UPDATE for getting scammed by Rusty Cannon from North Carolina

Send a copy of the original police report to Lexington PD. If the report is classified as a larceny, the Lexington PD will assign the case to a detective who will contact "Rusty Cannon", and see what he has to say. As a retired NC LEO, I doubt you will find a copy of a report. These situations usually come down to he said vs he said, and the officers request you to file civil papers. All "Rusty" has to say, is that he sent you the bow, or that he never received the cue. There is NO physical evidence in the case, if the cue has been re-finished, it cannot even be identified as your property. It is a bad situation.

Like I said, it will start with a copy of the original larceny report, that is your first step.

I will help if I can, as I live in Lexington, am friends with the Chief of Police, and am familiar with the Mocksville room. For what it's worth, I have never heard of "Rusty Cannon".

And, for the final time, without a copy of the original larceny report, nothing can proceed.

Thanks a lot. And ill try and get a copy of the report. And I do have the shipping information still. And I may still have a picture of Jen I tracked the package that an R. Cannon signed for it. And wouldn't he also have to supply proof that he sent and I received the bow package? And I have a witness from gate city billiards who seen Rusty with the cue before he knew of my situation. According to him Rusty was saying he won the cue or something dumb.

And anyway, his ex-gf saw my previous thread and contacted me saying rusty scammed her out of $800 and she hasn't seen him. But she just recently made me aware of his Facebook and I got a picture off of that. Not sure if its really him for sure but it's worth a shot putting the pic up. If someone can help post it ill send to their email.
Thanks,
Tim

If you are not aware of me getting scammed, ill be posting the link to the original thread. Anyway I basically was contacted by Rusty Cannon from Lexington, NC about a Schon I had listed on Craigslist. He wanted to buy it and then we got talking and about how I wante to buy a new hunting bow with the money. He said he had one he hardly used and a bunch of accessories so we were just gonna trade. We were talking for about a week so I felt comfortable with it, but in the end he never sent the bow.

Update: I've located the Schon wrapless LTD that I sent to Rusty. It's probably been 4-5 months since I located it, so who knows its probably gone. But Rusty sold he cue to one of the owners of Court Square Billiards, Mocksville, NC. "Steve" one of the owners actually read my thread and called me and sai he felt bad but he thinks he bought my stolen cue from Rusty. I described it and sure enough he said that's the cue.

Steve is a newer member on here as "pmracer". He hasn't been on much since he contacted me about the cue. He said he felt bad about it and that Ill just had to learn an expensive lesson. I'm not sure why I would have to learn the lesson? I believe he would be in possession of stolen property so I may pursue that avenue, but the way the police work it'll prob have no good outcome. He may sold the cue already since its been months since be first called me.

I'm thankful he called and I feel bad having to go about it this way, but he was supposed to call and give me updates if he had seen Rusty and never did. And I have tried contacting him about just buying the cue back even and he has ignored my pms. He said he had three businesses and at the time I was really hurting for money. So I just think it's unfair fr him to keep my stolen stick.

Anyway just wanted to get some outside opinions? Or if anyone knows Steve to see if we can work something out before more police action gets involved. Also I want to discuss Carolina Customs. From what Steve said his buddies at Carolina Customs refinished the Schon because it had a distinguishing chip down by the logo. I have emailed Carolina Customs telling them the whole story and just wanting to know if they did refinish it. Because it'd be hard for me to distinguish it as mine now since the chip is gone. And they were giving me a big run around. That they might have refinished it and that they can't remember, they refinish a lot of cues. And then they might have said that they probably did. Not sure how you can forget you refinished it only a month or two after you did it? And the stick was a rare cue from supposedly one of your "buddies" ? But anyway I guess they wanted to act shady and not be 100% honest because one of their friends brought in the cue.

Also I have recently gotten a picture of Rusty Cannon that I will be posting or if I can email it to someone to post that'd b great. I can't get pics to post with iPhone. I feel the need for some type of justice to come about this. The police aren't acting so Im looking for help.

Soooooooo anyway can I get any advice or help with this matter?

Thanks and sorry for rambling.
Tim

Thanks for making people aware of problems that you have with losing your cue. It seems that you do have a legitimate complaint with the person that took your cue and anyone that tells you that they feel bad about buying your stolen cue and it is your loss. If you buy stolen property it is not your property, no matter how much you may have paid for it.

Having said that, there are several things you have said that leaves me questions. First, you should have immediately pursued "police action." You are correct in thinking that it would probably have no positive outcome when you report a crime six months later. By the way, if the cue was shipped outside of NC, it is an interstate crime (fraud).

Second, I have been to Carolina Cues on four or five occasions and have seen the cues that they have to in the finished for deliver state. I cannot see how they could remember a chip on a cue that they refinished a month ago (much less longer than that). Also, knowing the guys there, I can tell you that they would never jeopardize their ethics by hiding anything. Trevor runs 3 or 4 businesses out of that shop. His reputation is highly important. He relies on relationships with fire fighters, law enforcement and many others in addition to the pool playing community. He would not jeopardize those relationships to cover up any crime. And to try to bring them into this, seems to me that you may be reckless in accusations. And that makes me question the other two incidents.

I do believe that you probably did have a cue "stolen" from you and I hope that you get it back. But, you should take a step back and a deep breath (let it out slowly). Do everything legally you can to reclaim it. And attack people only when you are sure that you have all the facts straight. I wish you the best in reclaiming your property!

