Heads up if you import your woods

The worst part is, the US Gov't is/was enforcing a law that does not exist or pertain to American's. They are forcing laws of the country India upon us!!! There are reasons behind this, for those that enjoy doing their homework.

Either way, cover your arse, and keep your powder dry.

I haven't looked into the laws, or done my homework, just what is the deal?
You can import ebony so long as you don't process it into a product? Unlikely.
Or they prohibit the export and it was purchased from a legitimate broker who got it from the black market? My guess is the later. Its pretty hard to make a product without the resources.

There are circuit court judges citing foreign law to explain their decisions. There are also many cases that are dismissed involving muslims so that they can carry out their own justice according to sharia law.

The US agents are saying that Gibson violated the Lacey Act:

"The law ensnaring Gibson is the Lacey Act of 1900, originally passed to regulate trade in bird feathers used for hats and amended in 2008 to cover wood and other plant products. It requires companies to make detailed disclosures about wood imports and bars the purchase of goods exported in violation of a foreign country's laws."

From another article that I read a week or two ago, Gibson had two problems: one was some ebony that was incorrectly labled, and the other, IIRC, was related to some East Indian Rosewood that was illegally exported. The issue with the EIR had something to do with an Indian law that says something to the effect of: if the piece is more than 1/8" thick, it must be processed using Indian labor. I assume the search recovered some thicker stock.

It seems minor, but I believe these are the two issues that required a raid with armed agents and multiple plant closures...

As I understand it, Gibson has problems because they were in possession
of Rosewood and Ebony from Madagascar that was not legally exported,
and, they had made the same whoops in 2009.

As with so much of what we once called the Third World, 90% of the
rain forest in Madagascar has been stripped away, with little or no profit
or even benefit going to the people of that island nation.

I like exotic Tropical Hardwoods as much as most anybody, but
enough is enough.
The part about coersion to use Malagasy labor is pure politico-spin hokum.

The same thing came up on Cocobolo many years ago. I bought a lot of it thinking it was going to dry up. Then I found out they made it to where it had to be processed in the country it was coming from. So instead of getting large boards we started seeing very rough cut turning squares coming in. For those of you that have seen the really rough cut turning squares this is probably why. But just like Ivory having to be processed or carved before being exported being the first steps leading up to the total ban, that is probably where this is also headed.

I erased my first three replies to your comment. Since nobody here has any actual idea what went on with Gibson, why don't you do what you always do and tell us how you do it perfectly in your shop.

I don't agree with everything government does, but I believe in the integrity of MOST government employees on a human level. If Gibson is in trouble then a law has been broken. If they were totally innocent & being picked on then SOMEBODY along the line would step up & say something. It's not happening, which tells me there's legitimate reason for the seizure & investigation. Nothing to worry about for cue makers, IMO. Just my thoughts
 
Well....rick's comment belongs in the npr but he isn't far off the mark....I have been following this gibson thing since the first time......I go to the gibson showroom every couple of months and even talking with some workers that I know....belive me this is a crooked thing....gibson has hired 580 new employees in the worst part of this economic downturn and also exports 60% of their products.....thats a good company in my book. The left wing is trying to destroy american jobs and create a nation of consumers...don't think so????......research and you will be shocked.....and paul I happen to know at least a little something that went on with gibson....pm me if interested....and its not just with gibson. There have been a number of these type events with small private buisnesses. Again this isn't the right fourum but pm me and I can tell you what I have learn thru research of the laws in place vs. what is acutally going on....Reading up on the laws is a hobby of mine...I enjoy the reasearch

I agree with you Eric.

Years ago I purchased some EI Rosewood from Schmelke and it came with some scolloping on one edge. I called them and they told me it was the law that the wood had to be processednin India. They apparently ran
the wood through a moulder to comply with the law.

Maybe this applys to this case.

Apparently this is not the first time they have been in trouble.
 
Although originally posted as just a 'heads up', I am glad this post provoked the discussion as my feelings behind the action are apparently the same as many others.
