I don't envy Goldwater in the least. Nor do I enshrine Trudeau. Whether the hotels got paid or not does NOT CHANGE the fact that Trudeau paid out MORE to PLAYERS than he took in during the IPT adventure.

How much money was actually PAID to the players? How much money was taken in from the players, including qualifier participants? All the rest is ugly, the dreams dashed, the expenses incurred, broken promises. But the money was real while it lasted.

I know you want to make this about KT. I only use KT in comparison to Goldwater because Goldwater is showing the same sort of "because I can" bullying tactics that KT employed. Pot, Kettle, Black.

I thought you where a businessman. I assumed you would understand.

Let's say hypothetically, If you offer the worlds best cue case for say 5K and offered a lifetime warranty and I decided to buy one. Now you deliver and it's the worlds most beautiful case. 2 years later it falls apart and I ask you to fix it. Now you tell me that your not honoring the warranty because you didn't receive the kind of revenue you expected. Would you tell me it's OK that I paid 5K because it's gorgeous?

Maybe it is meaningless to you but not to the players who did get paid and who continue to get paid. Those checks cashed.

That money was paid out and is the ONLY point I am making.

If you bought a case from me and I didn't follow through then you would have grounds to seek redress. If a court found that you were right you should be compensated. Simple really. There are no guarantees on the future Nick. You know that. If you think so then perhaps you are mad at yourself for being a sucker.

Yeah it's okay that you paid 5k if you believed the thing you were buying was worth it and that the company would be around. You are responsible for your choices. If my reputation up to that point supported a reasonable assumption that I would do everything I could to honor my promise then you would have to act on that decision. If my reputation were otherwise and you went against it and bought the case anyway then you were foolish.

The players each made their own decisions as to how much of themselves to give to the IPT. They were all aware of KT and his past and chose to follow him. As a group they received far more cash back than they paid out. As individuals some made nice profits and others incurred losses. But all them were playing the odds against a potentially huge payoff.

In your case example you are paying a large up front fee in return for a future promise. Only the qualifier players in the IPT had this happen to them and really only the winner of each qualifier is entitled to damages. Still, as a whole, the IPT paid out more to pool players than it took in.

To make a better example that is more apt. I ask you to pay the cost of materials and give you a case that is worth $5000 with the promise to fix it if something goes wrong. Two years later it breaks and I am unable to fix it. You are out the cost of materials only but have had two years of use of a $5000 case. A judge would likely find that you have suffered no harm, especially if I unable to fulfill the promise.

Don't confuse me with a businessman, someone might think I am somehow in the same class as Randy. :-) Seriously, I am the farthest thing from a businessman. Randy is right in that respect. I fail at business because I don't have the necessary ruthlessness that is needed to succeed. But I succeed at life quite easily and happily! I can pretty much guarantee you that I have more fun each day than most people. The smiles I get and give are worth far more than money.

Yeah, I am pretty sure that any bank would have given up the million bucks if they had a military contract in hand.

And for the record, the military doesn't set the prices. There are many ways to achieve government and military contracts and the government often pays a far higher price than it needs to for goods and services. As I know being one who worked for the government, and who also was in the Air Force and one who sells to the military.

Quite apart from the moral aspects, in a legal perspective this is a flawed contention.....try selling raffle tickets for a car and then inform the winner that the prize does not exist.....then see if the courts decide that only the winner is entitled to at least his ticket money back;)

:confused: Legally, your ability or inability to fulfil the promise has no bearing whatsoever on whether the judge would find that the plaintiff has or has not suffered harm.

However it obviously may have considerable effect on whether there was any realistic prospect of the plaintiff ever receiving settlement of any monetary award the judge might make in respect of that harm:)

I mean to say that the amount of compensation might be affected by my ability to compensate. For example if I were in an accident and completely unable to fulfill the promise then perhaps the court would take that as mitigating circumstances.

That is of course a competely different contention from the one you first raised.

The harm (financial or otherwise, in this hypothetical case probably financial only) would almost certainly be assessed without taking any account of your circumstances or ability to pay. In this case the court might decide for example that it would have been a reasonable expectation for the cue to have been used for say 10 years, therefore 80% of its useful life ($4,000/-) has been lost by your failure to provide the guaranteed repair/replacement, or if it was reasonably repairable to the same standard by some other third party the court might asses the financial loss to be the cost of that repair, probably eventually plumping for the lesser of the two amounts plus any costs etc.

Would the court reduce the corresponding amount they ordered you or your company to pay because of the state of your personal or company finances? Probably not in this case. However they would certainly take those mitigating factors into account later when assessing any penalties to be handed down to you for failing to fulfil the order made by the court, if that's what transpired in due course:)
