No. A B1/B2 Visa is good for 10yrs and you can stay for up to 180days each trip. You can apply for extension but i think you have to get the request in 30-45days prior to expiration. You also can't be employed by an American company. That requires a different Visa.

Man this sucks. I feel for the guy. I can’t think of another player who has been in battle more than this guy. Between tournaments and action games he’s always in the mix, I’m sure it’s going to be a real change of life for him. But make no mistake, there is no gray area here. Like zero- even if you have wealth. My brother has lived in Spain for the last 15 years and has duel citizenship. He also has a business here in Florida and one of the first years he was over there he came back more than normal. He was in his lawyers office in Fort Lauderdale and casually commented that he’s spending way too much time in the states and needs to get back home to Spain to see his family. The lawyer looked alarmed and my brother couldn’t understand why. Turns out you are only allowed to spend a certain amount of days in the states or you get your income taxed. I could be wrong but I think it’s only 30 days.

It's hard to understand what you are talking about because anyone that has lived abroad knows that all US citizens, even if they spent 0 days in the US, have to pay income tax in the US. The amount of income tax owed in the US does depend on the amount of income tax paid in the foreign country. You have to renounce your citizenship to keep Uncle Sam from feeling around in your pockets.

But he is also a 3rd Grade Graduate, shit hr was educated in way of world in travels.
 
Very disappointing news, as Dennis has long been one of my favorite players to watch.

That said, if he didn't break the rules, I'm sure he can get it fixed by an attorney. If he did, and there were no extenuating circumstances, such as illness or bereavement, any trouble that comes his way is on him.

I would rather an exception be made here, but if Dennis has violated the terms of his being permitted in the United States, he has done this to himself, and you can bet your last dollar that he knew the exact terms of his visa. Customs laws concerning immigration and visas need to be enforced rigidly as doing so is a matter of national security.

I hope it turns out that Dennis didn't break the rules, but it seems unlikely at this point. Guess we'll see. Hoping for the best.

Yes. There is no Visa that allows unlimited time here. For that one would need a green card. Most GC applicants are pursuing citizenship.
 
5 years is like a huge part of the rest of his career. i hope he gets into the MR events on european soil, like the UK open, the world championship, the world cup and the world pool masters. i also hope money matches can be arranged in connection with these events, but yea a rematch against chohan seems distant.
That's what I'm greatly hoping for, too, but while getting into the UK Open and the World Pool Championship will be easy, getting the other European Matchroom events may not as simple, as they are all invitational.

We all know that Orcullo is as elite as it gets, and that he's clearly the best player in the Philippines. By Fargo, he's the number 4 player in the world right now, and that says a lot. Unfortunately, despite the fact that it's the best player rating system we've got in pool today, it is not Fargo rating that is used when it comes to invitational events.

The Predator League Championship pool, which has really good money and no entry fee, is an invitational which had nineteen players in its inaugural edition, and Matchroom has its own ranking system. As Dennis skipped all the Europe-based Matchroom events in 2021 including the World Pool Championship, his Matchroom ranking may not gain him entry, despite a third- place finish at the US Open, which is a Matchroom event, because his fellow Filippino Carlo Biado won the US Open and would, therefore, have a higher Matchroom ranking than Dennis.

I suspect the situation is exactly the same for the World Pool Masters, an invitational with twenty-four players, with one entry per country other than the host nation. Whether you go by Matchroom ranking or WPA ranking, Biado ranks higher than Orcullo at present.

The World Cup of Pool might also be tricky, as invitations may be based on WPA ranking.
Thirty-two teams of two players each are invited to that one. However, other than the host nation, each country gets just one team. WPA rankings have become somewhat ridiculous, as they don't protect those that opted to miss events due to COVID or COVID-related fears of international travel. At present, by WPA Ranking, Carlo Biado is the highest ranked Filippino by virtue of his win at the US Open and Roberto Gomez is ranked two spots higher than Dennis Orcullo, so even this invitation is uncertain.

I really hope Dennis has an advocate that can help him gain entry into the Predator LCP, the World Pool Masters and the World Cup of Pool, because we all know he's worthy of those invitations.

