I hate to bring this past situation up and I shouldn't have to since it has been corrected, but now Mortuary Mike is putting statements up on this forum that are totally incorrect.
What happened from the beginning was this,
Pumkinhead contacted me in reference to a ITS GEORGE cue case that he was interested in buying.
I contacted him back and let him know that I had a 2x4 Solid Black Leather Its George Case in Good Condition with a few Scratches but nothing major. I was asking for like, $250 plus shipping for the case.
Pumkinhead or Brain71, asked if I would take anything as a partial trade to lower the price. Pumkinhead stated that he had a group of Pool DVDs, there were about 20 DVDs that he would include in the deal and would give me, $150 in cash plus the DVDs.
I told him that I would accept the DVDs and the Cash offer for the case and he sent me the cash payment and I sent him the case. After about a week the Dvds showed up and the Dvds were all copied TAR events and other Copied Dvds. I told him that I could not accept Copied or Pirated DVDs.
He then told me that I did not send him a Its George Case,
I sent him a 'Brunswick By ITS GEORGE Case' and he did not want the case and wanted a refund. Initially, I told him that I would give him a refund, minus the shipping charges, but after thinking about it, I didn't understand that someone would think that an Its George versus an Brunswick By Its George Cue case was a difference, but I decided that I would just refund the total purchase of the cue case.
All the while, Pumkinhead was bad mouthing me about the transaction and I started taking what he was putting in his comments personally.
So, I told him to send back the Cue Case and I processed the Cash Refund.
During this time, I had to go back into the hospital due to another Bone Infection and Blood Fungal Canndida Albican Infection. This kept me in the hospital for the next 2 months while I was being stabilized and had a Picc Line reinstalled and was trying to lower the Fungus in my blood which was killing me. Without too much detail, the DVD situation was not at the top of my concern list.
After I got out of the hospital, I was having a visit from my Cigar Club and two of the members started talking to me about the situation about the DVDs and the whole transaction, I don't know how it got brought up but it did.
Believe it or not one of my Cigar Club members is the USPS Postmaster General, I BS u not, and I told him about the circumstances and that he stated that the Shipping of Copied or Pirated DVDs is a Federal offense and that it is punishable by $100,000 fine and up to 10 years in Prison. He stated that if it were me I would tell the sender of the DVDs if he wants the DVDs to come pick them up from your house or you should just take a video of destroying the videos.
This started a whole pissing match back and forth about Pumkinhead or Brain71 dealing in Pirated/Copied DVDs and that it is a Federal Violation to do this and that I was not going to put myself in danger of this by shipping these back to him.
I explained the situation on AZbilliards forum and explained what was going on.
Hence to say about this time, I closed my small billiard proshop and put everything in storage because I was deathly ill and did not know how long it was going to take to get back to health or if I would survive.
I ended up fighting 6 more deadly staph auerus, candida albican and 4 other mersa and non mersa staph infections in the blood and bone and muscles. Went through 6 surgeries and spent over 500 days in the hospital over the 4 year period I was fighting this.
After a while I just took the higher ground and said, I will send the DVDs back to you and put this whole situation behind us but I had to try to locate the DVDs because they were in boxes in a storage unit and I was in and out of the hospital and finally I lost my right hip/pelvis and 4 inches of my right leg which took the use of my right leg, so I cant lift and move items anymore, so I had to get someone to help me locate the Dvds.
As some more time went by and I couldn't find the DVDs, Brain71 continued to bad mouth me, untruthfully stating that I had sold the Dvds and that is why I hadn't returned them, I told him over and over the situation that I was in, but he didn't care he said, "I don't give a shit what personal things u are going through, just send me my DVDs back'.
After this, I told him I would send him, $25.00 cash to cover the time it was taking to locate the DVds, but to stop back mouthing me and let me recover first and then I would send the DVDs back to him.
Finally, I was able to locate the DVds and they were sent back to Brain71 and he accepted them and sent me confirmation as well as 'delivery confirmation' that he has and had received them and they were even in the 'ORIGINAL Shipping Box and All original Materials Included'
I thought this was behind me, but I guess some people need all the specifics.
Mortuary Mike, now that you have the specifics, please stop posting inaccurate statements about this situation, I would appreciate it.
----I was sent copied/pirated DVDs as a partial payment for a Cue Case
----The case I sold was a 'Brunswick by Its George' not' Its George', but I have never heard these two ever called Chinese knock offs or copies of 'Its Geroge'
----I sent all the Cash funds back to Pumkinhead or Brain71 including the Shipping Charges, immediately when Pumkinhead sent me back the case.
----All that was in dispute was the copied/pirated DVDs that Pumkinhead-Brain71 had sent to me as partial payment and I in initially couldn't send back and then I was concerned about the Federal Violations involved.
----However, After Sending $25.00 cash payment to coverthe time it took me to locate the DVDs, the DVDs were sent back to the original sender to the original address and 'Delivery Confirmed' and the Sender verified that the DVDS were received.
I think I have done everything I can do to rectify this situation and not be beat up anymore for this partial mistake on my part.
This is the whole situation and now please lets this be PUT TO REST,
