Oddly enough, I was just contacted yesterday by Jake at Pooltees.com. So this thread stood out for me. What strikes me as strange is that the "personal information" he refers to is all available on his own website. It's not hard to find. That causes me to question his above response to Andrea.

Jay I was going to say the same exact thing, you beat me to it. I see it only as he doesn't want the competition. Period.

Which is childish in this market. Considering the designs are completely different, I would be trying to figure out a way to offer somekind of partnership rather then shut them down, save money on booth's carrier a couple of each others shirts, etc..... collaborate on a couple shirt desgins for charity, etc...
 
The only people who will win in this dispute are the lawyers.

The two domain names/business names are *both* very simple and frankly, lacking in creativity. You both deal in t-shirts with pool-themed artwork. Your business names reflect that.

Now, if one of you was ripping off the other's designs, that's a whoooole different story.

I suggest kissing and making up. There's room enough for both of you.

I can tell you that he is not a stalker/harasser/psycho by any stretch. He's a young, struggling, businessman in this struggling economy that is trying to protect what he has spent years building up.

Maybe he's schooled in copyright law, maybe he isn't. My suggestion, Angela is to not waste tax payer money going after an honest, nice young man in federal court. Use a neutral mediator to school both of you on the laws and then come to a peaceful agreement. (JMO)

It seems as he didnt want the nice way, he wanted the I'm right way cause I say so, youth, always knows better......

reading your post, makes me think that since he has been here longer, and has given away stuff, he is then by default, right? So thats how it works? Kick backs, and you are ok, be a new person and you are wrong?

From your side you see him as an honest nice young man. Note: He has not been HONEST while contacting MY suppliers and having my logo taken down on other sites, while KNOWING their is NO Trademark Infringement. I'm sorry, this doesn't seem Honest to me! I've had to spend unnecessary hours and hours trying to correct all the damage he has caused.

You know, a quick look at his designs shows knock offs. His "Got Chalk" is a knock off of "Got Milk" even using the same stylized lettering. The one where the monkey turns into the pool player is a knock off of another ad.

This post is about as biased as they come... and a complete hoot.

He isn't being a "nice young man" at this point... is he? He is being a hard core shrewd business man and quite frankly IS stalking. He is getting her stuff removed from other websites without contacting a lawyer or this woman for that matter before he does it,what do you constitue as this being then?

At the time, I remember wondering why it would be so difficult to change the name of the t-shirt portion of your business. I also wondered why you wouldn't do that to nullify the name confusion between your business and Jake's. All it would take is sitting down and coming up with a new name, then applying for a trademark. In the end, that would cost you less than what it would cost to fight this out. You could also try to work with Jake (as friends) in the same line of work, instead of competitors. As an instructor, I am always recommending students to other instructors out of respect for their ability to teach people.

If I were to wake up someday and change the name of my business to "College of Billiards Knowledge" I'm pretty sure I'd get paperwork or a phone call from Scott Lee in New York minute. I'd rather be more creative than that. As an artist, I have seen your work, and your creativity is off the chart. I'm sure you can come up with a new name in about 30 seconds.

Billiards is a small world. You have to network and make connections with people every day. Nothing should get in the way of that. I'm pretty sure you want to be known in this industry for your work, your excellent products, and your commitment to customer service, not a lawsuit over the name of your business.

I like you and I like Jake. You are both good people that work hard to bring attention to our industry. I hope that this can be settled peacefully. The market is big enough for both of you, and if you work together to repair this relationship, you can probably generate business for each other in much the same way that instructors do. It all depends if you want to invest in the battle, or if you want to invest in the solution. I hope its the latter.

I know Jake of PoolTees.com. Anyone who goes to Derby or Valley Forge has probably seen his booth. He is a good guy IMO who has always been very friendly to me. He is in a double tough racket trying to make a small business survive in not only a declining economy but in a small industry as well.

The fact that he spends the money for booth fees, travel and what I am sure is a good amount of money for inventory tells me that he is serious and committed to the endeavor. That the OP uses CafePress tells me that it is more of a hobby in her case. I can see where Jake would want to defend what he has sweated for.

You can bet that if someone started a business called Hustlin America, or The Action Report Page, or AZ Billiards Pool Forums there would be some controversy as well. On the other hand I see the OP's point of view as well but to call what seems to be a difference of opinion harassment is going too far IMO.

Hopefully a compromise or solution can be reached without involving lawyers or I suspect it will simply come down to who is willing to spend more money to fight. A lawyers dream.

Why should I change my name? I want people to find me... When I chose the name for my art website, PoolRoomPaintings.com, I did the trademark research as to not to infringe on other websites. Now deciding to create T'Shirt designs so my customers would be able to find me with ease, PoolRoomTees was the only choice I considered.

You are an artist with some talent as evidenced by your work and the best you could do to name both of your businesses is to add the word ROOM to two established entities ?

I would think you would want a unique brand to showcase your work.
 
I placed this video after some of the drama on MySpace to all my friends, hoping to bring an end to all of this. I believe there are a lot of pool players out there and a lot of t-shirt designers and artists - Room for everybody. I don't think that adding a huge gas truck to a fire would add more fuel to the fire than you are. All you are doing is getting publicity for your website the bad way at this point. This isn't a forum issue, I wouldn't even expect to see this in the NPR forum. This is nothing more than a pissing match in my eyes and there is NO WAY you are going to come out on top when you are posting things like this on forums and youtube. Just get a lawyer and settle down.... That's just my honest opinion.

I never said you "should" do anything.

In the long haul, that would be a lot easier to do than to pay a lawyer to fight this out. The only people that will win in that scenario is the lawyers.

Changing your name is not the only solution. I am sure that if you two were to talk this over, you could both come to a workable agreement. Best of luck - I hope it works out for both of you.
 
Let an attorney take a look at your situation and then - depending on what he/she says - have them write the other party a letter. Attorney fees can get expensive but in many cases they know right away how the case would likely play out in a court and the letters are pretty much boilerplate. It isn't cheap but it isn't thousands either.

There may be some bluffing going on. Once you know what cards you really hold you (if they're good) can play a stronger hand if you want.
 
Hmm after reading these from the beginning and trying to be open minded I have now just about come to the conclusion that I wouldn't want to deal with either party.

Neither seems willing to work towards a sensible solution to the issue. Bad PR all around now and that is too bad. There are many things on both sides that could be done. With that said, good luck, good fortunes, and best wishes.
