If you can prove that Glen serves in a fiduciary role for Diamond, then anything he says or does in their name WOULD be on Diamond....contractor or not..

Yeah.... Im sure that a major company is to blame for an independent contractor actions. Or somebody that ORDERS equipment to fix tables? Yeah... Im sure the court is gonna go for that
Don't get me wrong if a business man isnt being honorable for said work being done or staying good on reimbursements than thats shite and I side with you. You can't just go sueing companies or people due to other peoples poor business practice. That's just plain ludicrous or ridiculous at best. All I can say to your legal council is.....

 As all you ever saw in most any pool room was Gold Crowns (not to say every pool room).  As a business, they see the billiards slump, I think it is pretty freaking obvious.  It effects their sales in different ways as they make a wide range of tables for a large number of the public (price points) among many other things.  Quite a different model than Diamond.  And yep, a business has to be profitable, even Diamond.  So you don't think Diamond does it for just the love of giving stuff away do ya?
