I'm glad to hear you and your employees were not hurt. That being said, I'm a police officer and see this type of thing all the time (sadly). There are several reasons the driver was not cited.
First, it happened on private property. Save for about two violations on private property (a privately owned parking lot), generally we are not allowed to enforce state traffic codes.
Second, the accident was not a result of illegal activity that started on the public road/highway. If it started out as a car chase and ended in your back room, the driver would have been arrested.
Third, if the driver was deemed to have been impaired by the use of alcohol or drugs, he/she would have been arrested.
I hope this clears up some of the confusion. I'm sure the local law enforcement brothers did all they could given the situation.
ah thanks for clearing that up. I guess it boils down to getting into an accident/honest mistake, and the person already is having a pretty bad day even without criminal charges.
Even so, I'd say she needs to have the license taken away, her judgment isn't working anymore. It's a danger to other people to let her continue driving.

This could have turned out worst, so I'm glad you came out alive. About two years ago, a guy I knew from high school was killed at work (public electric ulity service worker), by a woman driver in a ford focus who ran him down and crashed into a wall. She let her insurance lapse, unemployed, and had no assets for the grieving family to recover. She didn't even bother apologizing. The police refrained from giving her a ticket after she claimed that she was trying to avoid a bicyclist.

RE: flushing. Here's what happened. No, I didn't remember to flush. Also, the lid was still up. While I'm on the phone with 911 I realized this and ran back into the bathroom to flush. Funny shit. Literally.

As a former officer(years ago ) myself, you are right about how often this happens. Coincidentally in my city a few weeks ago an elderly gentleman did the same thing in front of where I shop, a Safeway. However it was a little more tragic. The local girl scout cookie drive was going on and many were at chairs and tables right in front of the store where the handicap parking his. As it turned out not a good choice of places to camp(pun)
He plawed into all of them sending several to hospital with broken bones and injuries. Thanks goodness noone was killed as in this case also very lucky. The tournament could have been going on and lots of people standing around there.

In my mind, there's a difference between laughing at what happened after the fact and actually looking for a way to cause it.
The only comical thing about this entire situation is that I was on the can.

I don't really see any need to arrest or cite a 78 year old woman for having poor reflexes. However, I really hope one's license gets revoked when something like this happens.
It's sad, as I know that driving is part of independence for most people and it is very painful to lose that as one gets older. But how is she going to feel if she mows over a kid next time? A better question is, how would the victim's family feel?
If one does not lose her license when something like this happens and later kills someone with her car, I would hope that the victim's family would have a good case to sue the DMV or the state.
As inconvenient as it would be, I really wouldn't mind if we were all required to take a thorough driving test every year or two, regardless of age. I would think it wouldn't be too hard to devise a test that could identify those whose driving skills are this poor.
Anyway, thank God no one was hurt in this incident. Kudos to you, Eric, for having a good sense of humor about all this and thanks for sharing your story with us.

Wow I have been to your place on occasion. I believe the last time I was with Shannon Fitch or Cylis Carter (can't remember). Sorry to hear about that though. Now, if that table is totaled frame wise, and is setup with tighter pockets I would be willing to buy that portion of whats left to tighten up my Gold Crown 4 :thumbup:
