Sorry to hear the outcome of this Mike!! I was praying really hard that they would throw the book at him. I guess if I started stealing and hurting those that loved me the most my prayers would have been answered!!

I will keep praying that sweet justice will be done on the 28th. :smile:

Someone mentions NPR and then another poster comes in crying about their criticism while accusing that poster of being a crybaby.

There couldn't be a more perfect example of the NPR sub-forum.

I just got home from Las Vegas. Here are some facts:

On August 20th, 2012 Mr. Derek Savoie was arrested and charged with Grand Larceny for stealing 3 cues at the Riviera Hotel and Casino.

On August 23th, Mr. Savoie pleaded GUILTY in front of Judge Tobiasson, according to Dectetive Zeh of the Clark County Tourism Crime Unit. Mr. Savoie was sentenced by the court and is scheduled to appear in court again on November 28th.

I accept the court's verdict, but I am extremely disappointed in the DA for offering the plea deal that they did to Mr. Savoie WITHOUT consulting me. I was never consulted and would have never agreed to the deal that the DA offered Mr. Savoie. I am not sure if there is any legal rights that I have, but I would like to explore them.

Message to Mr. Savoie, you probably hit the biggest jackpot of your lifetime with whoever it was that prosecuted your case. Somebody upstairs is looking out for you, and I hope you use it to better your life. From reading your posts, I am not certain. I do feel bad for your wife and family as they have nothing to do with this. I would advice you to make good on your end of the deal with the court.

This is one reason why theft is such a hard crime to prosecute. Even though I personally saw with my own two eyes the whole thing -from the moment that Mr. Savoie walked into the booth, took the cue, and left the booth with the cues without paying- it becomes a he said/she said thing. In this instance, I am lucky to have the cameras backed up my claims.

I am not sure if I can have my say in the next court date, November 28th, but if I do, I would certainly be there to have my piece.

Do you know what the plea arrangement was? If he plead guilty to a felony, regardless of the punishment, he's pretty much screwed.

Look at it from the state's point of view. They would have to prosecute him, defend him, house and feed him, probably to the tune of several hundreds of thousand dollars to give him a proper whipping.

I applaud you Michael for pursuing legally with this guy, but I can only speak from experience here in Chicago. Non-violent crime, and over crowded jails everywhere, usually ends up like this.

Now, if he had priors, especially convictions, or worse, felony convictions, then perhaps it would've been a different story as far as sentencing. Hopefully, and I probably shouldn't put this out there, but of he fails to satisfy the arrangement by the November date, he could possibly do a lil time.

I almost started to feel a twinge of sympathy for this guy and was considering giving him the benefit of the doubt. We all do stupid stuff, lord knows I have done things that I am not proud of but this guy deserves his punishment.
Mike, Sorry to hear that you were taken advantage of by this guy and also sorry to hear of the actions of the D.A.
I have yet to do any business with Omega but I look forward to doing some in the near future. I'll keep my fingers crossed for you on November 28th.

Michael, was this his first arrest/charge or has he had priors? Sorry I didn't feel like scrolling through the pages of bickering if this has already been mentioned. That is weird that they striked that deal without talking to the owner of the cues...you know the person who was the victim here. I will be curious on what you find out there. Best of luck.

I was a public defender when I got out of law school for a few years. I heard alot of interesting defendant stories. One time I went to see a guy in jail on possession of cocaine charges. He tells me, I was sitting there on this wall, minding my own business when this guy comes running around the corner and throws this jacket on me. He disappears and I go and try on the jacket and no sooner do I have it on then a cop comes running around the corner and throws me down, searches me and finds that cocaine on me in the jacket.

Cop's version is he sees the guy involved in a deal, chases him 4 blocks until he gets the guy to the ground and arrests him, whereupon search incident to arrest leads to the discovery of the drugs in his pocket.

So there I am sitting in jail listening to this guys story. He gets done and I looked at him. I said ok, if thats your story we can go with it but I would suggest you try this story out on a few guys in jail and see how it goes over on them, especially if you plan to tell this story to a jury.

This thread reminded me of this case when I read Mr Savoie's story. (the defendant in my story also plead guilty btw and got time served and probation).
 
So I can only imagine, in Derek's twisted imagination, that because he was not convicted of felony larceny but instead pleaded down to misdemeanor jaywalking or something - he was cleared. So if he was cleared, he rationalizes he didn't steal.

That's just freaking rich. This young man has serious issues. Get some help - you're hurting yourself and those close to you.

I am shocked that Derek and his uncle came on this forum and lied about what happened. :eek:

Here is what will happen next - Derek won't do his community service. Derek won't travel all the way back to Las Vega$ for his court on November 28th. Derek will say that his wife's cousin's uncle's brother was very sick and he was helping him during this time so he couldn't do what the court ordered or travel back to Las Vega$. Derek will act as he is the victim once again. A warrant will be put out for Derek and he will be pulled over for speeding on the way to church six months from now and go back to jail.
 
The plea bargain punishment was light yes. But getting banished from the sport you love and getting exposed on Facebook in front of all your family and friends is sweet justice and a lesson a lot of would be cue thieves can learn from this thread.
