It's a slam dunk for the court to uphold the small claim ruling.

You can't squeeze blood with that judgement but you can dog them, attach their bank accounts and wages, and hound them for 10 years after you win, then renew it for 10 more years.

Maybe you can get some more money for your additional expenses? Once the judge hears the mediation story he will not be sympathetic at all to Tony. That will hurt him. What a jackass!

We're talking about our legal system here. Nothing is slam dunk. Lawyers think differently than you and me. Judges are just lawyers paid to decide which other lawyer knows the coded law the best.

Personally, I hope Action Central drills the bastard. If Tony were on this side of the continent and played these games, Vito, Guido or Luka would pay him a visit and make him an offer he couldn't refuse. Tony gave every other tournament promoter a bad name. This is really one sad case.

To me, the saddest part is Tony never even made a serious attempt to rectify the situation.

A good friend of mine is in the judgement recovery business and told me some stuff just the other day:

-Approximately 75% of all judgements are never paid

-Bankruptcy pretty much ruins any chance of payment

-He charges no less than 40% of the judgement for his services, which usually means finding the money (if there is any), and filing with the courts to freeze and seize it, which can take months or years. If he doesn't think there is money to be found, he won't even bother with taking the client.

Hope Tony pays you, and that you time and effort are worth something.

In NY i got a judgment against a business - i turned it over to the City Marshall's Office and he collected $3K within a month for a measly fee of $35 or so. There should be some govt outfit that helps u-ask the court clerk if you dont know.



In California the way it was when I last had a judgment against a bad account in 1997, after a waiting period, and no payment of a judgment, you had go before a judge again. Requesting a Writ of Execution on your Judgment. More fee, but they got added to the judgment.:smile:

Depending on the County were the Writ of Execution is to be served, you either pay a Marshals Deputy, Deputy Sheriffs, or Constable of a Justice Court to serve the judgment. Those fees were also added to the judgment.:)

The fun part is telling the Officer of the Court who you hired as your to be your debt collector, were he or she must go, and what they must go after that the defendent owns, like a Car, Checking, or Saving Account, or other property to satisfy the judgment.

If you have ZERO Ideas as to where the Looser aka Defendant keeps their money, or other property. You are SOL, as it is not the job of the officer of the court to find accents, it is on the person who has the judgment to find the accents.

BTW some court use to have booklets for people with judgments explaining what is necessary for the officer of the court to have to collect the judgment. Like Vehicle Description with VIN (hope they own it free and clear) ,Bank Name, Location of Branch, Bank Address, Account Number, etc.

Also most court clerks don’t help, as it would make them guilty of giving “legal” advice, without being a lawyer.

At this point, I WOULD gladly pay $100 to have the sheriff collect the cash for me from Annigoni. I am going to check into that.

Jeff, if he owns a business (pool hall) you can do a "till tap" where a deputy/marshall stands at the register and collects money as it is deposited during the course of business. I had a judgment once against a Tire shop and got all my money this way!

That is true, plus the business when under control of the Sheriff, or Marshal, becomes CASH ONLY. No Credit Cards, or Check Transaction. If you install a "keeper" they stay, and take money as money comes in, on a till tap is is only one hit on the till then they leave.

I heard Tony is closing down the pool room in Fairfield pretty quickly, if he hasn't already. I would assume that he doesn't have any other sort of income, and wouldn't be suprised if a bankruptcy filing comes shortly. I guess no one is getting paid even with the court decision?

I am a 72 year old newbie in Davis, CA. I have been playing pool for only two years. I have been to Tony's Two Cushion Club only a couple of times because it is 30+ miles from my home. I was impressed with the tables, historical artifacts, blues/jazz music, other players who were eager to help me, and with Tony. He was friendly, helpful, and generous with his time. I am sorry to hear about this mess he and you guys are in. Not fun as soon as attorneys get involved. Nobody usually wins when that happens except attorneys. I just hope the Two Cushion Club does not close.

Not a good sign

Stopped by the Two Cushion a couple of weeks ago and it was closed up tight at 1 PM....Used to open at 12 on the dot. Stopped by there yesterday around 1:30 and closed up again. Last two times I was in there Tony was running it all by himself. Looks like Jeff bailed. Too bad. It was one of the best places to play pool anywhere. OK perhaps Hardtimes, don't get picky. Two Cushion has great tables and equipment ad Tony kept the riffraff away. You could go there and play a little without some drugged out kid wanting to play for some money (or rob you in the parking lot).. As much as I, and some others, love the game it ain't coming back.
