True, but you have to look at it from the perspective of the enforcement.
They catch a very small % of offenders and make the punishment severe for those they do catch.

Getting banned for 5 years for an expired visa ( one-day, supposedly ) is ridiculous compared to what's been going on at the border .

He most likely appeal his sanction under the “exceptional human” clause and get a clearance of some sort.
I’m not 100% certain that’s the name of the clause but there are laws for gifted foreigners that give them some wiggle room on visa violations.

Boy do you have a twisted perception on this situation. The people who want a normal immigration policy are pointing out that while there is zero immigration policy at the borders and millions of people are being allowed to cross illegally, many diseased and felons, here is a productive and legal guest being banned for 5 years for, likely an error or minor infraction. Anyone refusing to acknowledge the hypocrisy, insanity, and illegality of this is beyond reason.
I agree that Orcullo shouldn't be banned for 5 years if it turns out he had a minor visa infraction so I don't know why you're lecturing me about it.
Of course, we in the peanut gallery don't know anything about what actually happened. It's all secondhand and thirdhand Facebook speculation at this point.

He's going to hire a lawyer who's going to grease someone inside the INS and he'll be here way before that 5-yr penalty is up.
Not trying to start a flame session here but just what do you consider 'productive and legal'? Not just DO but do many foreign players claim winnings and pay tax on them? If not how are they different than day laborers that hop the border, get paid in cash and go back to Juarez or wherever?
