HELP! I sold a cue to a guy on Ebay, he received it and says there are dings?

There are lots of games.

I sent a higher end cue to a cue dealer that posts here. I was asking a fair price to the cue. He wanted to "inspect it", and being an honest guy I sent it to him.

Now mind you we had done a few deals, on lower stuff over the years, but nothing huge.

He gets the cue and has it for a couple weeks or so, and then says that there are some dings in cue. Now mind you I never asked him to send me any money before I sent the cue. I considered him a friend and reputable. He wants me to lower the price so he can get it refinished. I say no, just send it back.

I get the cue and magically there are no dings in the cue. :rolleyes:

I feel he was doing two things.

1.) Most cue dealers have ready buyers. The dealer knows what to buy and how much so they can turn the cue quickly to maximize profits. I think he was "shopping" the cue to a few key buyers.

2.) He was playing, pick it apart, so he can "negotiate a price" game.

I later sold the cue probably here, for more than I offered him the cue for.

Its just part of the game. :rolleyes:

What the **** is wrong with you people? This guy has a fair question and is getting slammed.

He does this crap on here all the time,,,everything revolving around him is shady and BS, check his past and you ll see the general opinion on here of ace...

He wants to return the cue.

The cue took, 10 days to get to him via USPS, which was longer than normal, but I told him even if the weather did anything to the cue, like warpeage or anything, that I had purchased, $600.00 worth of insurance to cover anything that might happen.

What is the right thing to do?

I have pictures, many pictures of up and closeups of the cue that show there was no dings or dents in the cue when it was shipped out. I even marked the tube 'FRAGILE GLASS' in 5 places on the tube. I bubblewrapped the cue and capped in newspaper and sent it in a heavy shipping tube.

Initially he was complaining about the time it took for shipping, then he was complaining about the JOSS Custom, not lining up perfectly, it was 1/8" off, which I even took exact pictures of the cues collars, showing exactly how the names line up and this was on the posting. He offered me $180 less than I was asking for the cue and I accepted the lower price.

I even gave him an option on the Shafts, he went with the JOSS CUSTOM shaft with a Ivory Ferrule and 30" length which are both upgrades.

Who is responsible for the Insurance claim?

Do I refund all his money and go after the Insurance to have the Cue refinished or just take the cash claim and sell the cue for less?

Is it my responsibility, even though I have documentation and pictures that there were no dings no dents and no damage of any kind to the cue when it left my hands?

What is the proper thing to do in everyones opinon?

This is the first, DAMAGE that has ever happened to me in over 300 cue transactions and shipments?

Is the customer trying to pull one over on me because the Names don't line up perfect and is just trying to find a way out of the deal, even though I had a NO REFUND or RETURN with the lower price accepted, of course as long as something was not as described, in which case I would take the cue back.


Give me your opinions and how do I process the claim and how do I prove the claim and do I process the claim or does the buyer process the claim? I have the Insurance Receipt in my possession.

It's unfortuante for sure. It sounds like it could get heated and possibly go against you though I believe you delivered the cue as it was described. Long story short, it sucks. I would check with Ebay and see if the way your auction was set up will protect you from any backlash with them or Paypal. If not, I would agree to the refund on the terms that you get no negative feedback and you have the cue in your hands first. Once said and done I would kindly ask the buyer to buy from someone else in the future.

Sounds rough. I personally take them back and refund, no questions asked. The insurance claim is probably a waste of time if there is no damage to the package.

It hurts to refund a sale, but in the long run, you'll save yourself a lot of aggravation.

Some fool at UPS ran over a picture I sent with glass. They sent it back to me, I filed a claim and they denied it for inadequate packaging. I wasted hours on the claim for a measly $100 -

If it was a Paypal transaction...ebay will ALWAYS side with the buyer. You will want to make certain that he doesn't "switch" the cue on you.

I had a Bose stereo that a guy switched on me and said it didn't work. Ebay debited me.

Ace then felt justified in not following thru properly as any extra money in the guys pocket was going to get spent on drugs and he felt that he was actually doing him a huge favor.

That was the gist of it. When it comes to bad deals, trouble unfortunately seems to follow Ace around.

That is the worst reason I have heard to get out of a deal and not send somebody what was agreed upon after money had exchanged hands. I really hope that isn't true.
 
At this point Im curious what the status is,,,hopefully he did a refund for the guy and donated this dinged up pos the the boys and girl club so they can clean it up with their hard to find cue wax and improve their games with (stolen/burned/whatever) DVDs:grin:
 
Maybe he didn't get the community support form AZ he was looking for so he's off to his next battle, which will be a losing one with eBay or PayPal (if the buyer has a brain) and will get him the negative feedback he no doubt deserves along with the cue returned for refund.

Then we will see some huge post about how buying from him is sort of like charity because of how tough his life is.

Wash, rinse, repeat.
