One pocket rule question

I should know this, but I don't:

If my opponent has no balls yet, and all of the remaining balls are above the headstring,then he scratches, what happens? Do I have to kick at something or is there some rule that allows for a ball to be spotted? It happened to me at a tournament this weekend, but I was winning pretty easily so I didn't say anything.
 
You can spot the closest ball up, which is probably a no brained almost every time. I believe incoming player would have the option though.
 
Yes, the head string and if two balls are tied for that position then I believe the lowest numbered ball goes on the spot. Many times it's the shooters choice.
The onepocket.org rules say that it is the higher-numbered ball. The WPA/WSR say that the incoming player may choose which of two equally near balls to spot, which allows for balls sets that are not numbered.
 
I thought it was the farthest north ball that spots, because those closer to head string are less out of play??

I believe you are correct. Highest numbered ball.

That makes sense but the rule comes from before one pocket was played when that wasn't a consideration.
