Well the sledge hammer patent got me

Thats right, Mike has sent his warning to stop or else, good, (not angry, laughing) I've got a tip/ferrule combo I've been waiting to release for a long time, and now that I have the push to get them done and use them, I can't wait. Best part is, I'm going to share it with everyone, that's right, every/anyone can use it, no fee's or patent problems. Still the "Master Blaster".

Boy did that sound almost stupid as hell.

I already talked to another cuemaker about this, and my idea, not only did he Laugh his ass off, but is looking forward to reactions. I'll post pic's when the first couple are done.

He has the patent for the canvas phenolic, dun't he?
Why not just use linen phenolic?
 
It'll cost him more to push the issue in court than he makes from those silly things. If your idea/technique is not identical to his, he has no legitimate arguement. As for patenting the phenolic, that's smoke in your ass. I'll patent maple & screw all of you.

Someone thinks they have an enforceable patent on making a ferrule from Canvas Phenolic?
 
Ii heard that he lost his patent or had to sell it or something like that.not sur eif it is true,but i wouldn't worry about it either way.

I thought he sold the Sledge to McDermott.

Makes no difference if it was sold or not. If he holds the patent then he holds the rights to who can use it. As has been said, others used this design before his patent but actually that is immaterial. He would have to sue to enforce the patent but that is a large gamble on both parties side. He could win and get provable damages, he could win and get those damages plus up to three times the amount in punitive damages and he also might win having his legal fees payed which would ruin most smaller cue makers or he might not win anything.

A side note: Charles Kettering invented the first practical starter for a car in the early part of the twentieth century and put it into Cadillac's. Ford started using the starter in their own vehicles and were promptly sued. The case stayed in the courts for years and both sides spent millions in lawyer and court costs. When the case was finally settled, Kettering won but was only awarded 1.00 to be paid by Ford.

JOey,i heard the same thing.he was forced to sell his patent to Mac b/c he owed them a ton of money.

This is turning into a lot of gossip. I Heard, he heard. He contracted to allow McD to use the Sledge Hammer name and technology. That was told to me by Mike. All the rest is assumptions.
 
maybe it was all made up,either way threatening other cuemakers with legal action over the ferrule/tip is wrong.as others have said he didn't even invent it.

i am not saying legally wrong,i am saying morally wrong.
 
Ok according Mike Gulyassy what is patented is the concept of the ferrule tip combo.. No matter what its made of you have to have his permission to use a one piece ferrule tip combo.. You can purchase yearly rights to use his patent for the low price of $500 per year or if you purchase the ferrule tip combo directly from him you do not need to purchase his patent..
 
Patent protection is given to the first person to invent a product or process, even though someone else may have been the first to file for a patent on that product or process.

Many cases the cost of prosecution are so high that patents are valueless to there owners; the owners cannot afford to protect them.

I am in the process of taking business law and we are covering patents so I thought I would share this information.

Patent infringement may occur even though not all features or parts of the invention are copied
 
I saw a new jump/ break tip at Tiger Products Friday. It had a center of hard leather bordered with phenolic. Kind of like leather inlayed into phenolic. Sounds like an interesting concept that will meet requirments that a tip be made, at least partially, of leather. I think Tiger will be demonstrating them at the SBE along with their new Tiger-X Ultra shaft (their shaft quality went way up and is consistent). I plan to hit some balls with one of the new shafts so I can see for myself how they feel and play.

Sounds like Mike Webb's design a few months ago.
Joey~Wonders what good is a hard break if the cueball doesn't squat after~
 
interesting concept, sounds like it might work out nicely. the power of phenolic and the control of leather. will have to try one when they come out.

martin, did you get any details on the ultra shaft? how is it different than the previous generation x-shaft
