i would guess in most cases as long as the representation of the used photo is NOT for defamation or monetary profit and was obtained through public access sites they are fair game..........it can be a shame especially when the original user post's them on they're own site for their benefit or profit and then taken and used without permission which would fall into your category. still legal but wrong imho.....

skin ------------ tries to keep those "special" pics from ending up on the net :)
 
I think i can put any pictures of pool cues on my avatar ...beside this forum is all about pool related.....just my .02 cents

A neighbor...

I asked my neighbor if I could use his pic for my avatar. He said it was fine with him, "but, let me get that thing off your face, so I can see you!" as he quickly headed toward me to remove the camera. Great shot, but I had to work for it. One of the shots I got was mostly of his nose, as he was reaching up to remove the camera.
