When to draw the line with cue maker?

A lot of you guys want me to name him, but I'll establish comms first, sent him a PM this morning (Sweden time) and he's in the US. I'll give him a day or so to respond. As to the filing theft charges and so on, it's doubtful, we're not even on the same continent. :)

I will gladly admit that I've let this drag on way longer than it should have, I've been a very patient customer, just giving him a friendly question now and then about the progress. He's sent few pics, but I'm not even sure it was of my cue or just a similar looking one.

I'm not a lawyer, but....

In the US this is not a matter of theft. A broken contract is not a criminal matter, it is a civil matter.

"Small Claims Court" is the way this would normally be handled in the US. ("Small" is up to $10,000.) I don't know if you have to be present yourself. Lawyers are not allowed to be present. Here is some info. It kind of looks like you could authorize someone else to represent you. If the court awards damages (return of your deposit) there is also the problem of collecting.

 
except if he has done this before then it is theft and not a civil matter as his intentions were to defraud.

taking a deposit and not delivering the goods is considered theft. otherwise all those scammers that get deposits on roofs and driveways would never have to worry about the cops getting involved.

in any case, just the thought of the cops getting involved gets their attention. especially if you also suggest he maybe doesn't declare his work or the deposit money as income. does he want to take it that far or just return the money you ask him.
 
I had a service business for near 50 years. Learned long ago small claims court was a waste of my time. As Bob Jewett said. A positive decision does not guarantee payment. We've all been got before. If this guy doesn't want to pay or perform service, your recourse is cooked. Good luck!
 
When you buy a custom, it's a commission. Same thing with the painter or sculptor. I think a lot of these guys overbook and take care of the "good" customers. Seems like human nature.
Seems like B.S. to me. I'll be the first to admit not knowing all the particulars here, but...if you were quoted 16 months, 6 years is a complete disregard for the customer in my opinion.
If your wait-list is 6 years when the deal is struck, that is one thing. Overshooting a delivery date by four and a half years is a pant-load as far as I am concerned.
 
I will never in my life purchase a custom cue (unless it was in my hands for purchase as off-the-shelf). Nearly every maker is the same way. Hell no.
I would bet a dime to a dollar that you would never hear of Bob Dzuricky pulling this crap. All Cue-makers are not created equal IMO. I understand "cue-maker time," and I am as patient as they come. That being said, a 16 month delivery quote, and 6 years later, no cue is fraud as far as I am concerned.

A few things:

1. Under promise and over deliver if possible.

2. If you go past the quoted deadline, it is your responsibility to contact the customer. This should be done as soon as you know the deadline won't be met.

3. Taking deposits kills incentive. I have an auto body friend who flat out admitted that he was slow on cars that were paid upfront.

4. Twain said, 'a lie can travel halfway around the world before the truth can tie its shoes.' the same can be said about bad reviews vs good reviews.

My advice is never start a thread bitching about someone's business practice as a tool to try to leverage them to make it right. When has this ever worked?

Name the scumbag and let the flames begin. I can guarantee no matter who it is there will also be a stable of minions to defend them so just spit it out.

If you're not at that point yet suck it up and zip it. No one cares.
 
small claims court isnt a waste of time. if you are mad enough to put some time into getting even or your money back.
if you win you have a judgement against him. you can lien his house or car or whatever your state allows.
i had one against a property once. and he of course never paid. until one day he had a sale pending on it and needed it signed off.

most times you win as they don't bother to even show up so you get full everything you ask for.

no way without a lot of interest and penalties to pay, or no deal. he paid or would lose the sale and all future ones would be a headache..

A GOOD CUE THE EASY WAY

"Please send me pics of your current inventory. Love the tulip wood. How much?"
Money + Shipment = two couldn't be no happier cats.

I wanted one of Scrugg's cues. I have no patience for waiting. (Would take much of the joy away,) Never considered asking Scruggs to build me a cue like I thought it should be. I got exactly what I wanted and am still happy to this day.
