Interesting thread and I hope it all works out in your favor. However, I'd suggest reconsidering this plan. While I'd love to see this guy get what's coming to him and letting people know about his scams helps others avoid getting ripped off, you are treading a fine line when you start posting flyers and taking out ads. Libel suits are an every day occurrence and even when you're 100% right, the costs of fighting a bogus charge can get pretty hefty. Even worse, you could lose (our justice system sometimes gets things wrong)!

Instead, I'd suggest hiring someone to find him and break his kneecaps. Wait, no, just kidding, honest, just kidding. You seem like a reasonable and intelligent guy so I think getting your money back should be where you make peace with the situation and move on down the road.

I understand your thoughts. You are correct about the slander issue however my "flyers" wouldn't contain anything negative aside from a name, a "link", a publically posted pic I borrowed, and for them to form their own opinion. I personally don't think this guy has the funds to sue me, but I've been wrong before:grin-square:
 
I had someone on e-bay to rip me off on a 100 oz's of silver and along with paypal I contacted the fbi fraud unit. I had the agent to contact me again within a week telling me I should have my money back within a week and I did. It might be different in your case but I would check just to put him on their radar. Also, I did the flyer thing and posted on craigslist about someone who had ripped me off and when they complained to the investagator he told them as long as they were facts he couldn't do anything about it. Nothing worse than a thief!

We need people to keep redbombing his azz, which means greenies to others, then a redbomb, then more greenies to more others then another redbomb. If more senior members do it, they carry more weight and therefore more redbomb effect. REMEMBER THE TEACHINGS OF SMORG!!!!!

I think you should do it. My experience with thieves is that they really don't want any attention from the authorities. He has your money.
 
Red rep left on my behalf too. Stuff like this REALLY KILLS it for people like me and also the new guys trying to learn and establish a good friendship base with fellow members. Very understandably, it makes all the seasoned members scared and afraid to do business with us new(er) members.

I still plan on going through with my "plan". However I do agree with "wording" it carefully. Besides in a slander suit, they have to prove it's a lie. The pm's, public announcements of receiving the money and then deciding to give a refund however he still hasn't shows he has no "grounds" for a suit. Plus he has too much to lose if he does, Dave if you happen to read this, you know exactly what I'm talking about.:grin-square:
 
I see Dave has logged on as of yesterday. I take it he hasn't tried to contact you concerning this transaction.

If you check his Facebook page can you see any updates on how the build out of his shop is coming along? Maybe there are updated pics that may give you a clue as to what happened to the lathe you purchased and never received.
