Why wouldn't you ask what his intentions are? To concede with 4 balls left is ridiculous, even if you are playing Johnny Archer.
Wouldn't you want to give him the benefit of the doubt and make sure he isn't just having momentary frustration or changing a shaft? It's poor sportsmanship, to invoke the "rule" without checking the other player's intention in my opinion.
