Here's something interesting for all of you to chew on. From watching those shows a lot back in the day I can tell you one thing. The law means nothing. The judge has said many times in a case like this it comes down to who they believe and they'll make a ruling based purely on what they thing the truth is not what the law says. I've seen many cases in these small claim court situations where the law seems to be on one persons side but the judge see's through the bullshit and awards it to the other lol





I was on The People's Court tv show 7 or 8 years ago over a classic Corvette sale that a guy tried to stick me on.

After filing a small claims action at my local court, maybe 3 weeks later I received a call from a People's Court producer asking if I'd be interested in having my case heard on their show.

They explained the advantages, not the least of which was that if you win your case, it's actually them who pays you and they pay in full within a couple of weeks after hearing your case. This compared to if you prevail in a civil case, the court may well approve a payment plan based on the paying party's financial situation and, even then, the loser can jerk you around possibly causing you to have to go back to court asking that they compel them to pay you.

Other advantages were that the show pays for your transportation there (NYC) and back home, all meals, and they even set me up in a nice hotel room just a few blocks from their studios in Manhattan.

It provides some good drama on these tv court shows how they make it look like when they order someone to pay, that the money will be coming from that person. The fact that the tv show is paying the judgements and all expenses related to attending is a big inducement for all parties involved. There were even a couple of weenies in the 'green room' who didn't have the sense to wear something appropriate for tv and so the producers sent out for button-down shirts for them.

Whether or not something like this would be a good option for the op here, I couldn't say. You can certainly call these shows to discuss it, even without filing a small claims case.

And, oh yeah, I did win the nearly $4k that I was out.

You know, that episode really needs to be on youtube. I haven't been able to find it there, though. Wonder if anyone has it tapped and can get digitized and uploaded? lol
 
had that happen to me once. Brought a scruggs sneaky, got a frey in the mail. Turned out my scruggs got sent to someone else, and I got their frey. We just shipped each other the right cues without any fuss. Only fuss was getting the shipping money from the original seller, and that wasn't a huge deal.

I'd call my lawyer and ask if it was me, but then my lawyer is my sister.

Well as far as those shows go the law means nothing because essentially both parties are agreeing to have the "judge" act as a mediator and be bound by the decision. And really only the claimant who is looking to get paid is taking the risk because the person being sued will have their debt paid if they lose.

Of course the judge is going to listen to both sides and let the "drama" play out and make the decision based on what she feels is most right and not necessarily strictly according to the law. That's the freedom of being a tv judge.
 
My experience with real judges is similar. They do what they want.

There is something called a bench order. They use it to do almost anything up to and including openly violating the constitution. They actually jail and even imprison people for debt in the US every day which is clearly illegal and in violation of the Constitution but nobody questions a bench warrant.

The magistrates, mediators, and judges in the lower level courts generally don't even know as much about the law as one might suppose and may not have much experience. They often didn't even go to law school. How could they follow the law if they don't know it? It's more like the TV judges than we might like to think...sometimes worse.

Exactly. It's he said she said so you can say the law say this or the law says that but in small claims court the judge is gonna listen to both sides and then just make there decision based on who they think is telling the truth lol
 
I feel bad about this. It was my hoppe blank that Scott had. He already made me three Hoppe conversions, and I told my buddy that he could use the other one that Scott had and get a conversion also. Scott is a good guy and he has made many cues for me and his word is his bond and I know he is going to take care of my buddy.

Would prove it was not a gift.
Then either payment or the cue must be returned. If neither happened, you'd have a pretty stong case.
 
Met the guy whose cue it was supposed to be last night. Damn shame he's a real nice guy i hope it works out

Or you could find out where he plays on a regular basis and post pics in the place and the womens and mens bathrooms. Women are very tenacious in this arena.
