Dishonest cue maker

Had a cue maker offer to make a cue and be delivered July 2015. Was paid in full upfront which one should never do. Since July 2015 several excuses and broken promises. February 2016 cue maker promised to refund money. March 2016 cue maker refunded $1200 of the $2100. Cue maker is keeping the $900 because he said the order was cancelled by the buyer. What are the options to getting the $900 back since the cue maker didn't live up to his promise ?
 
Go to his house and get it back. His local authorities will handle it if you call and speak with them.

Small claims is about your only option. You are about 95% to win.

cue maker should be named. if this is how he conducts business others should know.

don't promise things you cant deliver on.
 
If his policy wasnt known up front, then it is straight up robbery.

He is probably poor and cant afford to refund.

it will cost you what he owes you i think but will send a message

As I said in the other thread, small claims and you will likely win.

For anyone reading this, please do not pay people in full for stuff they promise to do. You were fortunate to get any of it back. In California now, even licensed contractors are only allowed to collect a 10% deposit up front for home improvement or repairs, unless they provide a completion bond. There's a good reason for that.

I have a few questions:

1) Did he show you the progress he made on your cue?

2) What were the reasons he gave for the delay?

3) Did you change anything after the order was placed, which would materially affect the delivery time frame?

4) Did you spend a lot of the cue maker's time in discussions about the design?

5) Why not name him? You have gotten screwed. If the story you gave is correct, you are protecting someone who does not deserve it.

Small claims in most areas is under 20 bucks to file. You can sue for up to about 3k. No lawyers. You only have to prove you version as more likely than not....not beyond a reasonable doubt. If one party no shows , they lose. No rescheduling hearings. It's a very good tool for you. Judges smell bullshit from miles away.
 
Threads like this only serve a purpose when the offending party is named. Otherwise, innocent people might place orders with the cuemaker who has refused to make good on his promise to deliver.

But if you want a chance to get your money back then its allot easier if you don't slander the cue maker name online ....

Making money on the side... while learning from a supposed "name" cuemaker.. promising that persons techniques while making a cue with his name on it.. not delivering on time, after many promises, now doesn't give a full refund because of a cancellation of an order that HE, by not delivering on the promise date, was the reason for the cancellation?

Is this all correct?

Is this guy an ex-pool player because this is the pool player mentality in a nutshell.

Wonder what his teacher would think, especially of the promise to make a cue with his techniques... this is why you out him...

get 3 or 4 guys & U-haul,go to his shop and load up,butts,shafts,tips ,wraps,machines, tools,all his beer, et cetera. when he complains he only stole one cue,tell him this how he does it and this is how you do it. If he's there make him help you're guys load int all !!!
 
I never understand these threads where the OP's intent is to get their money back, however they remain incredibly vague and rarely if ever is the full story told.

It's left out that they called every day or stopped by the guys shop all the time to check on the status. Maybe a bad check was written or they "gifted" the money through paypal and created a problem for the cuemaker.

Maybe they asked for what they thought was a small change to the cue, but it was still a change and cost the cuemaker time and supplies to make the customer happy.

Any number of things, but most definitely the whole story needs to be told for ALL of these type of posts. Not 10 pages of BS back and fourth.

Lastly, how is it in 2016 that a ridiculous number of these "how do I collect on what this seller or cuemaker owes me" Are you serious? You know the ways, small claims court, ask a friend of the seller to rethink or interject, send over someone to collect. The replies to these threads is always the same thing. "sue them" "20 for small claims court" "if you put their name out there, you most likely wont get paid" etc.

It has to make you wonder every time one of these threads gets started, or duplicated, how much information is being left out to benefit the OP.

Either spit out the whole story including who the maker is or STFU about it.
