Old Guy KO At The Pool Hall

Shorty should have known better than to stalk someone to avoid a confrontation. Shorty provoked the fight and no lawyer who watches this video is going to even try to make a case out of it...even ambulance chasing lawyers know better.

I would agree with you but for two things:

1. If the injured fellow was, in fact, acting like an antagonistic fool there during the previous 96 hours, as was reported, a lawyer would start licking their chops over why didn't the room's employees eject him.

2. Also, and as I stated in a previous post, if the big man in the red t-shirt who just stood around and watched the whole thing happen, then led the injured guy away at the end, if he was, in fact, an employee of the room, then I think an attorney could easily make a case that this inaction was negligent and led to the injury.

And especially with this video being available, I don't see it as a particulary difficult case to prove.

Then there's the real possibility of going after the puncher - does he have any assets? House? Car? Bank account?

Yes, I'm pretty sure a lawyer could weave this into a payday for the injured man.

Assuming this guy was being an antagonistic idiot, even they have rights.

I think the second punch would hang the guy and should.The guys a boxer and needs to pull a low move like that.Man up and just ask the poor drunk if he wants to if not have a bouncer or the owner to have the guy removed.
The owner of that room really needs to take look at who he lets in his room.
I for one would never step one foot in that place.
There's more then just 2 guys in the wrong here.

It looks like the guy that got knocked out had a taser in his hand that he was trying to hide from the guy and then he displays it right before he gets hit???

Of course it's a civil lawsuit. Against the puncher and the pool room. In fact, it's a slam dunk that a personal injury lawyer would take this on contingency after an asset search, just banking on a settlement with the pool room. Hope their insurance is paid up.

Then there's the criminal assault chage. Punchy-boy is in a heap of trouble!

Of course, there needs to be an injury. Yes, he was in pain for a day... not worth a whole lot. Did he lose time from work, could he not "mess" around with the misses, was there an actual injury that required medical attention or just a few bruises and an aspirin?

Nobody is gonna get a payday if there is no serious injury. And even then, it all depends on the jurisdiiction, ....... so nothing is concrete in money exchanging any hands here.

And even then the poolrooms insurance company is gonna argue they cannot stop every instance of violence if they are not aware of it. I don't know any poolrooms with security ?

But in the end, I'm very glad this did not end with a knife, bat, gun, or something else. Like in the old days... a few punches and it's over. Everyone goes back to their business....
 
This talk about lawsuits comes from people watching too much tv.

There isn't going to be a lawsuit. The bar would be much more worried if they over served the guy and he want out and ran someone over.

Not taking anyone's side, but...............

Just because there is not an apparent injury does not mean that there isn't an injury. Any time there is trauma to a person's head, such as a concussion, there can be long-lasting effects that sometimes do not manifest themselves until later down the road.

Just ask any NFL player who's had a concussion.

I think blood is enough to show injury...but I'm convinced puncher can show that the idiot stalked him and provoked him, and that he was simply defending himself.

I'm also convinced that the owner and bouncer will not have a difficult time proving the bouncer had 2 seconds to react to the punches. The guy who got knocked out was the aggressor, and the puncher was simply defending himself. Video shows it all and witnesses will back the punchers know I would.

Any lawyer who pursues this is going to be wasting his or her time and the guy who got knocked out will have wasted a lot of money grasping at straws. Good luck with that. ;)

When the punchee looked at his hand, he got clocked.

When you get that much in a guys face, never take your eyes off his face.

Cause the guy that punched him was watching his face.

I would have to disagree with you on this Mouse, arguing and yelling is one thing, as long as no one is putting their hands on you, by Law you have no defense to punch someone just because they are yelling in your face, so if this was to go to court and the tape is shown the puncher will be the one at fault , he had plenty of time and space to walk away, now in my opinion i dont blame the boxer for decking that idiot(a man can only take so much), but our opinions dont hold up in court, i believe because the bouncer had plenty of time to stop someone from getting hurt and did not even attemp to do his job, by the bouncer being an employee of the owner of this pool room it makes the pool room to be at fault for this mans injuries, so if the man takes this to court, i cant see how he could lose!

He (the punchee) was obviously the aggressor. He was aggressive and threatening towards the boxer. The boxer walked away. He tried to walk away again. The punchee kept getting in his face. He tried to diffuse the situation and the punchee kept trying to escalate it. Interrupting him and repeating himself. It was obvious he was drunk.

If I'm the boxer I'm arguing that I was afraid he was going to pull a weapon or attack me and that given his erratic and bullying behavior the last four days I was scared that he was going to hurt me or someone else and felt like I had to act for the good of everyone present.

The second punch is a problem though IMO.

The outcome will depend on the quality of lawyers and the sympathies of the jury. Which, in Louisiana might go with the boxer. I don't see him suing because I don't see a lawyer taking this on spec and I don't think that he has the resources to do more than write a letter and try to get a quick few thou settlement from the pool hall.

I understand what you are saying Six, but you know as i know, ifs dont count in court, just the facts and the fact is the punchee did not harm the boxer in no physical way and no weapons were pulled, i hope nothing becomes of this, the asshole got what he deserved, iam just speaking from the law side of things, we all have the right to protect ourselfs, but this asshole was so drunk he was really no threat to no one, unless he did pull out a weapon(but he did not), the bouncer is the man to blame for this happening, he let it go on way to long, iam a bouncer myself here in baltimore and we are paid to escort out anyone that is overly intoxicated or trouble makers, as soon as we see it, before someone gets hurt!
