Once again, buyers beware...this sale was a ripoff attempt!!

.. Negligent misrepresentation is yet another variation of fraud is recognized in Minnesota and it occurs where:

One who, in the course of his business, profession or employment, or in any other transaction in which he has a pecuniary interest, supplies false information for the guidance of others in their business transactions, is subject to liability for pecuniary loss caused to them by their justifiable reliance upon the information, if he fails to exercise reasonable care or competence in obtaining or communicating the information.

Florenzano v. Olson, 387 N.W.2d 168, 174 n. 3 (Minn.1986).

It doesn't matter....The buyer knew what they received was not what they thought they were buying ....

The misrepresentation had already taken place. Akin to false advertisement.
Which, by the way, is exactly why Kevin Trudeu is in prison.

People need to understand that the table being sold, pictured on this ebay add http://www.ebay.com/itm/Brunswick-G...?pt=LH_DefaultDomain_0&hash=item1c362faf50=== is NOT the table they are buying, as it's only pictures of a table that at one point in time did exist, therefore the pictures. But, when they LOOK at these pictures, and decide THAT'S the table they are going to bid on, and hopefully buy....is NOT the table that is going to show up on their door step when they recieve it. Forget about the money, you'll never see that again trying to deal with JERRY the SELLER....pay attention to what is really taking place....it's called deception in the fact that the buyer is being decieved by the seller....because he is NOT going to sell you that PICTURED pool table you so badly want to buy!!!;)

Not only is he misrepresenting what he is actually selling, he is KNOWINGLY misrepresenting what he is selling. In criminal court its known as "premeditation".

He knows the parts are not all from the same table model, hence the statements about 'improvising' to make them fit. He also knows that the table in the photo is not the actual table that you will receive, which is textbook false advertising...bait and switch.

Had he included a statement in his ebay listing about " the table pictured is only an example of the type of table you will receive" and " the table you receive will be comprised of parts from various other tables", then he would have done his due diligence as far as letting the buyer know what they were going to get. But he didn't.

Noy to mention plain ass lying

This table has been in use at my pool hall for several years and considered the greatest innovation in commercial grade tables ever developed. Been the pool hall favorite and college game rooms too for 50 years. This is a GC3. Still plays like new, has recent new cushions and can be put right to work with maybe some new cloth, although this can still be used for quite a while yet. Closed my pool hall so I selling a lot of tables, cue racks, BILLIARDS neon sign along with most of the bar equipment. More listings to come. Building is sold and new owners want it for a different purpose. Not asking much for this table. Come and get it or I may be able to deliver if not too far from Duluth. Listing says delivery $200 but it may be more or less depending on logistics.

Well, some updates. Wendy is now talking with someone in the legal system in Deluth, MN to see about pressing charges in his home state.

And, an update on her table. Now that I can assemle the frame of the table after having to build the stetcher for the legs, I put the frame all together, and then added the frame work to install the Diamond leveling system, that's a LOT of work routering out all the groves to mount the wedges. Took all day yesterday just to get to this point. On the list of things to get done today, is steel plate joining the slates together, then taking them apart, packing them in the house and remounting them on the frame of the table. Once the slates are mounted on the frame, I can then add the center slate leveling system which allows me to adjust the slate up or down, in the center of the slates.

quick derail, Glen. but i think you're gonna like this. i don't know where else to post it.

so we're @ one of my buildings today, setting up for Furniture Market. 1Msf. 10 floors. one city block. halls are filled w/ all mfgs' skids & trash, to be cracked & installed/placed inside the shrms. people everywhere. chaos.

we're on 3rd floor, doing 100 lights. i run up to 7, to grab something from my other shrm.

i walk past AHB. American Heritage Billiards's showroom....

THERE IS AN OPEN CARTON (ON ITS SIDE) WITH WHAT APPEARS TO BE A POOL TABLE TOP

of course, i stop.

the CEO invites me in. they now have FIVE tables inside! 2 of which, are black felt. (shitty tables, but none the less, at least they are there as props) all i can think of, is RealKingCobra & AZB!!!! i inform him, that next week, i'm bringing my cue - cause i'll have nothing else to do to occupy my time all week....

so as i'm leaving, the installer is outside in the hall, assembling the table.

i stop again.

i said (cause RKC is still in my head, but my cell phone & ipad are out of charge to take pics): are you with the mfg? or contract labor?

he says: i'm with AHB.

i say: YOU REALIZE THAT YOU'VE PUT THOSE LEGS ON BACKWARDS?

they were Queen Anne legs.
and i think his name was Jerry.

Was his full name..."Jerry Rigged"....LMAO There's a lot of table installers that belong to the "Jerry Rigged UNION"....:p:rotflmao1:

i laughed for 4 floors down & it took me 3 minutes to recant to KK9, why i couldn't stand up. hell - i'm STILL laughing!

they are a mfg of very good barstools & dining chairs & bar/din tables. they use the pool tbls as props. and props, they are.... one table was black felt & gray veneer - hollow - cause i tapped it w/ my nails. they had Cyclop balls, old style. (otherwise, i would have put them in my bag & slipped out)

but they have NO CUES.

last OCT, KK9 stopped in everyday & asked them why they weren't playing. as a "draw" in their front window. cause all the sales reps were just sitting there, on a stool. that'll change next week - they are across & around the corner from 3 of my shrms.

i just remembered this - they are trashing 2 or 3 of their tables, if you want to come get them, RKC. have to be out by WED. i can slip you in & out of the docks; otherwise wait time is 15hrs. (but the legs might be backwards)

This is beside the point.....but even if the table in the Ebay pictures was delivered free with every single part matching and new cushions under that ratty cloth, it wouldn't have been worth $1250.

The problem with buying used GC's, especially if they're coming out of pool rooms is that you really have NO idea what condition the table is in, and won't know until after you get it. There really is no such thing as a bad GC, unless it's a pile of parts that don't match up;)
