Need some advice on an AZ transaction

Situation is that I purchased a cue from a member on AZ and the member shipped it Fedex. The package was tracked and said to be left at my front door. I was home all day that day and their was no knock from Fedex. To shorten the story a bit, I never received the package and the seller didn't insure the package. My question is, is it my responsibility to ask for insurance? Thanks.
 
I always send items signature confirmation required.. ALWAYS! This eliminates this sort of scenario.. JMHO
 
I think its on both of you to both understand what the terms of your transaction are.

As a Seller I would NEVER SHIP ANYTHING OF VALUE, without Insurance. Federal Express is only the hook for what their contract states they are on the hook for. Start with Federal Express, and see if you have any coverage for your loss.
 
Well the seller contacted Fedex and said he is covered for $100.00. It is my fault for assuming that everyone insures their package. Now I have to work it out with the seller, I just don't want to eat the whole $385.00 for something I didn't receive. Either ways it isn't looking good. Thanks for the replies.
 
If I were you I would ask the seller to provide a shipping receipt of some sort to show the address that it was mailed to, or use the tracking info and contact the shipping provider to find out where the package was shipped to. Sometimes (and yes this has happened because Ive done it lol) the seller might have duffed the address and it was delivered to the wrong place. If that were the case thats all on the seller, other than that best of luck in getting this sorted out.
 
mkistamikel, I have confirmed that the address is correct with Fedex. I have asked all my neighbors around and they haven't recieved the package either. I am trying to work out a resolution with the seller now.; Thanks for the tip.....:cool:

Well IMHO you need to contact Federal Express, and ask why the Driver Dropped & Ran, and if the Seller Requested Signature Release, Dort Drop & Run was OK. If Drop and run was OKed by the Seller/Sender you could be SOL. As Federal Express is not real good about paying claims with out a whole lot of aggravation. I wish you GOOD LUCK!
 
Raise hell with fedex, if it says it was delivered but you were home allday then something is not right here. Im talking raise absolute fu*king hell!! Im sure the wheels will turn faster that way (once again I know from experience lol)

This type of thing is getting more common I'm afraid. Listen to this one. Someone got my wife's credit card info, ordered several thousand dollars worth of stuff from a catalog, ordered overnight delivery, and stole the package from our porch!



Now on your situation, unless you have signed a waiver of signature with FedEx, I put this totally on the seller for several reasons:

1) Not requiring a signature - this now I can't blame on the seller entirely because for some home shipping types, the default is signature is not required.

2) Not insuring the package.

Number 2 is inexcusable. This is an oversight and may turn out to be a costly one.

i believe its the sellers fault

i build and sell cues here and on ebay. when a buyer sends me money he has done his part, now its up to me as the seller to deliver his cue. i use the local post office. i ship my cues priority mail, insured and delivery confirmation. i have sold over 300 cues and had only one problem, the us mail snapped one cue butt in half, the insurance payed within a month. i personally don't like the old ' i put it in the mail, so now its your problem ' bs. i think the seller has more responsibility than that.

I found out the hard way this is not always the case. Some companies have a policy with Fed Ex that allows them to leave the package without getting a live signature. Whta this means is that the company may have signed off allowing Fed Ex to leave a package even though you paid for and expected a live person to sign for it. I only know this after having an issue with some sensitive investment documents were left on the floor at the entrance door to a firm once. The person receiving them was my daughter who worked at the firm so I knew they had been left without being signed for. Her bosses had signed off and had never told her. I was plenty PO'ed at Fed Ex and they refunded my delivery costs but ANYONE walking by that office could have picked them up and walked away. I understand this is not the case with the OP but just thought I'd let the AZ members know. Even when you think you have it done properly & securely the shippers are pulling stunts to cut their costs regardless of how it may affect you..

Not really the buyers fault, bit the cue was delivered right?
Probably a neighbor grabbed it up.

I know when I'm expecting a package I am checking all the time for it.

Sucks when something gets stolen, but I can't see the reasoning for it being the sellers problem.

File a complaint with FedEx. Their drivers have permission to driver release deliveries to residential customers. But leaving the package in an unprotected area is not acceptable.
 
If you ship USPS, it only costs an extra few bucks to get a signature confirmation. If you do not pay for insurance, delivery, and signature confirmation, you are taking a risk as a seller that something might happen. If something does happen, you have to eat the cost and learn something. Without signature confirmation, the buyer can say it never showed up even if it did (not saying that is the case here but it happens everyday).

I sold a $90 shaft and spent $10+ to ship because of the insurance and delivery confirmation.

It is the seller's responsibility to ensure proper delivery of a package. It is the buyer's responsibility to pay and provide the correct address. If the buyer says they never received a package and you don't have a signature to prove they did, then IMO as a seller you are SOL. Maybe next time the seller won't be so cheap and spring for the extra $2 to protect themself.

Surely you've called Fedex by now, correct? A lot of times stuff that isn't in the tracking info on the website, may be in another screen in the customer service dept. Call them up and ask if there is any notes. Wasn't home, threw it up on the roof or something.

Call up the local Fedex office that delivers to your area and speak to a manager and tell him the story and ask him to speak to the driver. Hurry up while it might be fresh in the dude's head. Give him all kinds of details that may jog the drivers head. Something about your house, or neighbors houses, describe the package, tell him time of day it was delivered. Try to get the manager to find a way to put you in touch with the driver so you can tell him all that crap yourself. I know the guy delivers thousands of packages, but you need to find ways to jog his memory. Whether it be your house or something around there.

this can't be emphasized any greater, and i don't know if it's a coincidence but i've had issues with FedEx leaving items at my door even if they're shipped "signature required". since then i stick to USPS and CANPOST to get my deliveries, they've never failed me.
 
Hello, I like others here have sold hundreds of items (through my eBay account) but only use UPS BECAUSE I KNOW THE SHIPPING POLICIES. I, like a few others, believe the seller did his due diligence in shipping the item correctly since you asked for no special shipping conditions. However, I don't know FedEX policies and if they are similar to UPS there should be clearly stated policy statements available for you to read regarding their delivery practices. UPS can't leave packages without receiver recognition in open to the public unprotected places (can't remember how they word this) unless authorized (one of the situations described above) and so they leave that UPS sticker on doors asking for a signature and permission to leave the item unattended in front of the door or you can pick it up at the Depot.

Read their policy and see if the driver is in fact at fault in this situation for leaving the package in a compromised location and work a claim against FedEx through their insurance carrier from there.

I was a supervisor at UPS for 10 years. I managed drivers and inside workers. Packages are left on people's porches all the time without signature confirmation. As a matter of fact, UPS left a package at my house today. All the driver did was ring the doorbell and jump back in the truck, leaving the package in plain sight by my front door.

On the driver board when the package is scanned, the driver enters a location of delivery (front door, back door, behind bush, etc.) so that an OMS (operation management specialist) can provide a customer with information if they can't find the pkg.

In fact, UPS drops packages routinely at residential locations. They are required to get a signature at businesses, but not at someone's house. If a person claims that a package was stolen more than once from their house, then a manager will change that address to a signature required residence (I used to put them on and take them off) so that there was a record not allowing the person to say it was stolen.
