Gambling and Feds and the Internet

In order for most gov. agencies to consider it gambling, it has to be third parties betting on it or be a game of chance. Pool and billiards is not considered a game of chance, so betting on your own ability to play the game does not violate anti gambling laws in most locations.

Currently according to Wikipedia (so, not an official source), most states use what is called the Dominant Factor Test to determine whether an activity is a game of skill vs. a game of chance and therefore determines the legality of the betting.

THE DFT states that the following 4 conditions must be met in order to be considered a game of skill:

1) Participants must have a distinct possibility of exercising skill and must have sufficient data upon which to calculate an informed judgment.

2) Participants must have the opportunity to exercise the skill, and the general class of participants must possess the skill.

3) Skill or the competitors efforts must sufficiently govern the results.

4)The standard of skill must be known to the participants, and this standard must govern the results.


Now, given the 4 conditions above, I wonder what a judge would rule when the element of a handicap is involved. Wouldn't the presence of a handicap increase the probability of chance determining the outcome of the game and thus the legal status of the betting?

I have to agree with fatboy. It protection for all of us and for the pool world. It could just ruin everything. It would lead to them looking at where some peoples money to gamble and stake players is generated from. Right or wrong silence is the best kept secret.

they already did. back around the year 2001. that was why they sold out to ebay. back then, paypal was the prefered method to transfer money to offshore books. soon after they sold to ebay, neteller was born.

Investigation?

I am certain that the authoirities know well what goes on here and in and all other gambling circles. You must remeber since 911 the level of cyber security has increased exponentially. With a high level search of the internet they could learn about most every bit of big action from coast to coast. As this country leans towards becoming all the more puritanical and restrictive to personal freedoms you may be surprised what is deemed unacceptable to the powers that be.

If people do recognize a potential threat, they should smarten up a bit with the online chatter. If those on an action list want to continue they should exchnage emails/phone numbers and keep all talk of $ amounts under wraps. This advice is for the recreational online rail sweaters.

Openly calling out people to gamble for tens of thousands of dollars is foolish. For those bragging here about winning games of $10,00-50,000 or more, you must be more cautious. Statements here could be taken as an admision of guilt, or as least argued as such. Couupled with a forensic accounting search of a blatant money trail it would be a slam dunk. If this were being investigated it would be so very easy to roundup dozens of involved individuals in one fell swoop. Then work on lesser involved individuals to flip on others. Just like they do all the time.

Defending any legal accusations is exhausting to say the least. So please be careful here.

Thanks for the heads up Fatboy...I personally am not worried, but it pays to be careful.

You see, I don't gamble. I had a long broke drive home after spending my 21st birthday weekend in Reno. The hours of driving gave me time to realize that gambling is a business, and since I'm not in that business, it's best for me to stay away.

The money I lost that weekend was a good tuition to pay. That schooling has saved me countless thousands in the decades since.

(edit) I agree with other who say that the Government greed for money is behind this. It's certainly NOT about protecting the public. One of the biggest lies ever: "Hi, I'm from the Government and I'm here to help you."

On the theme of Government infiltrators. Decades ago, I was invited to join a militia since my conservative views were well known locally. I politely declined, saying I didn't want to get that close to federal agents...

The IRS Will..

as long as nobody here is booking action, i doubt there would be an issue. feds dont go after gamblers, they go after the bookies...

I wouldn't worry about federal prosecutors, so much, but the IRS is very interested in the amounts of $$$ changing hands in a pool room.. Especially since most of these guys (gamblers) don't file a proper return..
 
I think you are paranoid Eric. The feds have known for 100 years there is gambling in pool, they wouldn't have to infiltrate someone into azbilliards to bust some people gambling at pool.

The amount of money involved isn't worth their time.
 
I got word from someone I know here for a couple years there is a Fed among us, mostly on streams.

i though about that, but i also thought about how much trouble i'd be in if there was gonna be any trouble. I weighed it out and and decided to say something-that should have perhaps been left unsaid. I'm aware of that.

The answer to that is a big no.

Had a few friends busted for conspiracy and add any charge after it you want.

I'd think/hope they would need to see the transfer of $ in the act to bust someone. Good wake-up post for those that like to flash the cash. You never know who's watching.
 
Maybe the FED will get SC5ed repeatedly and give up cause there ends up being no money transaction to bust.

Can a FED bust you for an air barrel?
 
I have been talking about for years that people are being really really dumb with their actions on here.

The idea of an action section by itself put AZ on the radar and my pleas fell on deaf ears. If people want to bet, we have this thing called email and they can do it amongst themselves without posting to a forum.



that makes no sence to me, anyone can make 25 posts and go un noticed, just tell everyone their cue looks good or bump a few sales threads and nobody would notice anything funny about the posts, now lock out people with 1000 posts. it would hard to make 1000 phony posts,


I just got the txt last night and made this thread today, its not related to AZB, and I know lots about staying out of trouble, AZB is 100% safe, theyt are not promoting or booking action. they would be a witness if anything ever went down.


My point of this thread is just be careful thats all, nothing more/less. Know who your talking too

The average housewife in a bowling league gets more action in a year than we do.
