Deal gone bad on superior cues site

Drive into your nearest major indoor mall. Park your car and lock it. Go into, lets say, Dick's Sporting Goods. Return to your car and find it broken into. Just try to sue Dick's. Try to sue the mall. Ain't gonna happen. If you're lucky, the mall MIGHT provide the local police with surveillance footage.

I agree Martin is not responsible for the doings of a "visitor" to his website. If you fail to read the "legalese", you are the responsible person. Also agree "pookster" is a good guy and regardless of his reason for not wanting the product purchased, he should deal with the previous owner of the product, not Martin.

To be upfront, I have purchased from Martin in the past and will continue to do so if an opportunity presents itself. JMHO.

Just leased another new car. To be absolutely honest, I did not read every sentence of every document I signed. Understand the possible repercussions of failing to do that. Having blindly purchased an item from a reputable dealer, is the dealer responsible for my failings? Is the manufacturer of the item responsible? In the end, I am. I'm feel bad for "pookster" not getting exactly what he ordered. In the end, only he and the previous owner are participants in the purchase. Denigrating Martin Bick and Superior Cues for "pooksters" failing is just unfair. Again, JMHO.

In fact, in responding about it he commented that he wasn't looking for Martin to refund him but rather to intervene on his behalf with the seller, Don.

I swear on my life and I never ever saw a disclaimer and martin never text me or told me that there is one and I didn't see it.Listen sir I got fuvked by a guy that martin know but he should at least call me back when he use to if I have question about a cue he has for sale

But when a customer have problem then he decide to ignore that person???

I don't want a refund from don or martin cause I don't trust them anymore and I rather lose a little money than dealing with these 2 again

I failed to ask one extremely important question. To whom did you request Paypal forward the gift payment to? Was it Superior Cues or this Don guy? If Superior received payment, then I'm dead wrong and apologize for my previous posts. Haven't read the entire thread (shame on me) so if the information has already been posted, I apologize again.

If you were Martin what would you do now? Would you at least call up Don and say WTF? Why did you lie to the buyer? Do you realize you are ruining MY reputation?

Or would you do exactly what Martin is doing now by ignoring the situation?

To Don and I know ok that I din't send it to superior cue but I never ask martin for a refund or blame him at first.All I ask if he can try to contact don for me cause don won't pick up my phone and so was martin

Yes, it is an issue. Well respected websites or sellers don't ask buyers to "waive" their rights to do business with them. Trying to teach you something here, so don't be so gosh darn stubborn.

I demand folks do NOT use the gift option for $10 or $100 worth of chalk. And please don't say the fee's are not much on $10 or $100... because when you sell 1000 boxes, it adds up very quickly.

Did you agree to the disclaimer? Did you even go to a page that required agreeing before proceeding to purchase.

this thread and similar ones that pop on here from time to time is why i have been reluctant to buy any thing from this site. i have no doubt there are many trustworthy individuals on here...but with my luck i would wind up getting screwed from one of the shady ones.

your last sentence got me to wondering about what actually transpired between you and martin. i am just assuming here...you were pissed off after getting off the phone with don. i don't blame you... i would have been also.

you then call martin...apparently still agitated and probably had some not so nice things to say to him. ...apparently when he denied any responsibility for don not refunding the money. understandable...i would have probably been hot under the collar also at this juncture.

if martin had a disclaimer that the transaction was strictly between you and don i don;t think he is legally responsible. morally ...yes. i think he attempted to full fill his moral obligation when he offered you the same courtesy he extended to don...that is to post the cue again on his website for you to sell since you are obviously unhappy with the cue.

i can understand martin not responding any more to this thread after his 1st post. so far he has kept his word about that. kinda smart on his part. ..it seems to be the norm on here that the more some one defends their self the more shit some people sling at them.

you asked what you should do. my advice is if you are not wanting to keep the cue. txt martin explaining you were really pissed off and frustrated at the time of the sale and tell him you are willing to take him up on his offer to relist the cue on his website if he is still willing to help resolve this issue.

my next piece of advice it to do as several people have said on here every time one of these types of threads pop up. never gift pay pal and use a credit card.

good luck in whatever route you decide to take.
 
i had a trade deal with the op before he asked if there's a weight bolt, I checked and told him there's no weight bolt but he messaged again and ask, so I rechecked again. But he received the cue with weight bolt, so I paid him cash so we even. But maybe it's cause I didn't check well enough, and that's prolly what happen to don, he thought he checked and when u say there's a weight bolt, he wouldn't be able to accept it as he has checked before.

I hope you get this sorted out soon.

my first inclination would have been to contact Don to hear his side and to try for a resolution for pookster.

that may, however, have been influenced by the type of contact I was receiving from Pookster.

I have been hanging around az long enough to know there is a genuine lynch mob mentality here and I think we should try to show some restraint rather than damning people right out of the gate.

we should do a better job at keeping an open mind until we have facts.

if the situation was reversed and pooky was the website owner and martin the buyer I would still be on the side of the buyer in this situation and on Pooky's a$$ like white on rice in this situation! Would you still side with the website owner with the players switching positions???

Pookster, I wish you the best of luck. This is all so strange, it just has me questioning whether we've heard everything with what has transpired. You can rest assured that I would take your call(s), because if I'm selling a cue for someone else, then the deal is with me and me alone. But still, I just don't understand why this seemed to take such an immediate bad turn. :(

I see a few comments where people are starting with the crap about "this is why I'm hesitant to do a deal on this site", etc. This was NOT a transaction that took place here on AZ.

If you are considering a purchase/trade/etc, it is very easy to do some basic research who you are about to embark upon a deal with. Ask for references of known people in the industry. Go through an escrow and/or fund the purchase in a manner that you are protected. Deal with reputable, known people. There are a lot of them here and elsewhere. Know beforehand whether there is a satisfaction guarantee and/or return policy with the seller. It seems that most often the people who are not vigilant and just assume things, are the ones who end up getting burned.

If you are new and thinking about a purchase with a seller, ask questions of senior members here. This is not rocket science, folks.

For someone asking for us to keep an open mind you sure to have a nasty habit of taking hearsay as matter of fact. Almost exclusively with the side you align with.
