Player A shoots a safety and the CB stops in the kitchen. Player B mistakenly picks up CB and set it down behind the head string to shoot.
Player A calls foul, which it is.

My question is: Does Player A now get the CB in hand behind the head string or does he have to play it from where Player B set it down?

My guess would be from where it was set down by player B.

But Bob will tell us what the correct answer is.

This brings up the whole question of what is intentional. The player who picked up the cue ball thought he was doing part of the function of the referee by taking ball in hand. He deliberately touched a ball in play which is unsportsmanlike conduct.

I suppose there needs to be a separate rule for fouls due to "confusion, ignorance and inattention."

I think the present rules do not clearly state what should be done in this case. If I were the ref, I would call a foul on the ball grabber and put the cue ball back were it was when he grabbed it. Then I would remind the players that before taking ball in hand, it is best to confirm the situation with the opponent. It is even better for the scratching player to hand the cue ball to the incoming player so there is no question about it being ball in hand.
 
I think Bob has it right, spot the ball where it was before the guy picked it up.

Reminds me of a situation I encountered once in a ring game, 10 ball. Three of us left, a guy dogged a shot and in frustration shot it again as hard as he could and moved some balls. Incoming player wanted to spot the balls as close as he could remember to where they were (easy out) and I disagreed. We ended up removing the fouling player from the game for the rest of that rack, re-racking the balls with just us two playing, breaking and playing the rack over.

I was the one who picked up the CB... my opponent had just shot a two rail kick safety and missed the stack (kinda on purpose). Anyway, without thinking, I picked up the CB thinking I had BIH. Which was a foul. I thought it was a one point foul and ball to be placed back where it was originally.

My opponent said it was ball in hand behind the head string. I didn't really think it was, but I was only 99 % sure so I didn't disagree. And, after this thread, I still am only 99% sure. I only know it isn't an USLC foul.

Hopefully, the rule can be cleared up in the future. :thumbup:

Unless I'm confused, the only time an incoming player gets ball-in-hand
after a foul would be after a scratch<CB in a pocket> or CB leaping
off the table.
