Ripped off by a guy named Rocinante on the forum (please read)

I just wanted to let all the readers here know that this whole thread is out of line. Digitalcrack paid for a cue and it WAS shipped. It's kinda BS you guys all jumping on one persons side without hearing or seeing one shred of evidence. Right now I am consulting my attorney because I beleive Digitalcrack is treading on libel here.

ALSTL, I think you missed out on a good deal on that Schon which went to a user of this board. (who posted his comment in this thread)

Matthew Stanton I also did business with you on that Brunswick/Joss without a problem.

I have been scammed before and I didn't like it and I understand your guys' natural reaction to support Digitalcrack, but this in NO way happened here.
Not only was the transaction completed but he is also trying to resell the cue!

This is my last post to this forum on this matter. Everything is going to the legal end now. Sad it had to come to this.

I still haven't received any money order from you, nor have I been contacted by any state atty office....

I am not taking any sides here. You got your money and you shipped the cue. Did he recieve it yet? If not, why not? Now, what about Rosco? Explanation please! After I hear your side, I will decide for myself who is playing fair here. I have been selling cues for 6 years now and never had a problem like this. I hope it all works out.

Federal Crime

To use the U.S. Post Office to commit fraud is a federal offense. File a complaint with the U.S. Postal Inpector's Office and they'll appear at his doorstep wearing a federal badge and firearm. They've worked for me a couple of times to resolve my complaint.

Do a search at this forum covering posts made in the last 18 months or so because I've posted on this subject before.

Alright. I do not know if he shipped the cue or not. He has told me he shipped the cue (it is on the way) but with no details what he shipped it by. Originally it was suppose to be through UPS as we agreed. If he did ship it simple is I didnt get it. Rocinante: Lets get something straight. I am not trying to sell your cue online. I am selling a BRAND NEW Scruggs I bought from a guy from UCLA which I have his number so you can call him to confirm. PLease dont make assumptions if you do not know. I dont want nothing wrong but you disappeared for a long time not talking to me when I did not recieve the cue. What do you want me to believe. Look, I am not saying you didnt ship the cue. I am saying I did not receive one. What am I suppose to do. It's 400 dollars for god sakes.

Well if I don't see you offering any positive information to help settle this dispute. You stated in your post that you have been scamed before so you should have had the sense to send it registered mail or UPS or FedEx and if you did, what's the tracking #. Where's the proof you sent it? No, instead you come on here crying about everybody taking sides against you! The first thing a liar always does is play stupid or DENY, DENY,DENY. I did not have sex with that women!!!!!!
Even if he wanted to resell the cue, what business is that of yours. Crying about how you didn't screw him isn't going to produce any results!
Why didn't you try and acknowledge the problem and help find a resolution instead of ignoring it and playing stupid. Like we here, really believe your going to go to a lawyer,pleaseeeee. It would be much easier to prove that you sent the cue, than try and collect for slander. OH and by the way you have to prove monetary damage incurred by a person because of slander and there is no compensation for the truth because it wasn't slander. FWIW

Me and Rocinante are currently working it out. He sent it and I didnt receive it. Maybe it is USPS's fault. But yah we are working it out. Thanks for the input and support guys. I really appreciate it since most of you don't know who I am. Thanks!

Thats good to hear. Let us know how it turnes out.

I can tell you that a friend had a cue refinished (I think it was a TAD) and after the cue was refinished and shipped it never made it to his door. The company that did the work made it right with him. When ever we hear someone say they shipped it but we didnt get it we assume they never really shipped it. We are just used to always getting things that have been shipped. But sometimes UPS and others DO make mistakes. Hope it turns out that this is what happend here.

You evidently have been the victim of some extremely bad luck at the Post Office. If you would send your stuff registered mail or at least get a return receipt you could save on attorney's fees.

I have a 3 way deal going with that process. Ebay will present some pressure & I don't purchase from low feedback number members. PayPal will exude more pressure & even try to back charge the member. Finally my Credit Card company will help with FRAUD.

I find that trying to save a few bucks sometimes costs me. The following scenario just happened to me.

I just paid $500 for a used Pechauer. A new one costs $700. The seller had purchased it from someone & wasn't aware of a poor modification. The original owner had the cue drilled & tapped out for a floating bolt. I find this mess & call the seller. The seller sends my money back & deals with the person he bought it from. The seller is a stand up guy. I will now buy the cue from Pechauer, NEW. It is an old out-of-date model.

Well if every seller, and every buyer did the FEEDBACK thing, the system would work better on Flea BAY.....

But Sellers, and Buyers do not many times do the Fee Back thing, so Low, or No Feedback mean just that NO, or Low, as I said the feedback system is not perfect...

People Actions speak Louder than Words or Promises. Personally I have sold a couple of item off this Forum.

The Buyer sent the Money within a Reasonable Period of say they were doing so. I represented the items I was selling Fair & Honestly, and told the buyer if not happy send it back for a REFUND.

Item were Sent Insured, and Trackable, when did the Shipment and it was in the Mail, or UPS, Buyer was Notified the Shipped had their stuff, it was on the way, and Tracking Info. was given to Buyer.

Transaction went 100% Smooth.....
 
Yeah Rocinante made a mistake. I would never ship a cue or have a cue shipped to me with no tracking number. Any cue not shipped to the user by a weeks time is dumb anyways. In the summertime its humid and you know how cues can warp in major change of temperature. Cold to hot that kinda thing. That is why I was so concerned about not receiving the cue. I thought by the time I got it it wil be a shape of a question mark :P.

I talk to ya on the phone and I sold ya a joss I think your a honest guy I would do busines with ya again I hope ya liked the cue def had no prob with our trans action thank you.
 
Things that disappointed me in the transaction:

started typing in all CAPS when he message some things.

Called me an ungrateful POS

claimed he would do sometihng one day then still not do it until a few days later

Claimed he was not online when he was

said the check did not go through when it did (had it on online bank records)

sent cue using usps rather then the ups I paid for and did not even get a confirmation number?

Okay now all that is said and done. Communication is key in a transaction. A person should not just disappear from the face of the earth (exagarration) after he finish selling the cue because there could always be complications. If he did the send the cue why didn't he get some kind of insurance (like via ups tracking system so we know where the item is). Maybe 400 dollars is not that much money to some people but it is a decent sum of change. I believe the seller is responsible for reimbursement of the item or cash for the item if it does not reach where the buyer is. Wouldn;t you guys be pissed off if you paid for an item 2 months ago and still not receive it. Wouldn't you guys be pissed if you were on vacation with friends and worrying if your cue has gotten to your house yet?

I've been tracking Anthony Beeler's Schon on e-bay. Someone with a user id of rprocaccino has been bidding on it, wonder if it's the same guy?

I thought you had your problems resolved with him, sorry to hear you still haven't got the cue. As I posted, I came close to buying a Schon from him earlier this year, glad I didn't.
 
Not to discount your experience with this person, but your transaction is as a seller whereas the issue on the thread is on a transaction as a buyer.
