Please offer your opinions on cue design theft

Thanks for everyones opinion, but I have to stand behind mine. Maybe I see things from a different perspective, but I think most builders would definately be offended if some one copied their design to the extent that this cue copies Mr. Churdys work!!:smile:

on this point i agree .. its all varying degrees ,, insparation , theft , fine line
a real artist will be inspired then find a way to put his spin on it

who put the first window , diamond , propeller ect ect

it works both ways im a nobody but im buildingg my cue to submit for icm assoc i bett a biger name that me will borrow insperation from it within 2 yrs

Really? Who do you pay royalties to for all the design elements you use in your cues that other people pioneered?

Richard is clearly owed some credit.

But even as far as THAT goes what if this unknown cue maker in China had simply seen a picture of a Chudy without any attribution at all? So he sees this picture and thinks to try it himself and this cue is the result. What's wrong with that?

Does Joel Hercek owe Kandinsky some royalties? Does Richard Black owe Parker Pens some royalties?

I see a bumper design that reminds me of other makers, dash rings and what looks like micro-thin veneer rings. Do we need to start looking around the net to find similar designs in order to determine who was first so you can pay royalties?

Has nothing to do with that. There is no need to pay royalties on something that does not require licensing. Your comment is bigoted and ignorant of the law. Many Chinese companies legally license with trademark and copyright owners. Joey's comment was untrue and your follow up comment is equally out of line.

Anything coming from the prime example of the failing education system in the USA can only be taken with a grain of salt. You have no business in this discussion because you choose to remain willfully ignorant of basic economics, intellectual property law and basic business principles. You should spend your time online educating yourself instead of continuing to ignorantly parrot those who choose to remain uninformed.
 
Did Sugartree copy BlackBoar scallops or the other way around? Or are they not that similar?

They are not similar at all. But that element of Black Boars has been copied, along with just about everything else in the history of cues.

Oh no mr anti america is getting all high and mighty! just because someone doesn't agree with you doesn't make them ignorant. we get it you make more money in china because you can pay less for materials and labor. doesn't matter to me. the 12 year olds you have working for you cheapen your product on principal alone.

Hey is one of the reasons you moved production to China because you could not worry about hazmat laws?
or did you just jump ship because america was in a bit of a slump? maybe you got a little too close to being caught on "to catch a predator" so you went where the chicks just look underage???

Here is the question that defines it for me... If you design a very unique cue in collaboration with a cuemaker, receive it, post pictures because you are very proud of it, and 6 months later someone posts a picture of a copy of YOUR design that was made by another cuemaker... would you be pissed?

If you answer yes you have an issue with cue design theft, if you answer no then you don't.

I has been proven here that there are two sides to this and there will never be one...
 
If the same people who're losing their shit over the posted cue pict do their part to air their displeasure with every "xxx inspired" design, every Hoppe ring, every Szamboti/Balabushka tribute(copy), every bumperless cue, every sneaky pete, every SW look-alike, every box cue..., then it's fine.

Otherwise I can't help but feel that double standards are being applied. Especially if the double standard is applied to cues of their own making.

Nobody can deny that the cue in question borrowed a design element from RC3. No one is arguing if RC3 is the true originator of the 1 side splice. But no need to single out 1 single poster when you see the same "design theft" posted in the for sale/cue review pages every day, some made by some of the most sought-after and prominent cue makers alive.
 
how many guys are losing business or recognition because there cues are being knocked off? none of them, if anything it makes the real deal more desirable and threads like this give the real deal more publicity.

I agree with you there. But I DO think you may be taking this a little too far.
The guy admitted that he posted without knowing of Richard Chudy's work. He said he'd respect the wishes of the mods. He said he respected the opinions of those who called it design theft.

What more do you want from the guy??? Blood?

I say string him up. Jive's been on a buying spree of cues from America and other places from around the world. Send his ass back to watches. We don't want anyone like him in the billiard industry. You know the eager wannabe collector fresh off the boat on a cue buying spree. Drive those assholes right out of our hobby and tell them to take their money somewhere else.

Make sure that his joy at buying cues is made as sour as possible so that he and all the people like him don't want to have anything to do with the industry.

I will light the first match! Let me go get my white robe and hood first.
