Need some advice..

Ok so I will make this as short as possible but I have never been in a situation like that and need some thoughts.

November 2010 I agreed to take payments from a Buyer for a cue and he assured me it would be payed off in a timely manner. He sent me a $300 MO about 4 weeks later. That is the only payment I have received. I have had many promises but no delivery. In the past 2 months I have tried contacting him on here, email, and also telephone with no success. I am stuck on what I should do?? I dont even know where I would send the money to refund him but I do know it has been a HUGE headache trying to get the remaining $1100 for the cue. I am in a position where I need the funds from the cue but I feel bad selling it because he has $300 on the cue. This has been going on for about 6 months and like I said, I just dont know what to do if I cannot get ahold of him.. Thoughts?
 
If I were to finance a car and agree to make monthly payments. See where this is going? And, I made one payment and then none, how long do you think I'd still be able to be driving the car?
Do you think they would chase me for 6 months?
Nope, Repo Man would come a knockin at my door.
And after the car was taken back, do you think they would refund my original payment to them?
Are you financing him and charging him interest on the loan, because thats what you are essentially doing, giving him a loan.
Just be happy that he isn't driving your cue in the mean while.

Blue I beleive the OP still has the cue in his possession.

If so, if you are hard pressed for cash my personal opinion would be to sell it if you could and hold on to the $300 until you do get in touch with him.
 
Yeh that is very true. Its just I know his history and he seemed like a good guy. He is well known on here but obviously I will not disclose his name. Like I said, I have not been in contact with him for about 2 months and I have tried to contact him countless times.

IMO - doesn't sound like much of a "timely manner" of payment.
If you feel you've done your best to contact this guy then I'd sell the cue
elsewhere and put $300 aside so you can eventually refund the first guy.
Personally see nothing to feel bad about.
 
Blue, is a hunnert percent correct on this. The only thing you might even consider would be refunding the down money just because you're a nice guy.
I would definitely suspend his One Pocket playing privileges for at least two years.
The nerve of some people. :)
 
I didn't mean to suggest that you keep his money.
In the dumb example I gave, the bank wouldn't refund your money.
I know you would refund his money. It doesn't seem as tho he is concerned with either the cue or his money at this time.
 
sell the cue, hold his 300. when he contacts you send it back to him. if he has any shred of decency he'll understand. if he doesn't let him be angry and who cares. you've waited long enough. any other business he'd be screwed. a pawn shop would have taken it by now and put it up for sale, a lender would have repo'd property, so forth and so on. as long as you do the decent thing and hold on to his cash and send it back when he contacts you, i think you're in the good.
 
You are no longer obligated.

Sell the cue.

Hang onto his money until he contacts you.

Send his money back.

Done.

Case Closed.
 
What right does the guy have to get his money back? The douch bag has held up the seller from moving the cue for six months and dosen't have the stones to answer a PM. I say sell the cue. Move on. If you feel generous sent him 1/2 the money back. People need to carry out the deals they agree too.

You had to bring it up huh? Sadly she is gone Glen :(. I had to sell her when I moved to Fort Collins CO... Soon you will be delivering me a ProAm up like 20 flights of stairs and 2 elevators.. :D Just kidding about the stairs but I am planning on ordering a ProAm this year.
 
I have had a similar but reversed situation going on since last year.
A no-interest loan on his cue that was to be paid off by December 1 2010.
The loan was for half the actual value, I haven't heard a word in 6-months, and I forgot to save his phone number.
Not being involved in your deal it's hard to say, but it seems like you should put the cue up for sale,
and when the original buyer calls you depending on how long it takes, refund part of the deposit.

Free until now, and $50 a month for the next 6-months.

In most places, he forfeits the money if you make attempt to return it and he doesn't claim it for 90 days. That's the case for most property.

If someone leaves a car on your property and you notify them to remove it, and they fail to retrieve it for 90 days, you can claim it as your own and go and register it after the property is awarded to you.

Eric (Fatboy2) could you leave one of your lambos at my house for a while? :grin:
