How do you go about suing a cue builder? Just want to get my cue back.

My list of the custom cues is here below my post. I love every one of these cues. Honestly, I cannot say that any one is better than the other - they are all made very, very well and could play great for a lifetime with proper care. All the fine people that I bought these cues from were great to deal with- many here on AZ. All of my repair work on these has been done by Troy Downey at Mueller, Scott at Proficient, Cues Directly, Collier Billiards, Ted Harris - like to mention Mike Webb too- who contributes a lot here on AZ -NEVER had one issue at all - tips, ferrules, wraps, joints, whatever!

Point is that there are great folks in this business - A guy who charges the highest prices for his work is not always the best guy to have business dealings. Cue makers are responsible for creating what is a wonderful hobby for many of us- for some- a lifetime hobby- there are many good folks in this business too!

I must make a quick statement so some readers don't say "Dave told me he does not do repair work." I don't do it and will never do repair work but I really enjoy doing the Brunswick conversions, I believe I did two for you and you were kind enough to do a write up here, Thanks for that as well.

You put in the name of the guy I would refer people to ask, that would be Mike Webb, he's been valuable here in another section that I will now mention.

AZBilliards and the Ask the Cuemaker section, hmm, time and time again I see threads like this one and I mention how we NEVER see this crap about people in that section. These threads are always from people who buy elsewhere and then bring the complaints here.

First, that isn't what happened. What happened is that guy A went to keep an eye on guy B who he felt was looking suspicious around houses late at night. Guy B went out of his way to violently attack guy A for no reason and was literally bashing his head into the sidewalk about to cause him death or great bodily harm. Guy A, in fear for his life, shoots guy B in self defense to prevent himself from being murdered. It was fully justified in actuality, and found to be fully justified by a jury. Second, I'm not sure you understand the gist of Florida's stand your ground where the only thing that really changed about the Florida self defense laws with the new "stand your ground" provisions is that no matter where you are you no longer have any duty to do your best to retreat before defending yourself. You pretty much need to be able to prove your case up front though to be eligible for protection from prosecution under stand your ground rather than there being any presumption of innocence. Third, if there had been a witness as you brought up what would have actually happened is that Zimmerman would never have been prosecuted because the witness would have of course substantiated that Zimmerman acted in self defense and had no choice. Fourth, the prosecutors case was super weak from the get go and Zimmerman was probably only charged because Martin was black and the public unjustifiably pressured for his prosecution because of it. Had Martin been white, Zimmerman very likely would never have been charged in this case because the evidence didn't support it.
Read the transcript of the 911 call by Zimmerman as he is told not to follow the guy and meet the cops when they arrive.
Instead he says" These ass holes always get away" and went after him anyway.

In past cases a self defence was not accepted because the one claiming it started the confrontation. Martin was on the phone with his girlfriend during the whole thing. He says he is being followed.

He obviously is in some fear and tries to make it home. Zimmerman was the aggressor. Martin was defending himself from a perceived threat. But again, only a phone witness and a woman who saw it in the dark and could no say what she was seeing.

Had Martin been white Zimmerman probably wouldn't have perceived him as a criminal to begin with and wouldn't have followed him.

When you resemble the last ten criminals in the neighborhood it's bad luck if you're not one. But alas Martin's death likely saved the state a ton of money by now.
 
I am sure Dennis hasn't sold/lost or anything like that. I recently picked up a cue that was sent in for refinish 2 years ago. He's got a lot of work and with the amount of local players that stop in on a daily to get repair work done, its no wonder he cant answer the phone. Not only local players from his area, but a lot of us from Miami drive almost 2 hours when we need work done.
I am not defending Dennis, but what i can say is that i have been there dozens of times and he's always swamped.
To the op, send him a cert letter to send the cue back if he hasn't worked on it. It took 2 years for mine to get refinished yours may be coming up.
Dennis needs to shut that door or move to the boonies.
Those visitors come in for a retip and then stroke him for hours.

D also has the uncanny ability to turn a phone call that should take two minutes into one that may last an hour or more discussing the nuances of cue making with customers who don't know how to put a tip on.......like a lay person trying to discern a complex medical condition with a professional using Dr speak

he needs an administrative assistant

repair work perhaps one day a week or two

walk-ins by appointment

at which time a light at the end of the tunnel may appear, or he may not care about public opinion and continue with his current business model
 
you can excuse all the bad business principles a person has and thats okay. its hard to excuse not replying at all to a customer waitng for too long a time, but if you do business with that person its your fault.

but when someone asks for their cue back and you dont send it that is stealing plain and simple.

the police may not want to get involved. but get a list of all those he is screwing by keeping their cues and send that in and they might take notice at least.

but florida is nice in the winter and a trip to his shop where it seems he lets everyone in, would get results if your cue was still there i would think.

Why should it take an intermediary to get a message to the guy? Just ridiculous. And then does someone owe a favor? :LOL:

After reading this thread it sounds like showing up at his shop and politely requesting your cue back is fairly certain to get the desired outcome.

Some people's kids...........
 
I think you're on the right track. File a police report & sue in small claims court. I doubt he's registered w/ the Better Business Bureau, but be sure to check & file a complaint there. You've been respectful in this text. You may consider letting the cue maker know you're going to out him & his behavior on this board. Another thought since you mention you sent the cue pre-pandemic- the guy may be dead.
The last time I had a problem, small claims court was shut down.
 
Find out the rules for Florida and file a small claim in court, if possible by mail. You could win by default if he is too busy to go to court. :oops:
 
If you haven’t pursued a postal fraud claim, it might be time to do just that very thing.

He needs to move to the boonies imo .
No phone calls during the day .
People like to pick his brain on anything . One guy was picking his brain on breaking when I was there . I wanted to slap the dude with a 2 by 4.
He was actually drawing some pictures of how he breaks .
There are ton of hacks there that change tips and they don't want their tips done by hacks there . But, there's gotta be at least one decent tipper .
Nobody does tips like Dennis but he just needs to pass those jobs up .
Nobody there does refinish and wrap like he does too, so they bug him on that too . There are dozens and dozens of them who like to hang out there . If you can't shut the door and say no, get away.
One great maker here had the best idea. He has a locked gate and nobody comes in without an appointment .
