Somebody make a move.....it probably needs to be you Monto -- pretty weird to send partial payment via PayPal and then send the balance via Western Union without somebody agreeing to this upfront.

Just my $.03 but this thread needs to go away until it's resolved. Via knows me and can tell you I'm a straight shooter -- sorry for your troubles, Ken :)

1.If i lift the claim than i cannot claim again.
2.His account is frozen to the extent that he cannot withdraw money from his account.but he is allowed to make a refund to me thru the claims process and dispute will be automatically close.
3.i dont have any interest in carrying on this thread.I am already harrased to the bone to get my own money.
4.i bought a cue.paid for it and dont get it.still i do not claim any damages.
5.this guy intentionally took money from two people for same cue.
6.i have documentary evidence of everything i am saying.
7.if he does not pay me paypal will give me claim.
8.now he is buying time that with time that after some days if i dont escalate the matter the claim will close automatically.
9.that is not going to happen.if i dont recieve my money by tonight i will escalate this matter further.
10.All i want is my money what i paid

If u r not satisfied u can call or mail paypal and they can clear all ur doubts

OK, I'm going to take sides on this one with MONTO!!!! He pays for a cue that the seller in essence sold twice. That is just wrong and there is NO excuse for it. Common sense says that all you need to do as a seller is tell the second party that the cue is sold pending payment and that if the deal falls through, you will let them know and they have second option to buy the cue.

I haven't researched it as some here have, but I can't believe that Pay Pal would not allow someone to fund their account to settle a dispute. Seems like Jforney is just being stubborn and hasn't looked into it himself either.

Bottom line.....Jforney F'd up and is not making enough effort to make right on the botched deal. Monto should NOT lift the claim until he has been refunded........no way, no how!!

This was my initial thought about resolving the matter at hand. Only way something could go wrong is if the middle man ran off with the money order. Can anyone vouch for Marcus so we know he will not run with the money!?!?:D Well, it seems that everything will be ok since the Paypal claim doesn't need to be lifted to refund the money.
BTW, the last time I sent money through paypal it took a few days also. I think it is called an echeck. If you have a debit or credit card linked to your paypal account, I think it is instant. Mine is linked to my bank account and the only option I had to send money was through echeck, and was not instant.

The Facts...

I too have done business with Jeff that was flawless but here is the facts...
1. Jeff took payment from two different people for the same cue.
2. Jeff moved the money from both transactions to his bank account.
3. Neither side is willing to budge as far as what is to be done to correct the situation.

My only thoughts as far as Jeff's side are.
1. You were in the middle of transferring the funds so you have a lot of money tied up that is limbo.
2. You feel that you need to have the claim lifted so that the money will finish its transfer to your account.
3. You need to pay the claim or Paypal will take it from you...If you have never shipped the product to the customer and can not prove that you have then it is only a matter of time.

My thoughts to Monto are.
1. You have done nothing wrong and I would relax as Jeff is going to have to fix it.
2. If he doesn't fix it... Then Paypal will get you your money.
3. You have been very nice in not taking this to a claim status already, but that may be the only way to get your money back if Jeff doesn't have the money in his account to pay.
4. I think if there is a next time... you should make the person ship the item you purchased, instead of being the nice guy and just asking for a refund.

I had a fairly smooth transaction with Jeff also. But on this one Jeff ain't doing so hot. I'm still unclear how and why he sold this cue twice. How long did he wait for the initial buyer to pay? Did he wait at all or did he just get a better deal?

After he sold it twice, how could he not bend over backwards to satisfy Monto? Not only is he unapologetic, he gets downright abusive.:mad: And to state that it is all on Monto to make it right or he is washing his hands of the whole thing and keeping Monto's money:eek: WTF is that?

It is very clear to anyone that is paying attention that Jeff is protected if he resolves this through paypal and pays back Monto. It is all on Jeff to make it right NOT Monto.

When things go smoothly everyone is honest and great to do business with. When things go bad you realize what kind of man you are dealing with. Does anyone want to deal with the kind of man Jeff Forney has turned out to be?

Two things:

I use PayPal and money doesn't just 'get transferred'. You have to take a conscious step to transfer money out of your PayPal account to your bank account; and further, he would have transferred a specific amount from PayPal to his bank account. So it is seems specious to suggest that "the funds got transferred"...

Anyway, if he had already transferred the funds from his PayPal account, then how did he "have $1500 to spend on a cue"

And, since there's no indication that he has taken the steps that he now knows he can take (i.e. refunding to settle the dispute), inquiring minds want to know about this 4/15 thread, that's all...

I'm sure I'll get flamed from someone on this; so be it.

My 2 Cents!

I was once involved in an overseas transaction with a paypal dispute.

Trust me the account will let you transfer money to the other party if you have it in your account, available on your credit card, or in the bank. Your account is only "frozen for future transactions".

I would never lift the claim with out a refund!
 
i didn't take the time to read past the first page,but my question is why would you transfer both payments to your bank account,if you knew only one of them could buy the cue?

Thanks everyone for comments and suggestions,for everything everyone said and took time out spare a thought whether for my side or jeff's.

The refund to paypal i belive has been issued but not money has not yet hit my account once it does i will let everyone know.

This could have been resolved much earlier and in much more dignified manner.But i guess i guess this was destiny.

Jforney36 has realised he did a mistake and i am sure he wil not try this again and also everyone who will read this thread would not attempt the same thing ever.we are all humans and we all make mistakes.we are all part of a small pool loving family.

I guess we should forgive Jforney36, forget the incident and move on.he has made some good deals in past.on the basis of past record we should all give hime a second chance.

Kudos to u Bhupinder, rep for u! After all his name callings and stuffs (which turned me off totally), you are still so magnanimous.. I would ultimately forgive him if I were in ur shoes, but I might not have been able to keep my cool like u did.. It will be my pleasure to deal with u the next time..
