The way I see it is if a fake cue was sent out it shouldn't really matter the condition it is returned. The fact that is was fake proves the intent of a scam.

You got it all wrong. If your opponent lines up a bad shot that is on them and you absolutely 100% should not say a word. Why you ask? Because it is not your place to coach your opponent. They are solely responsible for choosing which shot to take.

I always pick up the ball and hand it to my opponent if I believe I committed a foul. I do not expect my opponent to extend the same curtesy

I stopped buying cues when I got my Madden. Best cue I have shot with bar none. Considering you can get one for a little more than a mid range predator it is a no brainer.

In most rules as long as the balls are touching you can push.
