Need help with a purchase I made on AZ

Hello, I'm not sure if this is the right place to post. However recently I made a purchase on here by the name "Marc". I purchased a Lomax 3 piece jump cue from him and before I paid I asked the condition and does it roll straight he PM that it rolled straight and is in good condition. I received the cue rolled it across the table and I would say it's about 2 1/2 credit card roll out , the tip is almost lifting from the table. Also there are dings everywhere and a few really bad chips in the clear coat also dings in the shaft. I contacted Marc and was told I was not in the right and there is nothing wrong with the cue. Posted pics and waited a few days because he said he was on the road playing. I paid via PayPal gift so I cannot dispute the transaction and this is my first issue here on AZ. My question is am I screwed or is there something I can do to get my money back.? I have PM Marc several times and keep getting the same response. "There's nothing wrong with the cue and I cannot ship it back".

Would this be Marc from Denver CO?
The cue looks rough, make a video of the shaft, and tip while its being rolled..

I have done biz with the op, tampapool and can vouch for his honesty and integrity.

Regarding paying using the "gift" option on paypal, only use that for money you are willing to risk because your paypal protection disappears when paying that way.

If the cue was described as being in good cond and it arrived dinged up and with a 2+ credit card roll, Marc should unwind the deal right away.

Thank you. I only sent the payment as gift due to his itrader being high I thought he was good business. I have it listed in the for sale forum with the correct description of the cue . Marc is unresponsive now and I think the chances he will refund me is slim to none. Thanks for the kind words Brain. Looking forward to do business with you in the future

I wouldn't give up so fast by listing his cue for sale..
Take my advice, and make a video of the shaft (with tip included)..
If you were truly wronged you'll get your money back..

I reposted the cue with the correct and true information. Marc confirmed he will not refund my payment and insisted he will sell the cue to someone else and for me to ship to them once HE received there payment. No way. I will make a video of the shaft . And I am actually embarrassed to sell a cue in this condition. I think the right thing to do is send it off to get back in the condition it should be in.

I would also recommend taking the for sale ad for this cue down and let Marc have the oppty to make it right.

He may realize he made a bad decision. ;)

Marc Vidal is a pro player and it's derby time. You might have to sit on it for the next 11 days. If the condition is the main thing bothering you though see if he will go half on a refinish from Proficient. Hit the cue though you might love it!

He stated he had a buyer that he wanted me to ship to I declined and that's when he started with the whole he had a buyer and because i didn't ship to that buyer it would take him awhile to resell the cue and he couldn't refund me until he sold it. By the way I am taking down the for sale post and will not sell it until all repairs have been done or keep it. I'm just really upset if I get stuck with it that I will have over $350 invested in this jump cue. Thank you for all your replies
 
This is just a thought, but is there any chance that the climate change cause a slight bend in the shaft to become worse? The chips and dings, well pretty unlikely those all happened during shipping.
 
The pic on the right confirms he said good condition and rolls straight. Pic on the left states there's nothing wrong with the cue? This guy cannot be serious and regardless if he's at the derby or not I've waited days already ,almost a week . I will not give him my phone # everything he wants to say I want proof of no more of his bs.

Your right, it's guys like this that ruin it for everyone. I will never send money as a gift again even though I've sent $1,300 and multiple other deals by gift no problem. Learned my lesson

I have done the same thing, I have gifted money too and allot more the 1300.00 .
And I have been burned too.

Pay pal transaction done with a credit card is pretty bullet proof for the buyer ...

And I figure you had learned your lesson.

My first post I wrote down all things that you did wrong and then rewrote it because
you already knew that you tied your own hands ...