You may be on to something about action matches. Perhaps Dennis will be able to play some action matches in Europe with Americans who go there for major events. Americans tend to go to Asia only for the China Open and the All-Japan, but those might be other occasions during which action matches can be arranged. That's all to be determined.

Thats not correct. What @Z-Nole was probably talking about regarding his brother’s status as a US expat living/working in Spain is called the “Foreign Earned Income Exclusion” - here is the IRS page where you can learn about it. To qualify, a US citizen must be physically out of USA for 330 days of the tax year.

None of which applies to this Dennis O situation…

nobody's denying what happened or who's to blame. but it's not totally unknown for pinoy players to have managers, like efren had rolando vincente etc. if anything this whole thing shows the need for it.

Well that sound like a smoking deal, and I am sure the guy could afford $2.00/day for a person managing business affairs.

Then all you need do is find honest person to do what you need done.

Not 15 years ago. I assume the amount changes if heathers for an extended time. I don't know the exact details but it was going to cost him a shit ton of money if he stayed one more day. A shit ton. Wether it was taxing his US or Spanish income I'm not sure- I assume he was already taxed his US rate and maybe he would be taxed on his income in Spain, but it had nothing to do with his visa- it was strictly a penalty for staying one day too long. And it was enough of a hit that he let me and two other drunks drive his Egg Harbor to and from Port Lucaya. And I know to this day he tracks his days in the U.S. very carefully.

Best part was we stopped in Chub and the wind was a perfect SE and the Tongue was freaking lit up. We couldn't keep the dolphin off the baits long enough to get Wahoo and Marlin bites. Horrible problem to have.

I just spoke to Dennis via FB cam. He is back home and feeling weak and tired. He was "detained" for a total of 31 hours before he was put back on a plane to Manila. It was only then he was given back his cell phone and allowed to call his family. He had been allowed one text message during the time he was detained. He was in a holding cell with other detainees and only given minimal rations the entire time, and was treated just like one of the drug carriers who were in there with him. Needless to say he is happy to be home, even though he must quarantine in a hotel for one day before returning to his actual home in Quezon City.

This was truly an ordeal for him. I could see that just by looking at him. He looked haggard and pale, and VERY tired. He was told that he was singled out for all the time he had been spending in the USA during the last ten years, more than six months per year. They wanted to know more about what he was doing here for so long, not accepting his poolplayer story. There is no way he should have been treated like this!

I had my own personal experience with our Homeland Security about six years ago, also at LAX. I was singled out when they asked to see my cell phone and the two Ukranian agents found mulitple photos of me with my six year old daughter. Yes, they were Ukranians who had gained citizenship and were now working for the TSA. I told them she was my daughter but they refused to believe me. They spoke in their native language when talking in front of me! I am a US citizen by birth and these two A-Holes were treating me like a criminal of some kind. I was held for seven hours (after an exhausting sixteen hour trip to get home), until two TSA detectives could take me to a private room to be interrogated. The room was in the bowels of the airport and we had to walk through areas under construction to get there. I felt like a lamb being led to the slaughter.

In the room I was read my rights and I asked them if I could have a lawyer. They said yes, but you will be detained until you get one. I asked them how long they would hold me and they said INDEFINITELY! There is no 72 hour period when you must be arraigned or let go, like when the police arrest you. So I talked and talked and talked some more, all the time being asked embarassing questions about my relationship with my own DAUGHTER! I hated them then, and I hate them now! They kept my cell phone and camera (to scour them for anything they could find) and I was released after Midnight. Two weeks later I was called and informed I could either come to the airport and pick up my phone and camera, or they would mail it to me. I didn't want to ever see them again so I had them mail them back. I never heard from TSA again, but that experience is forever on my record when I return from any overseas trip. A couple of times the agent who questions you upon returning will ask me why I was detained years ago.

Whoever wrote that Dennis should apply for a P-1 athlete visa is correct. The agent who transported him to his plane told him to do that and he may be able to get this restriction removed. We need a good attorney now to assist him, and we will find one. Michael Gurfinkel is one who has been recommended.
