Could this be the death of the AZ Raffles ???
As stated in the Gina cue Raffle that was canceled .
Any Attorneys out here want to Chime in?
With the wonderful state of the country's economics this could be a way for the Government to raise funds ,if they impose fines .
Could they change it to a Felony due to all the Scams out there in this economy?
What is the recourse to AZ?Could they be held accountable for allowing any raffles ?
Just a thought.
Sorry for listing it in the For Sale/Raffle section .But I think it is related.

"Penal Code Sec.319.

A lottery is any scheme for the disposal or distribution of property by chance, among persons who have paid or promised to pay any valuable consideration for the chance of obtaining such property or a portion of it, or for any share or any interest in such property, upon any agreement, understanding, or expectation that it is to be distributed or disposed of by lot or chance, whether called a lottery, raffle, or gift enterprise, or by whatever name the same may be known.

Penal Code Sec. 320.

Every person who contrives, prepares, sets up, proposes, or draws any lottery, is guilty of a misdemeanor."

I posted this same info a couple of weeks ago, nobody really seems to care. I guess they feel it's worth taking the chance of getting caught. Personally I think it's really gonna suck when AZ gets shut down.

My thoughts (again)

How would AZ get shut down? Could the Fed's get involved under RICCO ?

When the guy who state this thread quote Penal Code Section, I wonder what state this is from? As laws varie from State to State, and even City to County. Exception would be Alaska with no Counties.

State ...

I'm pretty sure he said it was for the State of California .... And he said it was a misdemeanor which if you ever lived in California they have some pretty strict laws ... I would guess this ranks right up there with Jaywalking ... I was raised in California some of the best years in my life it is a beautiful state with great people ... And some of the friendliest people but it also carries a large population ... And alot of laws ... you would be surprised at some of the laws written in the books years ago that are still laws but not enforced any longer as they are acceptable now in most peoples eyes even if still frowned upon ... Here in Georgia it is against the law to commit Adultry ... you can go to jail for it (not that it is an acceptable thing to do but dang Clinton could of got put in jail here while President)... It is still a written law in the books ... but it is not enforced anymore... I wonder how many other states have old laws like that , that are no longer enforced and may seem odd in this day and age???? There is also a law on the books here that forbids oral sex and you can be locked up for it .But again it is no longer enforced but still a law non the less ... Imagine getting locked up for that and trying to expalin it ... . ;)

ehhh

No one gives a rats @$$ about the legality, or not, but I would like to see the raffles elsewhere. And in a VERY short time, raffles now outnumber cue sales it seems.

Wish I was eloquent enough to convince someone, but I get to rambling, and right after that degenerate to F#$% Y09

My gift of gab has left me

SC has laws much the same still. I think you can still beat your wife on the courthouse steps with a switch no thicker than your thumb on sunday, and any position other than missionary is illegal... Bible belt laws seem funny in retrospect

I really do not get it, what is the problem with the raffles as long as they are done fairly and on the up and up. I do not understand why there is so much dome and gloom about this subject. The forum membership is getting a chance to get something they may not be able to afford otherwise in many cases.

Does anyone believe that the forum owner is stupid, or not a Businessman. If these raffles were going to cause Mike Trouble they would not be aloud to happen on this forum. Why do we need all this legal advice, if you think it's wrong do not participate, why continue to be negative and try to frighten people into seeing your point of view.

The only situation I can see where these actions can become a problem is if the person holding the action is dishonest, and the agreed upon terms by all participants are not meet. Other than this, who cares and who's business is it, besides the forum owner, and the participants.

Just my thoughts

pretty sure the only chance someone will start to look is whne people start to quote the penal code!!!! hello !

and even then these are harmless, way bigger scammers and fish to fry on the net these days at least here its fair and trustworthy! just my 2 cents

I was thinking that the biggest problem the government has with raffles is money, or the lack of cut they get on the sale. It's probably much easier to falsify income tax records with a raffle.

So to all the cue wheeler dealers who do raffles, how are you going to report the income from these raffles on your taxes?

Answer at your own peril:cool:

I'm fairly certain that the lotteries or raffles being run on AZB are more likely than not illegal under the laws of each of the 50 states in the U.S.

sry but i hope so. im not a big fan of raffles also not a fan of 20 raffles on the first page all day long

if they stay they need their own section

I am not a Lawyer, but I am positive there is other illegal activity here as well. Will you be heard concerning those?

Nobody inforces those laws anymore unless its like a real lottery. Like powerball, florida lotto, exc. If they were enforced every school, church, and state i the U.S. would be shut down. Ever1 does raffles theses days. Its not frowned upon or anything people dont think twice about em. Hell my old Catholic middle school raffles off a car every year. This year it was a jeep but you get the point nobody cares.

There's a difference between the raffles that the churches and schools, and that is simply that they arent looking to profit from them. some of these raffles have been fairly blatant that the total of the money, far exceeds the value of the item.
