Get checked at the er asap. If you wait too long the insurance co. Will claim you faking it. i would get a lawyer too.
As many here will likely reel at the thought of hiring a lawyer, just out of dislike for them for one reason or another, I have found that dealing with insurance companies directly can be a real pain in the backside in cases like this. No fault rules, etc, cause both your insurance and his insurance comapny to play nice with each other and offer the least amount of financial security for you should you need it for future medical arising from the accident. They prefer to keep the cash in their coffers and not give two cents about you more than lip service, both will just bide time and hope you don't raise a medical claim or lawsuit.
First rule, See a doctor and document any and all associated problems associated with this accident. Many people have lingering herneated discs from accidents that they later could not afford to have operated on because they never filed a medical claim to start with after an accident.
2)If you are like me and not after scamming the insurance company for tons of money for pain and suffering, but just want to make sure you are compensated for you vehicle, medical, time off from work, rental vehicle, etc, hire an attorney by the hour to be paid upon settlement. Most ambulance chasers want a slice of any settlement and yes those scumsuckers will bilk the insurance company for every penny they think they can get without going to trial in a lawsuit. If you hire one by the hour, you can also fire him if you think he is delaying the process which delays you getting reimbursed, etc.
Case in point: We had a situation where the insurance company of the responsible party was trying to turn fault around onto my wife who was at 0 fault and there was even a cop as a witness, who was also injured more severly than my wife by the party at fault. My attorney was on hourly by my choice and in no hurry to stop the clock and get things done because he was now trying to milk the clock to fatten his side. I was okay with a little of that to get things rolling. I told him exactly where we stood after everything was calculated and settled in our mind as to what the settlement numbers had to be and yet he still delayed. Every letter he fired off to the insurance company cost about $200. I decided to stop his bilking and called the insurance company of the at fault driver directly, told them in simple English terms that I was going to fire my attorney when I hung up and file my own lawsuit the next morning to the tune of XXX if my demands for yyy weren't settled by 9AM the next morning. Amazingly, my attorney called me 15 minutes later saying the insurance company wanted to settle the next morning. My attorney was pissed saying he could have gotten us 4 times as much, and I was pissed we didn't need, want, ask for, nor deserve 4 times as much. That is a major contributor to what's wrong with our insurance and court systems to begin with. Attorneys wanting to get fat off everyone else.
The same delays will happen with attorneys that take a partial % split of the settlement only longer. They also usually get a lot richer and the delay to settle can be a lot longer, and you can't fire them as easily. Pick your poison.
Bottom line..... see a doctor. I hope it is nothing serious. Also, if your vehicle is trashed, rent a nice one until you get yours settled out.
If you think you may need an attorney, you have two ways to go on this issue.
