EBay Issue - I Need A Consultation

If anyone has extensive dealings with EBay and has had to deal with an item that was misrepresented, I would appreciate a consultation.

I bought a cue that was was for sale on EBay but was being listed by one of those one of those "ISoldIt On Ebay" places locally. When I went to pick it up (with $$$ in hand), it had a cracked ferrule, way undersized shafts, one of the shafts has a signficant wobble and the leather wrap looked like a piece of upholstery had been glued onto the wrap area. I walked away and didn't pay.

I even asked them specifically if the shafts were full sized, did everything roll straight etc etc before the auction ended and the seller responded.... "everything checks out."

Now - Ebay is telling me that I really should pay or I have an "Unpaid Strike" item against me.

I buy a lot of stuff, especially golf stuff on Ebay, and I hate to have that against me but....I am not going to pay!!!

Any ideas on how to deal with this would be appreciated.

easiest way? post the auction and their email address.. enough of us will email and they will leave you alone....

either that, or give me their phone number and I'll take care of it for you.... :p
 
If you have emails from the seller stating that everything checks out, you can provide them to eBay and maybe provide pictures of the cue from the eBay store to back up the fact that the item was not as the seller led you to believe.

Or if you are forced to pay, give the seller negative feedback stating how the seller misled you.

Just my $.02.
 
Dude .... I just reviewed the auction and there are several loopholes...

Can you send me additional photos of the item?
Unfortunately, due to the high volume of items we receive each day, we cannot take additional photos of specific items.


They couldn't take enough pics to properly represent the item for sale

None.

you need to open a dispute. there is a dispute called significantly different than described. it should end with a wash. the worst case is that you both leave bad feedback.

Open a dispute. That generally works to get it resolved with both parties not leaving feedback for each other.

Make sure you document everything accurately.

I had the happen twice with items I bought. Both times the dispute was resolved with no harm no foul.

Another angle is call the main distributor of the franchise. ISoldIt is a franchise and I don't think the main company wants or needs bad press.

I kept every email and hopefully it can be resolved. As far as being forced to pay........THAT IS NOT GOING TO HAPPEN! Its not a money issue but I didn't even get a kiss before the drove it home.

I had never seen or hit with one of that guys cues and was dissapointed it ended up looking like somethng I would have built!! And, having had mixed luck with Ebay in the past, I never would have bought it if it hadn't been local - so I could look at it in person before laying out the $$$. I was actually the hoping the ISoldIt guy would call and ask me if there is a dollar amount that would be acceptable. I can get it rewrapped and new shaft made without much problems. Its 3/8-10 so I most likely have something that would match up anyway.

*** Ross-are you getting plenty of sleep and staying off the computer (got to take care of those eyes baby) ?? We need to make sure you're good to go here in a couple of weeks.

A dispute was opened by Ebay. I responded to them and they came back and said I was at fault and the "Unpaid Strike" would remain. I gave them a Snappy Retort :p and, hopefully, they'll respond to that

As soon as it appears like its a done deal and they are going to hold me at fault - I'll call the main distributor and generally become a disagreeable sort. They are located not too far from here so "The Vito Option" is definitely in play.

As said before, you gotta play the game. Be honest and remember that flea-bay deals with lots of these situations and knows the buyer/ seller are at odds and will both feel they are right.

It is important to convey that the item is not as described, issues "none", and the ferrule (cracked) and shafts (wobbly) are items that are essential to a pool cue.
