You're in the ballpark John but it's not up to the host or platform to determine infringement as this is up to the courtPoolTees can allege infringement but it's up to the paltform provider, Ebay, Facebook, MySpace, etc... to take the action of removing content that it feels is infringing. If they do it or not doesn't mean that the person making the allegations are right or wrong it just means that the platform provider feels warranted in making the decision they did ....

If pool was more popular there would be a lot of shops that have similar products and names, since its not that popular its a smaller sampling size.

I see Mike is still the decider ain't nothing changed. I was really impressed by some of you cyber sleuths. I do most of my detective work by smell. Its always been easy for me to sniff out a rat. I think I'm going to take me a little nap an go fishin in the morning. I had a vision I was going to catch a monster in the morning. I don't know if any of you all fish but I registered on a site the other day called AZBZ. I don't know an I'm guessing but I'd say it could be Mikes. What about it does anybody know? That business if it happens to operate in the same locality (trademark has locality) will have no other choice but to excercise their rights on their trademark. Not doing so will be considered as neglect, and they can lose their ability to contest the infrigement in the future. This is the same reason why some seemingly stupid claims of infrigement are filed.
Infrigement is not only about similar products but also diversion from one type of product to another.
You obviously have never owned/run a business - put your life into it, risked basically your life for it, and then have someone try to steal it.
I get what is going on, get that it sucks and is ethically wrong, also get that in todays world ethics have for the most part disappeared.
What I'm really trying to say is how is this a topic on a pool forum, when its really a business to business problem. Just find it odd, and the real reality is that whichever company provides the best service, fastest shipping, and best customer service will be the long term winner. That of course assumes they have a marketable product to begin with.
And your right, I'm not a business owner. Not all that smart, really nothing at all but a pool player that has a computer.
And it should be pointed out that the person that showed the least amount of ethics in this situation is the person that brought the business to business issue to the pool forum. In that respect, I have no problem giving my opinion on the rights/wrongs of the situation.
I owned a store and found one morning a list of wholesale pricing (not my wholesale prices but definitely less than retail) written by one of my employees. The next time he came to work, I confronted him with it and he admitted that he was thinking of opening up a similar store. It should be noted that I was in a town of 11,000 people and had a unique market to sell to. So I fired him on the spot. He stated, how can you fire me for this - I replied, I thought we had a friendly relationship, I gave you a part time job to help give you extra spending money in your pocket, and when should I fire you - after you have told all of my customers your 'plan'? He did finally open up his own store and I put him out of business in 9 months. It isn't that easy, he found out and even more difficult when I was working against him. But again, I had risked basically my life on this store as I had bought a house 2 months before I opened and was determined to do whatever it took to make it work. Try explain to a wife that if you don't do any business, you don't get a paycheck and then you don't get to keep your house.
