It's not Bill's decision; it's the Prosecutor's call, and my guess is that the case will be prosecuted. We are talking about a first class felony. It appears that the bad guy was caught red-handed, so you can bet that the Prosecutor will push for a conviction. They love cases where the Defendant is nabbed in the act. My guess is that the one perp in custody pleads gulity and throws himself on the mercy of the Court. Bill, you need to be present so that the Court does not give this clown a slap on the wrist and a couple of weeks in the slammer. No less than 5-7 years in the can is the right punishment for stealing well in excess of $250,000.00 of cues.
