time.

You're not dealing with some broke kid, you're dealing with a crook. Out him and file a claim against him.

Yep you've got it ALMOSTGOOD is the user in question, i'm submitting a paypal dispute right now. Don't deal witht his guy he's a scammer.
I paid through payapl with my credit card so hopefully i've got 2 ways to claim if paypal can't do anything.

This is the same as I was thinking. I don't really have that much experience with PayPal but it appears as if the seller knows how to get around the PayPal "protection". It seems as if he knows that if he can stall long enough PayPay and/or the credit card companies cannot get the money back from him.

Think about it. The question will be if there is a problem why did you wait so long to report it. Now you become the problem.