I went to the police right away and they said they'd do everything they could do. They also said they doubt the DA is going to let them go to North Carolina and recover a cue but that they would contact authorities I that area. I tried calling them 3-4 times and had to leave my name and number and they never contacted me back so I just have no faith in them. And I am under the impression that the whole cue was refinished by Carolina Customs. So I find it hard to believe that they just couldn't remember it after me sending them a picture being only a short time after doing it for supposedly one of their friends that takes all his stuff there.

And they weren't really helpful. Trevor said he kind of did remember the cue but couldn't say for sure. And after I told him that Steve told me he took it there. He asked what I wanted from him. And I said just a confirmation that he did in fact refinish the cue and he said I think we did but we refinish a lot of cues. Idk just seemed shady to me. That's my opinion of the circumstances.

So you are "under the impression"-- that they worked on the cue. And you are publically calling them out. You are not even able to say definitively that they have worked on the cue!

You llea saying that your da would probably not let them go to another state to recover?? You have to see police in nc, no other state would have jurisdiction. Of course, evèry officer knows this. This thread is just bizarre.

Everything that you posted about your conversation with cc seems reasonable. You saying that they are acting shady does not sound reasonable.

I'm under the impression because the guy who bought it from Rusty, "Steve", said that he took it to his buddies down at Carolina Customs. That they are some good ol guys and they do good work.

So its 100% for sure if the owner of the cue told me he took it there then thats who did it. Since now my distinguishing chip above the logo would not be there anymore I turned to Carolina Customs to just give me a confirmation that they did do the work on the cue so that I would still be able to prove that it is my cue.

But me thinking that they are all buddies makes me think that something was being covered up, because without good confirmation from them itll be hard for me to prove its my cue.

Anyway, its not my intention to tarnish Carolina Customs reputation at all. I apologize for that. Just being in my situation it seems as though everyone is in cahoots working against me.

Posting this for "thubosky"

Tim (aka "thubosky") asked if I would post this photo for him since he is having some troubles getting it through on his phone. I'm having troubles also as there is a format issue with the photo that you sent. AZB is reading this "jpg" as a "png" file. Funny that I can view it on my computer easy enough though, (but not in Photoshop). Let's see if it's working now... yep... that last one did it.

Rustys ex-gf saw my previous thread and contacted me via email. She just recently sent me an email saying she's sorry she hasn't gotten back to me for awhile, but she could help anyway she can. So I asked for a picture and she said Rusty is the scummer in the middle.

You'd be praising me if some "rusty" character was trying to do some deal with you after reading my thread so that's why it's in this section. Im sure the many many sellers i hurt will understand that my one thread is put here to make them aware of this scumbag. Because someone local to NC may wind up doing a deal with this guy and my thread might save them the headache of this type of situation.

And I'm not looking for sympathy just to make aware to other azers and some help to see if they know the guy or have seen him or the stick. Not looking for people with nothing better to do to bump the thread because they are so much smarter than the rest of us and this could never happen to them. That's great that this will never happen to you, but I don't need to be aware of it in this thread. Just a waste of a bump. Just looking for sincere help here.

I did pay for insurance and signature confirmation so where does that help me??? An R. Cannon signed for it so i have proof of that. You have just hurt the many many sellers here by bumping for a BS post about how I'm so dumb and everything else but no real intent on helping me. Thanks.

I'm sorry, but I have very little sympathy when a trader/seller doesn't protect themselves and ships without receiving the payment,no signature required, etc. There have been plenty of threads on here regarding how to pack and ship items safely and securely. Most of it is common sense. Also, this thread doesn't even belong in this section of the forum.I understand that you want to warn others regarding this Rusty character, but so far 4 pages in the Wanted/For sale section.Sorry but you are hurting the sellers here by pushing their threads into the basement. So as much as you are helping by warning us,you are also hurting many, many sellers.I even feel bad that I am bumping this BS.
Sell correctly, pack properly and ship, WITH SIGNATURE REQUIRED AND FULL INSURANCE.A FEW BUCKS UP FRONT MAY SAVE YOU A LOT OF MONEY LATER.I hope this helps you and I hope you get something back from this "Rusty" person.Good luck.
Best,Marc

Let's hope you never need help in a bad situation, marc. Your post is so helpful.

Thanks again for being the judgemental. You always keep us mere mortals in check.

Updated my first post with pictures of new information about where my stolen Schon is now. Please read my first post and if you have any ideas to help, please do.
Thanks,
Tim

from a legal point of view. no, you won't be able to get the cue back from Steve as he's an innocent 3rd party and did pay money consideration for the cue. Unless you can prove that he knows the cue was stolen at the time of purchase, you shouldn't have tried to mass him up.

Mostly likely you have Rusty Cannon's address, eg. by posting the cue to him, why not just go after him directly?

Well in Pennsylvania I'm pretty sure you are not allowed to buy and sell stolen property. Not sure about other states. And it doesn't matter if you knew it was stolen or not. Being in possession of stolen property is a crime. He knew it was stolen and sold it anyways.

And Rusty gave me someone else's address and called the post office and told them he'd just pick it up at the post office. So the package never made it to the intended address. Afterwards I searched the address online and it came up as a property for sale in North Carolina. So he had this pretty planned out.
