Uploading videos to Youtube...

My question is for anyone that has uploaded videos to Youtube and had their video blocked due to copyright infringement.

I am in the process of downloading and uploading my videos from the past few tournaments that we have done. I have had several videos that have been flagged as matching third party content. All from the music industry of course.

So, I finally had one that actually got blocked in the US for this. I have filed a dispute claiming fair use, as the music is being played at the event in the background and is recorded unintentionally.

Anyway, I am just wondering if any of you have had experience with fighting youtube and the music industry on these things? I can understand that the music industry doesn't want people reproducing their copyrighted materials, but it seems a little ridiculous to have to go through this.

Take it from someone who knows, fighting youtube = ice skating up hill. Good luck with this you are going to need it.
 
It's amazing the music industry makes any money at all with their atrocious business sense. Apparently to them the key to selling music is to make sure no one ever hears their music.

Sorry to say, not much you can do. Youtube is just an intermediary in this. If someone claims infringement they just comply.
 
As much as it might suck not to hear the commentary, can you upload it without the audio?

I had Brumbacks promo get flagged by Orchid music on Youtube, I bought the rights to the music from DAWN music. When I disputed it I never heard anymore about it. I did a search and it looks like Orchid claims most of the music is theirs when they actually have very few they own the rights to.
 
They use software to identify their songs and have no idea whether it's background music or dubbed in as no human ever looks at it. All you can do is shake your head and move on. Well there's that and then of course identify all the artists associated with that label and always remember never to forget to "borrow" the songs you like from them instead of buying them. It's not the whole recording industry that has taken this stance and it's pretty easy to figure out with a little research who to support and who to boycott. These people are like the dinosaurs who didn't notice the world changed and they were going extinct until it was way too late. They're too stupid to understand that the war is already over and they are the losers so they confront and piss off instead of looking for a new business model that works.
 
Ever try vemio.com instead of youtube? I think TAR had the same issue with the Beckley VS Bustamante match. And vemio allowed the upload.

There is a form you can fill out to dispute it. Fill it out and describe the fair use and that's it. YT will probably decide in your favor since you recorded an event.

I did exactly that and quoted the portion of the fair use that involves incidental reproduction. I was just curious if anyone had bothered to fight with them and what their experience was. I see that the video is now available while the dispute process happens. So that is nice to see.

I just had a mental image of of giant virtual Indiana Jones and the Lost Ark type warehouse where all those requests go never to be seen or heard from again.

Now YouTube will yank shit down in a hurry if you file a take down notice with them but I guess since they probably wont get sued over fair use too much they dont give too much of a shit about those forms.
 
On the download side, I also recently found out that programs designed to enable you to download video content have been crippled by YouTube and no longer work. You can only watch via live video streaming and no more time-shift recording. If anyone knows of any program that can still capture YouTube videos, I would appreciate some leads. There are times when you have no WiFi or 3/4G access and can only watch downloaded video. YouTube's new policy no longer gives you this flexibility, even though you have no intention of ever profiting from it.

I have a video with a Stevie Ray Vaughn song playing in the background, you tube flagged it, I disputed it. I filled out the form you talked about, it has been 2-3 years and I haven't heard anything from them yet. The music is still playing in the video but the video is blocked in some countries.

They have software that picks up on the music, just like the phone app that listens to a song and tells you what it is.

There are many programs that allow this. I use Internet Download Manager. It's virtually impossible for YouTube or any other broadcaster to stop recording of the videos because the video technically resides on your hard drive as it downloads to your drive in a buffer state and plays from your hard drive rather than from the server. Thus the recording clients are taking it from the buffered version.

In fact if you go to the net you can find out where the video lives on your hard drive in the temporary files and save it to another place. All the recording software does is to do that for you.

Probably. All these new "social media" and Internet 2.0 sites rely on algorithims to handle their business. Thus unless you find a way to hack their algo you have almost no chance to have an actual human look at your problem and flip the relevant switches.

The digital age will change IP laws, like it or not.

i put up a 1 minute long video of myself shooting some balls last week at the pool hall and there was a radio station playing some music in the background and now its blocked by youtube.

Well, one claim has been released. The other is still awaiting a response. Looks like this may not be as bad of a process as I thought it would be. If EMI releases the claim as well, I think I will dispute all of the ones that aren't blocking my content as well.


This is what I originally said to dispute their claims:

The music in this video is music that is being played in the event center. My microphones picked the background audio up. This clearly falls within the "incidental and fortuitous reproduction" portion of fair use. The music in the background has nothing to do with the content of the video and I would appreciate this video being unblocked along with any others that may be blocked for the same reason. Thank you.
