That is the final move, and I remember a thread some time ago stating whoever filed the Police report first prevailed with Paypal. So it would behove you to file a report before the dispute so the seller/scammer had no recourse. If not, and the s/s beats you to the punch with a report, it seems Paypal will go after you.

All that is if you process your dispute through PayPal. You don't dispute the seller through PayPal, you dispute PayPal through your bank. Then PayPal has to answer to your bank, not you answering to PayPal. As I said, both times I dealt with switched goods on a PayPal transaction, I disputed through my bank and that was the end of it. The scammer won't jump through PayPal's hoops, he's committing fraud and at some point will quit before it turns into prosecution.

AmEX, for example, will NOT let one of its customer fall victim to a scam when paying with one of the cards, won't happen. PayPal will allow it, AmEx won't. File your dispute with AmEX, let PayPal deal with them, see who pushes who around.

After zero communication with this seller I received my notice of refund through PayPal.

I saw that the seller had his first post the day he offered this cue and had a eTrader feedback, and that looked plenty fishy to me, so I PayPaled him with a credit card.

I saw that hew was a seller that joined AZ to sell this cue and had no history with the community so I paid him through PayPal with a credit card.

I saw that even when he saw his cue and his pricing had created a feeding frenzy he decided to continue the sale so I PayPaled him with a credit card.

I saw that he obviously knew what he had and still decided to under price it so I PayPaled him with a credit card.

Anyway, to those of you that were concerned about my money, I totally appreciate your concern but I have been refunded.

To Danktress who requested the honor of doing this deal, proceed in anyway way you feel safe, I suggest

PayPal funded with a credit card.

There is definitely something funny going on.
The above member(poolplayer1714) jerked me around on a justis case.
He had it for sale here and ebay. I asked him repetedly to buy it and I got ignored. He ended the auction early and marked it sold on here.
Now these two guys are tied together from itrader. Definitely something fishy.

Seller protection:
For example, I just sold a 2009 Blackcreek and the buyer will receive it today via USPS express mail. How do I protect myself as the Seller if for some reason the buyer lies to the CC company and says he received "rocks in a tube" or "received a cue tech and not the Blackcreek he ordered" and asked for a charge back refund from his CC company?

Kevin I know you sell many high end cues from Gina and others on ebay. What would you do if someone who bought a Gina from you on ebay got the cue and then lied to his CC company?

PS: I am sure everything will go well with my sale but I always wonder about "what if"...............

Also look at the pics very closely. Compare them side by side with the pics from Proficient.
The Proficient pics are watermarked with there website name.
The OP cropped off the Proficient name.

Yup, that's a "what if" to be concerned about. PayPal will indemnify you up to (I think in your case $5K) if you follow the procedures they lay out for seller protection, basically

1) ship only to the PayPal address and only on payments marked "eligible for seller protection"

2) ship with a week of payment (maybe this is 5 days)

3) on items under $300 ship with delivery confirmation, over $300 signature confirmation (this confirmation has to be provided through a company that provides direct online access - PayPal has to be able to plug some numbers in online and see a signature NO OTHER method will trigger this insurance which means ALL PERSONAL deliveries funded with PayPal are at risk)

4) comply fully with any PayPal investigation

basically, do this and PayPal with guarantee you against charge backs, even for "items not as described"

In your case, USPS Express mail provides online signature conformation so as long as it is domestic, you are fine. USPS provides NO international tracking method that will produce a signature confirmation acceptable to PayPal.

Exactly why I laid off selling on fleabay. When they changed the rules and shifted the burden of proof onto the seller, I said that's enough for me. Was it a move to force out the "small guy"? I personally think so. Big fish can insure their losses so they are covered all the way around.

But if the buyer initiates a charge back through his creditcard company, Paypal will side with buyer?

The buyer has little to no exposure on E-bay. I sold an expensive item, never received payment or communication from the deadbeat. There is no way to leave anything but positive feedback, so you have to rely on E-bay to post a non-paying bidder strike on the buyers feedback. I filed the claim, was refunded the seller fees, but E-bay never posted the NPB strike on the persons feedback history.

I did ship to the confirmed paypal address
The next morning after payment was made
USPS express domestic (well as long as we still conceder Texas a domestic mail) :eek:
The only odd thing about my transaction is the guy I sold the cue to made payment through paypal but when I looked at paypal.com it shows a girl's name not his and a different last name. My first thought was oh no this dude scammed someone else's paypal account to make payment for the cue, but the address he gave me for shipment matched up with the confirmed paypal address on file for the paypal account. I guess it could be boy friend/girl friend living together or husband/wife and wife did not take last name etc........
