Small claims court

For 10 bucks you can go to your local town court and file a small claims case. Usually $3000 or less. Best part is if the other party doesnt show you win. I have used it several times...never lost. He wont BS a judge and cant prove payment.
 
Same in Canada.

But if you can't serve him the papers yourself, you have to pay a PI to track him down and serve the Summons. That could cost a bit more.

Of course, most people will ask for a judgment that includes court costs.

I don't know if court costs include the cost of serving the paper work. Meaning, I don't know if a Judge will award that. Maybe.

But a good idea as an option tho.

A no show equals a win in court. Then, you have to chase him around to get the money or cue back.

In Canada, if someone dodges you in payment, you can have the Sheriffs Office intervene and you don't want those guys on your tail. They will hire a lock smith, enter your home and start confiscating things.

But all in all, probably more money and hoops that Bishop would prefer not to jump thru. With all the added expense, it will cost more just to prove a point.

It would be much nicer if Ricco would just honor his word. I can honestly see that in this case, Ricco feels justified in getting his property back and not having to pay out.

The only thing is that he involved an innocent person in his little Sting Operation and has caused him a hardship. Thats not fair at all.

He should pay up and suck it up to experience rather than allow someone else to take the fall for his own Fathers undoing.

You have to file in HIS town i believe.
 
Why not go back to the cue owner, explain your situation and see if they'll take less money? Maybe $130 or anything less than $500.

Yally suggested sending you $10. I'd chip in and hope a few more might too, to soften the blow. $10 bucks isn't much, but a little here and there can add up from a group of us. Sorry about your problem!

I've sent money to people on this forum and didn't ask for anything in return. They were in a jam and I tried to help. Don't change, just be more cautious. You're a good guy, Bishop.

Most juristictions serve by certified mail.These are minor civil suits, no lawyers. If they make you serve him, anyone except the person filing the case can serve the other party.

The case is always heard where the transaction occurred. Since you gave the cue to his family member in your home, thats where it is heard.

If you file, you win. The guy wont show, 95% of the time since he has no defense. Often they just pay up to avoid the hastle.

The money has been sent so its over and done with. I really appreciate those who have offered to help but its absolutely not necessary. If anyone's going to fork over anything its going to be Smoothie's Kings most notorious former employee.

The debt would have been to the guy who sent me the cue, not me. Just because I covered the debt doesn't mean he now owes me. At least that's what I think he would argue.

I'm thinking without a clear documented transaction it might end up being a waste of time and energy.
