Stolen cue!!! Barry Stewart has my cue.

Man this is horrible...do you think it's possible to maybe offer him some incentive, send him another cue or something to get him to do the right thing. He doesn't care about his reputation obviously. Man that's such a tough one.

Sorry this happened to you, you make great cues too, but it's hard fading losses and even worse you may not even be able to replace that cue in kind.
 
I agree it is wrong of the guy to keep the cue and it is low of him, but I still have not heard how it was shipped to the wrong person. You have to have had some dealings with him at some point otherwise you would not have his address. Is there something else going on behind the scenes that we dont know? Did yall have a bad deal on something else that is making him act this way? Some people are just d-bags, but if he moves that many cues I question why destroy his rep over one cue? I hope he does the right thing and ships it to the owner.

I read it just like you did, but was it a good dealing? Is this guy trying to hold it because he is a d-bag or because their dealings were bad? The comments that the guy is saying makes me think that there is some bad blood between them. ie...he sold the cue 2 days ago when he didnt even have it yet and saying he is not shipping the cue he is gonna keep it. There is always 3 sides to a story so I am curious what the other 2 sides are. I hope the guy is just messing with the OP and is shipping it out. Is the guy on AZ? If so lets get a hold of him to see what the hell is going on.

He has sent me a text.

For you guys that think I jumped the gun. He was texting Dusty at the same time I was. I tried calling and sent a text. He responded to Dust and ignored mine. Barry stated in these texts he was keeping the cue. That's when things changed. I told him I would go public if he didn't contact me.

His text gives me enough to look into legal action. I just want the cue back. When the cue is safely in my hands I will erase this thread.

I don't think based on him outright saying/texting "I'm keeping the cue" that you jumped the gun at all. Problem is if he's not lying and really has a customer for the cue..once it changes hands its over, the new owner has no obligation to pay you as he paid for a cue that now belongs to him and he had no idea it was stolen. I hope you get that cue back..needs to be soon though, in case he does sell it. Good luck and sorry you have to deal with this crap.

Come on Barry, do the right thing here and give the cue back. Make up ANY excuse as to why it took so long or you didn't answer his calls, as long as you give it back we will accept the reason...Come ooon maaaannn....

That's absolutely not how it works. If you buy stolen property, and its proven to be stolen, you have to give it up, and you take a loss for it. (which you would have to file suit on the seller to recover your money) If you knew it was stolen, then you can catch a charge.

The issue here though is, if the cue is even considered stolen by law. Since the shipper is technically not the owner, there may be a case here. Since some texts were sent which may show the person in possession of the cue understands its not his, but he still intends to keep it, and sell it, it may be considered theft under SC state law.

Federally, nothing can really be done, as it would be considered an usolicited shipment of merchandise.

I'll do some research later this evening on SC law and post it. Sometimes when dealing with local police, if its not an obvious law, you need to tell them what statute is broken before they will take you seriously. Especially if they're in a busy area with more serious issues going on.

Also, according to the tracking information, a notice was left the day before he went to pick it up at the post office. Not that it really matters.

In any event, there is always small claims court. You know the person has the merchandise. He picked it up at the post office, and signed for it. Legally, the person that bought the cue is due a cue from you or a refund, so you need to make that right (it sounds like you are making another for him). You might try to contact the police, but if that fails you can still sue him in small claims court and get a judgement against him. Whether or not he follows through after the judgement is another issue, and you need to find ways to obtain the judgement. At the very least you will have a legal basis after the judgement.

If there was bad blood, perhaps it's time to bury the hatchet and offer that cue as a peace offering to settle matters. Escalating it will cost time and money from both parties. If that Barry person truly is a d-bag, and doing it out of selfishness, then stick it to him as best you can.

If you report it to the police(doubt they will get involved)and they investigate....he will be reminded he is falsifying and police report. That gets serious.

If you report this to the police and explain the issue exactly, if they decide to investigate then it is not falsifying or filing a false police report. They will ask questions they need answers to in order to decide if this is an issue they can do something about. (it may very well be a civil matter which they have no power to touch)

Now, if he called them up and told them he watched the guy steal it from his house, this is a different story.

This is likely the legal solution, unless SC has a specific statute about knowingly receiving goods in error.

I don't know if this has been asked yet but how did you have Barry's address in the first place? If it was cause you made him a cue...did you guys have a falling out? It sounds like he's just trying to screw you.

Hi,

On a civil matter like this you can spend about 70 bucks and file pro se in his local area and he will be served to appear before a judge.

Scott has enough evidence where the judge would order the cue to be produced and returned. If he sold it it is Lilkly the judge would sustain a motion and rule in Scott's favor for a monetary settlement. This could include expenses involved.

Hopefully this is a close driving distance.

That was my reasoning for my questions. Something just isn't right. And no offense, this Gracioscues is not the best communicator in the world.

All I know is if you post my name / address / phone number and make idle and some straight threats to me, you better be in the right.
